Just like any game developer, they can take content away without refunds. It’s pretty scummy, but it’s also how companies can shut down their servers without legal troubles. In the EULA/TOS it specifically says the money you pay is only to rent and use the content. The entire Cabal are a direct rip off of the Romans, down to the main units from D1. Legionaries (regular Roman soldier) and formed part of a LEGION. Phalanx were an early combat style the Romans stole from the Greeks and Alexander the Great before they invented the legion. Centurions (higher ranking and tougher in Destiny) were simply a more senior legionary in the Roman legions, just like the Cabal. And guess what the primary colour of the Romans was…. I don't think they are similar enough. In lore in 2014 the red legion existed long before 2017's Red War campaign. In lore in 2014 exo's already existed. In 2014 lore the war beasts were mentioned already. 2014 already had the traveler established. In fact, in Halo ODST the traveler was already teased in a poster in the game, so the concept already existed long before any of this. While there might be solid parallels, I don't think it's enough to be a solid case. A lot of Destiny lore already existed in 2014, directly countering their claims. I could be wrong, but I think it's their time to cash out so they're grasping for straws against a company that has been caught plagiarizing images before.

Failsafe reminds me of Cortana from Halo CE... Thats a Bungie game from 2001. The arguments in the lawsuit is so generalized. I don't see how Martineau can win this. Also, the description on conscience transfer doesn't sound the same as the exo transferring in Destiny. 10:59 I can kind of see it. I think a jury might as well. It's not plagiarism, but there are enough ideas taken that cohesively, they can constitute a collection of ideas taken. Too many to be overlooked. Each one is just a modern trope. In their own, they are quite commonly used in story telling. To join them together in such similar ways invite suspicion. 2 failsafes. They are completely different, but they accomplish similar things. Further, why did Destiny 2 name Failsafe as Failsafe. Where did that idea come from? That is not a coincidence. Transference is a trope that is common, but they use it in such a similar way that it arouses suspicion and questions. The same with the Almighty. By itself, it's a trope. It's a thing that must be stopped to save the human race. The story is built around it. Why though? Similarly to Martineau's work, there's already a main villain. Why isn't it enough to just beat the main villain. Why do both stories have a twist of what is essentially a train set on a collision course with a maiden tied to the tracks? Why do both stories have this? Why could Destiny not stop at Gaul or come up with something else than needed to be beat?
