The problem with this is that I wanted to schedule a viewing off Zillow. I just want someone to unlock the door. I don't want that agent's representation. Even with a limited agreement, if that's the only interaction I ever have with that agent, I still owe them commission if I buy that property for SIX MONTHS! That is utterly insane.

I am a agent, and in order to see the property many listing agents are requiring "proof of funds", and prequalified in order to see the property with a agent, and to be personally honest i like this change. Because it cuts across the BS!

@@justcallmebrian793 I am very displeased with it. I historically search for properties myself and have largely handled viewings on my own. Having to sign an agreement with an agent I don't know from Adam made me pass completely on a property this week. You deserve nothing unless you actually represent the buyer, and a buyer who just wants to see a random house on Zillow isn't asking for representation. I couldn't even get the seller's agent to call me back to schedule a viewing. For buyers working with a selected agent, I'm all for these changes and agreements, but it is pretty terrible how difficult it makes the process of finding property for buyers who are not ready for or do not want representation.

Go ahead and find the attorney that you call on Wednesday afternoon to let them know you want them to write an offer up for you by the close of business Friday and submit it to a list agent. Then ask that same attorney to answer their phone all weekend long in anticipation of negotiating a counter offer for you and submit it by 8pm Sunday night. Then ask them to waive their bill Monday afternoon when your offer wasn't accepted. Then, do it all again the next weekend.... I'll be waiting a long time to hear who actually found this attorney....

Big misconceptions here. First, buyers agents do more than just open up a door. There’s a whole transaction on the front and back end that consumers seem to forget. Access to the home for home inspections? What repairs make sense to ask a seller? How would you know your new deed has been transferred to your name? When it actually makes sense to walk away from a home? All this AND more is what your buyers agent helps you with. And before you say you can do it yourself, actually sit down with a reputable buyer agent and ask what they do. The list is long. Second, you (the buyer) are the only one who will know EXACTLY what house you want. Expecting an agent to send you the “perfect home” is unrealistic. Once buyers go out and see homes in person they change their mind, realize that don’t want a pool, a 2 story home, to be close to the freeway, etc. Finding the house you want is the least you can do.

@@jay-alldayy while I agree, the list of things a buyer’s agent, if hired can do is long, your response seems to be heavy agent-centric. I’m willing to bet you’re an agent, or at least have one in your family. To come at someone who’s hiring you to guide them through making one of the largest purchases, in most cases, of their lives and tell them the least you can do is find your own house is a bit off. It’s a job, if you don’t want it, don’t accept it. And there are multiple options, I don’t have to use an agent. Understand people’s needs, and fill those. That’s how you change someone’s perspective, not by telling them the least they can do is do your job while paying you. I agree, a buyer’s agent is important and in some cases, invaluable. But with the new law change, people have to approach home buying a different way.

@@NikkoJ you missed my point about the “least you could do job” thing. For example, no one can tell you what food you like. No one can tell you what clothes you like. No one can tell you who to date. These are all preferences right? The same with a home. Every single home has so many different features & benefits that only you as the buyer can determine if that particular home is something you want. The agent isn’t living there, the buyer is. The buyer is spending thousands of dollars to live somewhere for 2, 4, 7, 10+ years. I would hope that buyer is the one to choose where! An agent can narrow down a list of homes for you, but there is no way an agent can jump inside your mind and manifest the exact home you want. No one can do that for anyone about anything. Second, the agent’s job also includes making sure everyone else does their job (which includes the buyer). Hence, the buyer’s job is to choose which home they want. Then the agent handles pretty much every thing else after that. Does that make sense now?

I don’t see why RE agents should earn so much money for just opening doors, filling out a few documents and earning money from referrals to lawyers, inspectors, pest control, etc. 3% of the home price is way too much. The agents earn $15K + per sale. Wow. Some people earn $15K a year.

I definitely understand that thought, and personally, some agents shouldn't, but we do take all the legal risks with every transaction. The fees for MLS membership, licensing fees, & the marketing costs just to be able to perform our duties to both buyer and seller clients are quite expensive and the housing market is always changing. Good agents who are able to negotiate the best price for their clients, who can guide their clients to closing with reasonable expectations and are knowledgeable about local market conditions and trends, and help clients to understand all their real costs of home ownership are worth paying for. Good agents more or less "pay for themselves" and will likely be able to negotiate seller contributions to buyers agents fees.

@@agentperk Look at Europe! There are no buyer’s agent fees for a seller, only for a buyer. Everyone pays their own fees. That’s how it should be everywhere. I’ve done a lot of for sale by owner and it was inexpensive and easy. If the seller needs a full representation they can go with Clever who charge only 1.5% of sold price plus whatever you decide to pay the buyers agent. It includes 34 photos, home layout, 3D walkthrough, and virtual staging. Redfin is also good - 1.5 % (minimum $5K). I have done a few sales with 6% realtors in the past and they were no better than my FSBO or discount brokers.

I always thought a BBA was an excellent idea from the beginning anyway to help understanding on both sides for agent and buyer. This new change although can complicate things in my opinion moving forward. You just have to love real estate and know your buyers and sellers.

I literally stopped looking ...until the other lawsuits get settled. The buyer agen agreement prrmote illegal behavior. They will be stealing buyers to certain houses. Also... it does not stop the buyer agen to make side deals with the listing agent. I secured a great deal on a rent controlled $1500 rental in a good new york area neighborhool....IL just use that money and invest....lol

I’m in Houston and just noticed the changes on MLS site with my realtor. As an investor I like the change because it forces the listing agent. Also buyers agents to show all properties regardless if it’s a new property or old property for a flip.

1st Time Home Buyers will suffer more. They will not have the equity to use as a down payment, nor will they have the guidance from an experienced Realtor to navigate the process and educate them on getting down payment assistance. Nor will they have someone encouraging them while protecting their earnest money and protecting them from putting an offer in on a home that may not meet the lender conditions. Let’s not mention negotiating repairs and holding the deal together while encouraging the buyer not to give up. It’s a lot more that Realtors do but some will never know because the families that this is most effecting is not complaining because they don’t know how much they need the assistance of Realtors just like they don’t understand the process. They don’t know what they don’t know. Some realtors fight for Affordable Housing and protect their clients as if it is their home. But some will not understand and just go to the listing agent or seller thinking they are getting a great deal.

It is just a lot more work on the buyers side to have to schedule the individual showings on your own, then you need to have some knowledge of how to put in a offer where you are protected. So it would be a good idea to get a lawyer or an agent to do contract to close for a flat fee.

The second biggest issue for agents is agency. For listings agents there will be more situations where buyers will not be represented by their own agent. What will be the listing agents duty to their client when they have to write up a purchase agreement for the buyer who is not represented by a buyer's agent?

Hey S. What if you have an FHA loan, complete inspections, and due to results of the inspection and/or appraisal, you back out. Is the buyer still on the hook for the buyer agent fee? If so, doesn't this negate the privaledge of an FHA protection?

It depend on when you back out and for what reason. Typically if it is not your fault for walking away you will be fine. In the Buyers Brokerage Agreement, there will be a section regarding termination of the contract and compensation.

Its a scam, I am glad I receded the contract immediately before the sellers agent could agree and sign. I saw that I would still have to pay a fee just by the fact that I was in a contract. The agent would have gotten paid even if I terminated the contract for due diligence reasons or any reason. Its a scam. I receded immediately. Its best to take your time and read the buyers brokerage agreement, not to be rushed.

It sound like a reasonable fee, but you can still in most states add that fee to your offer and ask the seller to pay. If a seller has a lot of equity in the home, that is not a big deal to most sellers.

Look on the weekend for sign said FSBO for sale by owner directly and go for a tour yourself and write done the seller phone number then text him your offer if yes let your bank know then go with the seller to the Title Company to deposit some money the house will be pending after that go get inspection send the report to your bank then relax because your bank and the Title company will take care of the rest of the paper , you just have to wait for a call from your bank to tell you go sign and get they key of your dream home and congratulation . All done 🎉🎉

Usually yes, you are entitled to get paid for the work performed thus far. But as self employed individuals they are able to ask for what they think is reasonable and the market will either support this or their lack of business will make then change their policies.

Agents are mostly useless in my opinion. They open the doors and help to fill a few paperwork which probably could be done by yourself.
