Hello professor! ☺️ I just want to ask, paano po makikipagdeal sa taong gumagamit ng "kakasuhan ko kayo ng libel/slander!" para manakot ng mga nagki-criticized sa kanya kahit objective at constructive yung criticism? Ano rin po palang gagawin if in public niyang ginawa yung pananakot sa tao like naipost yung tao na nagcriticized sa Facebook with captions na pananakot nga po na kakasuhan yung tao dahil sa criticism niya?

That is a difficult situation. I would always make sure. As long as it just commentary and not "insulting" to one's honor, it should not be considered libel.

Hello Dean, Binenta po namin yung House & lot, ang naging kasunduan po is Sasakyan na worth 1M yung downpayment tapos installment na po yung balance. Ngayon po is the buyer is cancelling the contract, kinuha po nila yung sasakyan na downpayment sana and they are asking for refund sa installment nila na binigay.Upon checking po wala pa pong 24months yung nahulog nila.I want to confirm po if do we need to pay them sa nahulog nila and how about po dun sa vehicle na binawi nila considering that was the downpayment po. Ano po dapat naming gawin?Salamat po!

It might not as it is technically a loan and Pag-Ibig is not a developer. But one can argue that Pag-Ibig is in the business of giving housing loans

Hi dean, tanong ko lng po 8mnths nlang po kulang namin sa sa monthly payment po pero may 4mnths po kaming delay gsto ni seller na bawiin ung lupa kasi po 3mnths lng po ung naka sulat sa kontrta na palugit maari po bang bawiin nya ang lupa? At this point, negotiate a new deal. But if the seller is refusing, best to consult a local lawyer

Ok po and sir advice so yung bahay na binabayaran namen ngayon its good for more than 4 years payment installment but the owner po pumayag na patirahin kami sa bahay na hinuhulugan namen meron na po ba kaming karapatan tumira kahit installment payment palang po or anytime pwedi niya rin kaming paalisin kung gugustuhin niya thank you po

Depends on the contract if you are allowed. But check with the city. it may not allow you to construct

Good day po atty. Hnanap ko po tlaga to. Ung property s di pa na subdivide pero yung 1 sa heir is benebenta na ung portion nya na ayun sa pinaghatian nila pero hindi pa legal kasi d pa nalipatbsa kanila. Then i paid 50k as down payment at plan ko magnayad ng 150k pero napaisip ako kung magbabayad ba ako ng 150k or mas mababa .ung sabi ng heir is bbigyan nman nya ako ng deed of sale same sa ngyari sa kapitbahay ko. May pinakita po syang deed of sale at copy sakin ng kapit bahay seems ok nman po at nkatayu na ung bahay dun at mga kapit bahay they can prove nman na sila ung owner ng lupa. 2 kami ang nakpag down na parehas na naka concrete na ung bahay namin kasi ung isa na nkapag fully paid na malaki na bahay pero wala pa title kasi d pa po na subdivide. Ano po kaya ang tama kong gawin? Salamat po atty. Sana po mapansin.

Sir just to clarify, the two years is not necessarily calendar years but could also mean the total amount paid for 24 mos.? If you paid in advance the amount for two years, you become covered by the law?

To be qualified, you make two years worth of payments under a payment for ownership. If you paid in advance, then you didn't pay installments.

Atty. what about po regarding sa pagbenta ng condo unit ko na under pa ng bank financing ... my agreement with the buyer is sya ang magtutuloy ng bank ammortization ko until mabayaran nya ang kabuuan ng presyo ng unit. So ang naibayad na ni buyer sa akin is 1% of the total contract price ng earnest money at ang initial down payment of 15% ng total contact price, then ang remaining na balance nya will be devide into 2 payments - 50% upon occupying the unit and the other 50% will be after 5 months. ang question po.. just incase nagmature na ang timeframe na nakalagay sa CTS ano lang po ang pwede marefund ni buyer incase may right sya to refund. Can I also evict them sa condo, kase po they can occupy the unit na kapag nakapagbayad na sila ng first 50% installment payment.

Dear Attorney, meron po sana akong nais ipakita sa inyong deed of absolute sale. Pwede po bang gamitin ang unang pahina ng absolute sale na ibang abogado ginawa tano 1979 pa po. Tapos po attorney walang pirma ng nkasaad na abogado sa unang pahina. at wala rin pong pirma ng aking nanay at tiyahin.
