Sir puwede nyo po ba ko payuhan ano po dapqt gawin sa OR CR ng owner type jeep ko. Nabili ko po ito 7 years ago, ngayon ko lang po nalaman na wala itong OR CR number, kahit po sa LTO computer, pero yearly po sya narerehistro.

It doesn't matter who makes it. As long it contains the terms and conditions your agree upon, then notarized, it should be valid

Hello po Dean. More power to you po. Quick question po, if ang case is pagibig housing loan, part ng requirements nila is transfer ung title sa pangalan ni borrower, wht if na transfer ung title sa borrower pero ayaw ni buyer iproceed ung transaction? What will be the buyers liability po?

Dean, is it legal na ang isang property maybe the subject of three different instruments by the same parties (landowner and same recipients): 1. Deed of Confirmation of Atty's Fee re portion of agri property by landowner/defendant in favor of the lawyer of the opposing party in a litigation of said property. Recipient Lawyer then applied for retention at DAR and was granted landowner's retention (but lawyer and his son unable to transfer ownership of their retention due to pending litigation on the property) but lawyer was able to transfer the unretained portion of his claim to his alleged 'tenants/farmers'. 2. Deeds of Donation by and btwn landowner/defendant and heirs of same lawyer who died during the pendency of the case. (Document submitted by heirs to DENR for segregation of same lot previously granted by DAR as their father's retention and apruval of subdivision/consolidation plan) 3. Deed of Absolute Sale of a Portion of a Registered Land by and btwn landowner/defendant and Heirs of deceased lawyer (same year as the year of deeds of donation)- (Document submitted to ROD for titling). Docs 2&3 executed on same year within span of 2 months after deceased lawyer's son/co-counsel engaged parties to end the litigation of the subject property thru amicable settlement. Thank you po🙏

Good morning Sir.. gusto kong mgtanong dun Sa binili kong lupa dun Sa amin. Kong anu ang gagawin q dahil walang deed of sale tapos walang papel yung lupa na binili q.. ang concern q duon Atty is kung pano mailagay Sa pangalan q na akin yung lupa.. kc puro kasunsuan lng ang pinipirmahan.. kumbaga yung lupa nila na binenta hindi nila pinasurvay... Sana payuhan aq kung anu dapat kung gawin duon Sa lupa

If it's real property, technically foreigner cannot own land. So, might not be valid

Good Day! Atty Dean, Question po, owner ng title nasa abroad sa ngayon, nung nabili niya yung industrial lot SINGLE pa siya, ngayon MARRIED na at hindi alam ng asawa niya sa ngayon na ibebenta niya yung property...sa Deed of absolute sale ok lang ba na yung owner ng title lang ang pipirma kahit MARRIED na siya and SINGLE status ang declare niya same as the title na single nung nabili niya yung industrial Lot wala bang maging legal concern in the near future about that salamat!

Sir Dean, question po what if ang verbal agreement sa lupa na ibebenta at ang deed of sale na pinirmahan ay di pareho/tugma. May laban po ba ang seller na ipaglaban yung verbal na kasunduan?

Hello sir dean, maraming salamat po sa pag discuss tungkol sa deed of sale. Marami po akong natutunan sa inyu. Gusto ko po sanang linawin na, yung deed of sale na ginawa namin, wala pong signature ng buyer peo nakaperma doon yung seller , witness at na notaryo na po. Valid pa rin po ba ang deed of sale na yun kahit walang signature ng buyer? Pero lahat ng impormasyon ay nakasulat naman dun sa deed of sale, ang signature lang talaga ng buyer ay wala. Maraming salamat po😊

kapag walang signature ang buyer, baka hindi valid ang deed of sale. Parang nagkamali ang notaryo noong na notarized ang deed of sale.

PWEDE PO BA NA SPA lang muna ibigay sa buyer at wag muna deeds of sale habang di pa fully paid ang napag usapang babayaran nya sa seller? Hello po ask lang ako kung kailangan bang FULLY PAID ng buyer ang napag usapan assume amount bago gawan ng SPA at DEEDS OF SALE? Kasi ung buyer ko gusto nya ng reservation lang at hulugan. Pwede ba na wag muna sya bigyan ng deeds of sale at SPA dahil hindi nya pa mafully paid ang agreement namin na pasalo, at hindi nya muna pwedeng galawin o irenovate haban di pa nailipat sa kanya ang bahay. Pwede po ba na acknowledgement receipt lang muna ang ibigay sa kanya assurance lang sa seller lalo na kung di naman kmi totally magkakilala. Saka na gagawan ng deeds of sale kapag fully paid na po nya ung napag usapang pera po.

Technically, there is no expiration date on a notarized document. It's up to one of the parties who signed to verify (authenticate) the document in court

Hi Attorney, Affected po ba ang Working days ng office dahil sa Pandemic? Yung Land title kasi di pa namin nakukuha sabi ng Seller dahil daw sa pandemya kaya di nila maasikaso. 5 months na kasi mula ng mabayaran namin ang lupa sa Mindoro. May kontrata po kami kaya alam ko po na di yun scam 😁. Natatagalan lang po ako sa pag process ng Land title paglipat sa name ko

If its the owner's copy of the TCT, he can always send it by courier. Why don't you try a LRA office nearest you. Apply for a copy of the TCT and check any annotations.

Good Afternoon Dean, Thank you for uploading informative videos. Question lang po regarding sa deed of sale. What do we need to do if the seller of the land bought the land while she was still single, then she now wants to sell them to us but the catch is 1. She is now married and is a married to foreigner 2. The title of the land is named on her maiden name, but on BIR records she is already using her husbands surname. Do we need her husbands signature on the sale even if he is a foreigner? The husband does not live in PH so things are a bit complicated by the distance and especially the restricted mobility brought to us by the pandemic. We were supposed to sign this month but since there are lockdowns we thought is wise to suspend a bit since we could face a problem regarding filing documents. Hoping for a response. Thank you sir.

PTPA Admin sana maapproved need po advice May nagbbenta po kse samin ng lupa at balak po sana nmin bilhin kaso po nag aalangan po ko kse ung titulo pnakita samin is nakapangalan pa po sa developer which is NHA ,hndi pa po dun sa seller ,e ung nagbbenta po samin is 2nd owner lng po bali nabili nya un dati at sya nagpatuloy ng bayad at natapos nya npo bayaran kaya gusto nya npo ibenta.Ngaun po may deed of sale npo sila ng NHA at nung seller kso po nkita ko po sa deed of sale ang seller po nakapirma as Atty in fact then ung unang may ari pa ren is ung nakalagay na vendee. Safe po ba nmin bilhin un?badly need advice🙏

Always ask your LRA and BIR local office on the requirements for a transfer of law by deed of sale. Each city may have their own particular set of requirements.

Atty. pwede ba magtanong bumibili kasi ako ng beach lot na 300 sq meter sa quezon. Yung seller my deed of sale pero yung piñata owner ibang Tao pa. Pwede ba yun d ba mag ka problema later on . Thank you po

It all depends. Sometimes lawyers charged a percentage based on the value of the property

The absolute deed of sale is the best evidence for the buying of the lot. If you paid by check, that is the best evidence of at least money changing hands

Hi sir I watched and subscribed, I just wanna ask about a deed of sale issued to me by the agent as she said, well the DoAs doesnt have technical details on which is the 100sqm from the 13k.sqm mother title, it also doesn't have the title number, and also not been notarized because she doesn't bring all the parties all together on one place, not even in notary public, I just want to refund my money now, its been a year since then, they doesnt want to refund my money, they are insisting that the sale is valid, they are currently subdividing the lot, but I want to refund my money, I paid in full last year. Can I get my money back?

not all "sales" have to be written. Yung resibo is a evidence of payment and delivery. Thus, a completed contract of sale.

sir kami po ay buyer at ang seller ay inaapply thru PAG IBIG housing load. at based sa requirements need na itransfer ng seller sa buyer ung title bago pa maapprove at marelease ang pera. ano ang kasiguraduhan ng seller na makukuha nya ang pera if magback out na ang buyer eh nakalipat na ang name nila sa title? Sir Good day. Nakabili po ako ng motor. 3rd owner na po ako. Ngayon po, yung deed of sale po ng 1st owner at 2nd owner ay nawala po. Hindi ko na po makontak ang 2nd owner. Pwede ko po ba kausapin si 1st owner para magpagawa ulit ng bagong deed of sale na nakapangalan po sakin at sa 1st owner. Sa madaling salita po, deed of sale between sa akin na 3rd owner at sa 1st owner. papalabasin po na 2nd owner ako. Ok lang po ba yun?

Attybsa deed of sale pwede ba na iba yung pipirma hindi ang may ari ng lupa. Nasa malayo kasi nasa davao at bohol po ang lupa. Tapos emergency nila gagamitin ang pera. Salamat po sa sagot

Good day po Atty. hihinge lang po nang tulong. si A ang dating may ari, binenta nya po ang beach lot kay B nong 2013 pero pirmahan lang po sa brgy ang nangyari, hindi po notarize ang pirmahan since hindi pa po nakasubdivide ang mana ni A nuon, naka mother title pa po. nitong 2021 nalaman po ni B na may titulo na,kinuha nya po ito at nakita na hindi pa rin ipinangalan sa kanya kahit po fully paid na sa brgy nuon, ang ginawa po ni B ibinenta nya ito kay C. ngayon po naka transfer na ang titulo kay C, narelease na rin po. naghahabol po si A ngayon sa Denr, dahil gusto po nila makuha yung 1000sqm na tubong sangab. may kakilala po kasing atty si A sa loob ng DENR(from legal dept) pwede po ba nila makita ang doas ni B at C sa kanilang paghaharap ? Hi Dean question po.. bale may utang po sakin yung tao na halagang 45k and then so hindi na po mabayaran at iniwanan nya sakin ung motorcycle bilang kabayaran ngunit xerox copy lng ng ORCR ang binigay sakin dahil my balance p dw sila na about 6k s Casa pero di n dw naningil yung collector kaya di n sila ng bayad..Eto na nga po gusto ko sana gumawa sya ng deed of sale para sa motorcycle na katibayan n saakin na ang motorcycle baka po kasi maharang or maquestion ako ng any Authority about sa Unit..Any Recommendation po for proper way paya maging malinis ung papel ng motor..Thank you po

For the motorcycle unit, get a deed of absolute sale and have it notarized with an ID (govt issue) with three signatures of the seller. Make sure you have it notarized. present that to the Casa to get a mortgage clearance.

At nag pa compute po ako sa BIR ang laki po..at di ko po kayang bayaran ung ganung amount gawa ng nawlan ako ng trabaho. If the deed of sale is final before the death of the seller, you have to file a case in the estate proceedings to claim the land

good day po atty! Ang fiance ko po ay may nabili n lupa at bahay noong sila pa ng ex nya nung 3yrs ago. Ngayon, ngtx yung seller sa fiance ko at ibinalita sa kanya na gusto ipabago yung deed of sale na alisin yung pangalan ng ex ko at sya nlng ang nkalagay n pangalan sa deed of sale. Hindi pumayag ang seller sa gusto ng ex kasi alam ng seller na ang fiance ko ang ngbayad ng buo sa seller. So ngayon ngbigay ng liham sya sa ex nya at ngsasaad ng condition na ibenta nya ang parte nya sa ex at bayaran sya o ibenta ang property at hati sila. Then, now hindi responsive yung ex nya dito at narinig nya n nabenta ng ex nya ang bahay. Tanong namin is ano po ba ang legal action n nkarapat dito? Maari po ba kaming huming ng lagal advice sa sitwasyong ito? Thank you and more power atty.

If your fiance was married to the ex at the time of purchase of property, kalahati sa asawa. if not married, then it belongs solely to you fiance. The seller should have followed your instructions.

It would be not be a deed of sale per se. More like a deed of assignment. In a sense, you are buying the loan of the borrower

The remedy is to pay the balance to the estate of the seller. Work with the heirs of the seller

Hello po Dean.. I would just like to ask if notarization is required for Deed of Conditional Sale? If so, how much is the notary fee for a deed of conditional sale? Is it also same as notary fee for deed of absolute sale that is 1 to 2% of the total purchase value of the property? Thank you for your response!

Required. Notarial fee is subjective and up to the notary public.

good day sir Dean ang pinoproblema ko po ksi yung deed of sale nang magulang ko po hindi pa po nila naparegister po sa Registry of deeds mula noong 1968 pa po.ksi bumili lng po sila na hindi nila pinaregister po sa register of deeds.ngayon po ang problema ko po mayroon po naghabol sa lote po nmin yung apo po.ksi yung nagbenta po sa magulang ko po ay yung lolo nya po paano po ang gagawin ko para di na sya maghabol sa lupa po nmin na kinatirikan ng bahay po nmin.ang gusto nya po ipabulldozer dw nya ang bahay namin ano po ang gagawin ko atty pwede ko po ba iparegister sa register of deeds ang lupa paano po ang proseso di ko po ksi alam po.sana po maadvise nyo po ako kung ano ang gagawin ko po ksi gusto ko na sana ipangalan ko nlng sa akin ksi yung bahay po nakapangalan sa akin pero ang lupa sa magulang ko po.sana po matulungn nyo po ako atty Dean.thank you happy new year po..

Hello po itatanung ko lang po nag pa titulo po ako ng lupa 2019 po pero update po sa yearly buwis dhil pandemic d po nkauwi Mula abroad ngaun po ung SPA ko po di nmn po sinbi na di pa pla natransfer ang tax declaration sa pangalan ko.mapapatransfer pa po ba sa pangalan ko
