Thank you so much! Legal access is provided either through a public or community road or its granted via an easement (which would be recorded either in the property deed itself or in a separate document).

I have an older relative who bought his 3rd 2 acre lot decades ago in a semi rural area about 40 years ago. The land just sat there as he developed the first lot and put a mobile home on it, and then the 2nd one which he built a house on. He finally retired and moved into the house, however, now that he's older he can't figure out why his easement to the 3rd lot has disappeared! His memory is going, but seems to think he was somehow swindled out of the easement. Crazy.

Hello Nick, I always recommend giving the county or city planning department a call to confirm whether the road leading to a property is a public road. If it isn't, you can do a title search to check for easements. If no easements show up in the search, the property is likely landlocked. I hope this helps!

Is it hard and expensive to get an easement through state land? I need a two-track road about 740 yards from the highway to get to the landlocked land. It's pretty much the only option.

I'm trying to close a real estate transaction involving a lot in a platted subdivision with designated streets that was developed back in the 1970's and went bankrupt before it was completed. The main road running throughout the platted subdivision is a private road as the original plat somehow left off any easements. This subdivision has sold many homes in just the last year, 26 to be exact, with no issues, but the buyer in my transaction using a VA loan is unable to get approved without an easement and RMA. It seems a unique problem to us because the VA appraiser made note of this requirement on his appraisal, where apparently the other appraisers did not. There are MULTIPLE properties down this road to our property. I am at a loss at how to resolve this issue. Any suggestions would be welcome!

Hi, and thank you for sharing on this topic. I am looking at a landlocked property that has a "3 rods right of way" through another property. Is a ROW the same as an easement? Thanks!

Hello Vincent, a rod is an old English unit of measurement that is equal to 16.5 feet. Old surveys used to measure distance in rods rather than feet. A right of way is typically similar to an access easement, but it would be best to have a title search done to see what is written in the historic chain of title. You would then want to have a land use attorney review the language to see what access rights will actually be granted to you with the purchase.

I own 10 acres in front of a main rd facing south have neighbors on both side with same acreage empty and the back i hv a the same acreage now the back own first send me a letter that he a customer wanted to build a custom hm an wanted to buy 20ft from my property back to his on the westtside for $1500.00 really i said n tru the paper away now 3 yr later i get a lawyer letter an envelope a 5.00 check n for me to sign n send back bcuz his client is landlock n that back in 1950s his land and my land was own by the same owner who split it..n i hv 22 day to respond or il paying the court cost if gets to that really i been there for 25 year do they hv right to do that..n i already have a nice fence on that side of my property wish is the 5acre on the westtside they dont like the eastside.lol thank you in advance..

I bought land in 2001 which has a easement on it my realtor never told me about it and signed the title without reading schedule B form. I know I'm a moron. So a neighbor which I have no idea who they are owns rights to a runway through my land they made this deal in 1998. I bought it in 2001. Now I can't sell it because no one will touch it. What can I do? I can't find the person who owns the easement rights.

So update. There are two plots that are attached to mine well one neighbor has a city road in front of his house but still doesn't want to sign off on a release. The other family who owns two plots wants to use my property to get to her 2nd plot. She could easily use her land to cross over to her next but she claims that a wash stops her but she drives over a wash that goes through a small part of my land. The real issue is they don't want me to sell so developer doesn't build homes around them. They Will soon have no choice the city is expanding and moving in that direction.

Thank you so much for your video!!! Question, in the scenario that a road is planned / platted by the County, but it is not developed, is it unheard of to ask the county to build out the road to the property?

Hello Gary, you can sometimes make such a request, but for many rural properties it will be too expensive for the county to be willing to build it. However, it doesn't hurt to give them a call and ask.

Mail yourself to the landlocked property and then mail a really large mail back and hop in the usps truck . Or become a usps employee and mail yourself a letter everyday . Or less laws to make it possible to make a tunnel at least 4 feet underground with special zoning and tax rebates for doing so to the property . Or use a helicopter and land on your property . Get a bunch of drones and airlift yourself each day . Invent a teleporter . Or mail a bunch of letters beforehand to your empty lot just to convince the neighbor that not letting you on the property is dumb because the mailman sends letters everyday . Um. Contact your local congressman and complain. Um. Or just take the trespass . Last option accept jesus as lord and savior but that should be your first though 🙏
