Are you in the process of buying property from someone only to find out?
Wait, wait, wait...
It's still in the name of their parents, or worse, their grandparents!
Or are you trying to sell property that you inherited but the title is still in the name of your great grandfather?
Buying property plays such an important part in our day-to-day lives.
For some, it can mean fulfilling a lifelong dream to provide shelter for their family.
For some, it can be the next step, like starting a business where the possibilities are endless.
Many times it involves a relatively big investment on the part of the buyer,
which is why it's very important that the transaction is as risk-free as possible.
So what happens now if the property we are about to buy or sell in is in the name of someone who died long ago?
Is this a deal-breaker? Is there something fishy going on?
If not, how much additional effort is involved when dealing with this situation.
So our question for today comes from Bernadette...
And she writes,
"Attorney, my husband and I are finally ready to buy property for our young family. We found a house and lot which fits our needs and our budget.
But when we started talking to the sellers, we found out that the property is not in their name.
It's still in the name of their parents. This raised so many red flags for me (sayang.)
It's a shame because we really like the property. How difficult is this situation to solve? What should I look out for?"

Nice information Attys. What if the farm lot has just one name (only to husband) and is deceased, kailangan bang isalin muna ang titulo sa wife at mga anak bago mabenta eto? Hindi pwedeng EJS na document lang at direct na isalin sa buyer ang titulo? Thanks po Atty.

Hi attorney Irwin I bought already a land and now that I am trying to make a title of the land to My name because this land was sale for 3 times and land still in the name of the first owner and the first owner is died , and second also what should I do the BIR asking me the original deed of sale for the first owner and we cannot trace already.

Hello po, pwde po ba malaman kung magkano kaya ang halaga ng EJS tax kung namatay na ang owner 7 years ago, sa kanyang lot property na I papa transfer sa wife or children para ma ibenta nila….any ballpark figure or guide

Hello po, nagexecute po kmi ng extrajudicial agreement with deed of sale on a purchase of property. Kami po buyer kaso ung seller po ay asawa ng yumaong may ari at may anak cla na minor. Now po we are processing the transfer of title and hinihingaan po ako ng court of order para sa sale ng property of a minor. I ask the atty who made the extrajudicial settlement and he said we will file the court order while I ask the seller about it and she is not cooperating. What cab we do po in this issue? Kindly help po

hello atty, yong lupa sa mag asawa nakapangalan sa title pero patay na yong asawa. ngayon gusto ng ibenta ng asawa (namatayan) paano po ang process kapag ibebenta na, extrajudicial settlement po ba?

Good day po, Ito po yong sitwasyon. 2014 nabili ang lupa at nabayaran na ang mga dapat bayaran po kaso 2021 May namatay ang May-Ari ng lupa ng hindi pa na transfer sa buyer ang title. Tanong po. 1. Puede po bang hindi na gagawa ng extra judicial settlement since si (deceased) naman po ang name nakasulat sa Deed of Sale 2. If gagawa po ng extra judicial settle, May karapatan ba ang heirs magdemand ng money bago pumirma kahit na May deed of sale naman po Thank you po

Hi attys, sana po mapansin. Ask ko lang po. I have a case where my husband and I signed a Contract to Sell and DOAS with a distant relative where we will be buying the property ni relative. Title is with developer pa and the tax declaration kaya hindi pa namin naipasok sa bank loan at ma process title transfer. Although we have already paid the downpayment and renovations for the home out of pocket. Now, she passed away before we were able process loan app and TCT. My law student friend advised na technically, heirs do not have claims na to the property since we have entered a contract na with the original owner. And it's valid even if she's deceased. CTS was notarized but the DOAS was not. It's also stated in the CTS that in case hindi mafulfill ni orig owner yung terms in the CTS, that her heir will process it. Tama ba friend namin na the developer can release the TCT and tax dec in our favor instead of the heirs? Thanks in advance 🙏

good day po, ito po sitwasyon ko po , i want to buy a land but nalaman ko po na wala pla papers ang property kc in old time noong nakuha ng owner ang lupa. They use only verbal sa bintahan they did not work the papers noong nabinta sa kanila ang lupa. naka rehistro lng po sa munisipyo na ang ama nila ang claimant not the legal owner . Problema pa po is matagal napo yun at matagal na patay ang totoo may ari at ang claimant ng lupa. At gusto na ng anak ng claimant na mabinta ang lupa at i really want to buy this property talaga. Please po help me , What to do ? how to buy the property ?

Good pm, yung lot po e kapapalipat pa lang this march kaso namatay po yung donee, may nabasa po ako na pag wala pa 5 years ay may deduction pa sa estate tax. Saka po ang value nya is below 5M. Wala na po kaya babayaran para sa estate tax? Isa pa po tanong e may atty na nagsabi na kelangan daw muna ipalipat sa heir ang title bago sya ibenta o idonate sa iba. Mangyayari e dalawang transfer of title pa ang mangyayari. Di po ba pwedeng EJS with absolute sale or donation para isang transfer na lang po? Pag EJS w/ sale or donation po ba ay may babayaran pang transfer tax and panibagong CAR po ba ulit yun sa BIR? Pasensya na po sa dami ng tanong at salamat sa mga information na binibigay nyo sa channel nyo.

Good morning attorneys, what if the land i brought is a government property and the owner this is passes away a very long time ago. And the heirs 1 is selling me the land and then i pay it. The other heirs ask the money i pay to his brother. What should i do??

good day... may i ask po what happens to a contract if the buyer died before completion?.. bali po kasi yung mother ko po bibili sana ng lupa, bali hulugan po sya..hindi pa po fully paid ang lupa pero pinapirma na po sya ng contract na binenta na sakanya ang lupa..kaso po after 1month namatay ang mama ko...so dapat po ba kaming maging liable na icontinue ang contract??..or pwede po ba namin icancle ang contract at i pa refund ang nahulog nag mama ko? hope ma notice ..thank you very much po.

question po Atty Erwin and Atty Ramon: what if ung may ari ng lupa ay binata at namatay na? pwede po bang ipa-transfer ang ownership sa isa sa mga kapatid nya o pamangkin para maibenta nila ito sa iba? thank you po!
