@@renaehagen7990 Also he literally told the police that he executed her, point blank. He said it was because she laughed at him after his rifle jammed when he had shot her first with the Ruger Mini 14. He switched to his .22 revolver and shot her point blank in the head. He told the police this. Yes, people have gotten away with things like this, like Robert Durst. He had the best trial attorneys money could buy, and he actually tried to avoid the police, rather than giving them the evidence they needed. It makes me question if this Byron Smith guy knew anything about the law he was trying to exploit. I know in my concealed carry class we learned about that stuff. All he had to do was shoot the guy in the head, then call 911. Say he was confronted by an intruder and shot, that's justified. It's creepy how calm he sounds the whole time too. Oh and his excuse for not calling the police was he didn't want to bother them on Thanksgiving. Most things I've seen about this don't mention that for some reason.

Among the items stolen were thousands of dollars in cash, the watch his father had received after spending nearly a year as a POW in World War II, medals and ribbons Smith had earned in the Air Force during the Vietnam War, several firearms, and jewelry. Smith began routinely wearing a holster with a loaded gun inside his home. There is some evidence that Kifer and Brady committed at least a couple of the previous break-ins and were being investigated for prior burglaries, including one earlier on the day they were killed. Smith installed a security system to protect himself.

The moment after he shot them and they were laying on the ground unable to stand and he shot them in the head is when it went from self defense to revenge killing. If you shot someone who came into your home (which you have every right to do) that's fine. But if when they are laying on the floor saying "I'm sorry, I'm sorry" and you go up to them and shoot them in the chin you're a psychopath and belong behind bars.

What's wrong with that is that he is okay with killing two kids, regardless of why. Picture a movie where the main character has to shoot a bad guy and hesitates; that's called morals. Thieves or not, these kids probably had better morals than the bloke doing the shooting, whom obviously is a little sick in the head based on what he says when shooting them.

@@Refresh2b Gosh. How could those kids have avoided being killed? Maybe by not breaking into the man's home. You act like Smith left a bag of money with a dollar sign on it on the porch. His big trap was to move his vehicle and make it look like no one was home and see it the two POSs would come back and they did. Was the homeowner mentally disturbed? Absolutely. Was he driven to that? Absolutely. If he had not recorded the entire thing and played his cards better, he likely walks and likely was no threat to anyone who was not robbing him.

I don't agree with the intention to kill but the intention to incapacitate until authorities arrive. I also heard of someone who was pregnant where I used to live called the cops and had a double barrel shotgun and was telling them that she was pregnant and was being broken into and was warning the assailants that if they don't stop she will shoot and said so multiple times. and as soon as they got the door open she opened fired and killed the first one and wounded the other... you have to take into account that anyone and anything will do anything at any point, once you are committed to breaking the law why stop? because if you are looking to get away, basically murder intent is they only way to have no witnesses. anyone can strangle you to death or beat you to death with a crow bar if they have the intention to do so.

There are thousands of cases of burglaries gone wrong, when the burglar is surprised or confronted. Dont need weapons to do it either, especially with the elderly. I really dont have much sympathy for the 2 perps in this case. Though yes, the home owner seems rather disturbed and is certainly an... interesting fellow.

This is likely due to people having a soft spot for kids. Had an old man entered his home, no one would have batted an eye at him protecting himself. But I've seen many more instances of kids getting shot for breaking & entering & the parents, family, community, etc. all go on about how it's a tragedy. If you taught your kids better, maybe they wouldn't be dead. This man was obviously shaken to the point of talking to himself about how scared he was. These kids were hiding behind little angelic faces. They got what they deserved & anyone saying otherwise needs to practice what they preach because when someone burgles you countless times you better not harm them if it comes down to you & them in close counters. I guess just give up your backbone now &, hell, maybe even your dignity because a thief will always prey on soft people. When you steal someone's piece of mind, they have nothing left to lose.

Nick was involved with other break-ins/robberies as well. He's not the "precious kid" that his dishonest/delusional mother said he was!

Maybe because he waited for them for hours, purposely hide the car to encourage them to break in. Or maybe because he shoot the girl under the chin when she was already helpless bleeding on the floor. He was using a small caliber fire arm and he didn't wanted any bone preventing the bullet from reaching her brain, he thought about it, he wanted to kill her and he did, this is called an execution, not self defense. Don't get me wrong i'm not defending the burglars, i would have shot to protect myself as well, but he went over the border with his vigilante complex. There was no need to finish them off. He's clearly trigger happy, and was waiting for an opportunity to kill someone, and that to me is very scary

As an American, I'm given the right to defend my property & I won't sit there & question whether someone will harm me or not. If someone continuously came into my home without permission, I would defend myself. Maybe not the way he did, but once again, it's his property. It's in his rights to defend it however he sees fit. Maybe some burglars will see this & think twice about breaking into people's homes.

No its not about the soft spot it's about the recording. Its about the body bags being ready to use. its about the car being moved out of sight so the house Appeared to be empty. Its about a Man in his Basement with guns loaded ready for attack. Its about The Gunman who feared for his life but never called the cops until the next day sleeping in his bed while two dead teens lay lifeless in his basement. Its about an individual who may not be all there in the head living in society where he clearly does not belong. The guy looks and acts like a cold blooded individual. I shouldn't even reply to you because the recording speaks for itself Your not protecting your home when you cheerful tell someone "You're Dead" You are not in fear of your life when you are telling someone as you are shooting at them while they are screaming "You're dying" Having sheets to cover the bodies after each kill isnt something normal people would do if they feared for their lives. What he did is what sick killers would do the Man is behind bars and thank God he is there because that is where he belong. Theres no room for debate because no matter what people may say it will not change the fact that Mr.Smith is rotting in his new home...His Jail cell.

Shawn Taylor This man was the victim of a crime. Is he supposed to assume people breaking into his home are unarmed? I have very little sympathy for people who break into houses, knowing there is the risk a home owner may be home and may decide to defend themselves. I have mixed feeling about how he went about it, but you know, you shouldn’t break into houses.

Mr. Smith didn't go out into the street and murder these two. They came to him, remember that. Remember that the next time you decide to throw up a middle finger at someone in traffic, or elevate a situation that you could have walked away from. I believe in the three C's of life. Circumstance, Choice, Consequence. I can speak for myself in saying, I learned a valuable lesson from this case.

Which is why I feel there is a need to scap the whole "Jury" system and go back to treating everything like a civil trial. This man was a victim of a crime, before he commited a "crime." The same could be said about the so called "victims" in this case. They had already commited multiple break ins. Eventually they'd run into a defensless homeowner who'd try to stop them. What then? Maybe they'd beat the owner to death or cripple him/her? They weren't going to stop robbing people on they're own. They were'nt going to just "grow" out of it.

So by your logic, if Person A stole a bike from Person B, Person A finds out and goes to Person B's house and shoot them in the head. The FACT is he incriminated himself crossing the line between self-defense and murder. Normally a homeowner has very strong legal legs to stand on. But that's only because the state would have to prove you stepped over the line. A very hard burden to overcome when the legal homeowner is given the benefit of the doubt by virtue of being the homeowner AND the only living witness. No prosecutor in their right mind would want to try a case with a slim to none chance of winning. This guy on the other hand recorded the entire thing, didn't contact authorities until the next day, and gave detailed self-incriminating statements to the police about putting the pistol under the girl's chin. Basically made it an open and shut case for the state. As for your "feelings", civil trials have juries as well. But if you're trying say that we should have lower burden of proof like in civil trials, then it goes both ways. Yeah it's a good idea to remove the high burden of proof by removing reasonable doubt from criminal court. That's sarcasm if you can't tell. If anything that would make it easier for the state to convict.

Why did he record himself ? Everything you hear there makes him sound guilty. Without the audio recording his explanation would have been more plausible - I listened to his 1st and 2nd police interviews - over 90 minutes (insomnia helped) There were probably more but I could only find 90 minutes ... and he explains it well there, how afraid he was in the basement, the harassment he had endured, vandalism, thefts, stealing his guns, I mean he had 4 cameras recording outside at all times and weas planning to set up more - so he was definitely paranoid ... and fearful ... but then the audio recordings destroy everything. The audio tape and the inappropriate comments : "You're dying, you're dead, Bitch, You're a real pro (she had on a t-shirt that said "Hard candy") - Sorry 'bout that (when the gun jammed)" The female victim pleading ... the tone, the excitement in his voice, a few nervous laughs, the comments later on ... makes it sound like he was enjoying killing them and it was all planned ... he would have been more likely to be found not guilty if he had not recorded himself, maybe he thought it would be the opposite ... The male intruder was dead from the shot to the face but the female could have survived possibly ... No, he finished her off - in his police interview he's talking as if he's putting down an old dog with the final shot under the chin, inappropriate comments peppered here and there in his police interview - making it sound like he cared more about not staining his rug than the dead people laying there. Also calling the cops right away too instead of waiting a whole day. Listening to his police interview I was thinking the cop there had such an easy job, most cooperative suspect ever in the interview room and he was even incriminating himself with some odd comments - the cop was just saying "Uh uh ..." while the old man was going on and on about what happened and even talking about properly killing the girl because he didnt want to see her suffer more, shooting them almost right away when they were coming down the stairs but when the girl comes down you can hear her going down 5-6-7 steps at least so he could see her better, not just from the hips down as he claimed ... The audio recordings were not mentioned, also makes it sound like he had planned it which he probably did. I'm almost certain he was waiting for them, moving his truck so they would break in while they thought he was away but he made it easier for the cops and prosecutors to nail him with those audio recordings, that's for sure.

It's bad enough that the cops could not stop repeated break-ins. Even worse, when Smith tried to take the matter into his own hands, they had the nerves to charge him with murder. If someone tries to break into a police officer or prosecutor's house, and the police office or prosecutor kills the intruder, should the police office or the prosecutor be charged with murder, too? For one thing, this old man had absolutely no way of knowing that, and given these little thugs' history of stealing guns and other weapons, it's actually pretty surprising that they WEREN'T armed. That old man had every reason to assume that they were. Besides, if someone breaks into your house in the dead of night, are you going to politely ask them if they're armed or intend you bodily harm? If you want your brains blown out, be my guest. Nobody breaking into someone's home under cover of darkness has good intentions. These worthless punks would have happily killed this old man if he had something they really wanted, and if they had known he was in the house they definitely would have been armed and possibly murdered him. I've said this before on other channels. Two thieves broke into a murderer's house. It's hard to feel sympathy for anyone involved. If you commit burglaries then your death is a very real possibility, and a justified one. That being said, Byron Smith's weird narration, coupled with the fact he waited 24 hours to call the authorities, rather soundly demonstrates his state of mind. He wanted to kill the people that had been breaking into his home as a sort of vigilante justice. We're beyond that in the USA. If you're truly in fear, even after shooting home invaders, call the police. The fact he could coldly and calmly wait that long rather proves he wasn't in fear of his imminent death.

I feel sympathy for the old man who desperately pleaded for help from law enforcement but was ignored, the man who had everything taken from him including his sense of security by thugs who could've been anyone. Everyone has a right to defend their home ..but lying in wait, while working out a defense, staying silent for the 3 mins they broke in and not yelling out “hey I’m here I’m about to call the cops” or “I’m armed”, too holy over kill, waiting 24 hours to call for help (most people call when they hear the glass breaking), to not shooting the second unarmed teenager, a girl, looking for her cousin, to simply understanding that being a teenager and getting into a little bit of trouble doesn’t mean you deserve to die like this. When a person is robbed the value of what is taken, or lack thereof, does not matter. What matters is the feeling of complete violation. The feeling of absolute vulnerability, and the realization that you are safe nowhere - not on the street, not in what should be your sanctuary. You realize that anything can happen to you and that you may have no power to stop it and no power to defend yourself. You can be killed in your sleep. This is powerful stuff for anyone to have to deal with, let alone an old man who lives alone and who has been prey to this violation multiple times. The cops did not help him, so he knew he could not turn to them for a sense of safety. So rather than move to where he might be victimized again, he decided to protect his own life the best way he could fathom in his extreme state of mind.

3:23 two shots were fired. The dude was down, writhing in pain. At that moment, any sane self defender would told him not to move and to stay down, then called police. This. I get the sense that a lot of people didn't listen to the entire recording because it was so long. But he definitely had malice. The first and even second shots were justified but once they were on the ground, executing them was beyond the pale.

They had stolen his medals he earned in Vietnam, and his fathers watch which he wore during WW2. If that isn't justification for wanting to blow someones brains out then I don't know what is. Maybe they shouldn't robbed people. Ever think about that. Its not that hard. I've successfully never robbed anyone on the face of this earth, as have millions. you can shoot anyone who breaks into your home, you're not allowed to execute people though. if you shoot them and they die it was their fault. it's kinda like, you're not allowed to rape them if they break into your house either, it's not necessary. do what you have to protect yourself but you can't actually have the inetention of murdering them. but of course, as long you make it look like and accident, it's not what you know it only matters what you can prove.

i think he had every right to do what he did, there are far too many home invasions these days and I know it seems like a cold blooded murder, but home invasions are out of hand and if this were the case where more intruders were killed as opposed to the statistically significant amount of home owners that die as the result perhaps there would be less break ins.

Um no, he had the right to defend his home, he did not have the right to murder them. One shot would have stopped them and defended his home, both teenagers would have been stopped by a single shot. He continued to shoot them, after they had been stopped. He murdered them. He dragged the girl across the floor and put her beside her cousin's body before he executed her. That is not justified, break-in or not.

I hear you but I dont think he did lose it. He worked in the state department for homeland security for several years. The cops had 6 hours of recording before, during and after the shooting. He talked about getting a lawyer a few times. The next day he called his brother and told him to get over to his house fast and that he needed to get him a lawyer. Thats not a guy that loses it. Also after the shooting he was extremely calm. whats interesting is that he was also a huge hoarder and most around him said he was a very strange guy. The neighborhood was afraid of him at times; he was shooting guns all the time. Parents were afraid that kids may get hit. To record for 6 hours and comment with the evil thoughts he had were scary. To give the girl 3 head shots including 2 kill shots even freaked out the cops. His cold blooded interviews after the shooting were serial killer like. very scary guy.

It's absolutely insane that people agree with what this man did. I completely understand him shooting them once maybe even twice, but to taunt the teens and execute them was when it was too much. The kids definitely shouldn't have broken into his house especially since it obviously wasn't their first time but once they were incapacitated they posed no threat and it didn't help his case since his crazy ass recorded his comments and waited a full day before calling the cops. Not to mention that he entrapped the teens which is definitely illegal he planned this out and was convicted accordingly so everyone agreeing with what he did and saying they'd do the same thing go ahead and your crazy ass will be right in jail with him.

I believe he 100% had the right to shoot, but he took things too far, I too would've shot but to try to incapacitate not straight up blow a kids head apart when he's writhing on the floor, he should've just covered the entrance and the boy and called the cops. I understand he had thousands of dollars worth of stuff stolen multiple times but this is psychotic. 9:11 he goes up stairs to do something, maybe wash up/clean his hands, check for others...? then he notices the female approaching his house (she’s coming to look for her cousin) so he runs back downstairs at 11:18 to get back in his chair, calms his breathing, grabs his gun and readies himself to shoot her. Here's my take. The way this went down wasn't right. If a cop shoots a burgler on sight during a crime, that's murder. The use of force requires some very strict guidelines. Is there an immediate danger of death or serious bodily harm to an individual or somebody else? This man shot two people on sight. As soon as he saw them bam. Then he executed them. The jury got this one right. Having said that, I can see why he'd be very angry and emotions run deep. This guy had his father's WWII watch stolen from him which undoubtably had sentimental value to him. He also had his war ribbons stolen from him as well as tens of thousands of dollars. And this theft occured over and over and over during a span of several months. I'm sure he felt violated and disrespected BUT you can't go about it the way he did.

I wonder if any of the idiot's who said the executions were justified actually listened to this audio... anybody with any sense would see this as a deranged man who killed these children for pleasure, he deserves exactly what he got.

I once talked with a friend who told me, “if you break in their house, they are locking the door behind you”. If you ask me, he went about it incorrectly if he wanted to maintain innocence, however, if this was “how to get away with murder” I would say don’t call police at all, clean up the mess like he repeatedly said and remain silent. He obviously had money and time (retired) which makes the job that much easier for him. Or don’t rob people homes and this doesn’t happen at all, just sayin’...

These kids deserved some lesson on breaking an entering and one shot to bring them down was enough and should have stopped once they no longer threatened his life. After listening to the tape, i can't agree with this man, it was over kill. More out of anger than fear of being harmed. Why wasn't he on the phone calling for help while he held them at bay once they are no longer able to be a threat to him. This all around is very sad. The kids should have not BROKEN in and he should have NOT let his anger kill them.

Did you see the little prick....? Going from window to window? Covering up the cameras? Vermin for sure. And then when the female felon came down the stairs after undoubtedly hearing the gunfire.. how she squeaked out her partner's name? Like she wasn't sure of just who shot who... Like if her partner had answered, it would have been business as usual. No.. they are right where they belong. Too bad I can't say the same for the befuddled and terrified homeowner.

He had so many break ins that he just turned crazy. The shooting were 100 percent justifiable in my opinion. But the man needed some psych help and it was no fault of his own.

I read the full story. He sounded like a good hard working guy who was driven to madness by a few stupid young adults. He felt the justice system couldn't protect him so he took matters into his own hands. He didn't want to wound them as he was afraid they would come back to do harm. It's a terrible situation. Plain and simple, don't go looking for trouble. That girl would have regretted every bad thing she ever did well laying there as the final killing shot was fired- that's rough.

The most fucked up about this? You can hear Haile say I'm sorry. You can all sit here and say that these to KIDS were scumbags and deserved it but not a single person posting on this thread is completely innocent of everything, whether is be burglary, robbery, drugs, sex, or any other thing in this world that society has deemed unethical. Yet, you sit here and judge these children. What if it was your kids? Many of us are raised not to do these types of things but we all go off the beaten path. All of us. Not one time did byron apologize. But there haile is, obviously aware her cousin is also dead, apologizing while a man fills her with lead. These two teenagers were harmless. Not a single one of you can sit here and say they would have hurt byron, bc they never would have entered his home if they knew he was home bc they weren't violent! Common sense people. Also, a majority of you are replying saying these two teens broke into his house 11 times. No, he had, had his house broken into on that many occasions and these 2 kids were only suspected of what? 2 of the previous break ins? The jury made the right decision. Most people would install a security system, or move. They wouldn't decide to lie in wait to kill two teens that were making a dumb decision. I would use force on someone robbing or burglarizing my home, and even kill em if I had to. But the situation would need to be more extreme. He got what he deserved. The teens were wrong, but they deserved their day in court. And they most certainly did not deserve to be murdered.

Sam Austin If burglary and robbery being unethical is only do to social constructs, then why not murder? Everyone goes off the beaten path, in his case it just resulted in two deaths. Using force and harming people against their will is what's unethical. These things aren't anywhere near the same category as sex or drugs. Byron had no idea who they were, just that they were intruders in his home and had likely stolen firearms from him in a previous invasion. He had every right and reason to see them as a threat. He had every right to shoot the second they entered his basement, or any part of his home, potentially putting him in harms way. He did NOT have the right to fire kill shots or abstain from calling the police however. That is the only issue with this. Even if they were harmless, which no one but them could say, how would he have known? How would he have known they were only responsible for two of the break-ins, assuming they just coincidentally were? How would he have known they weren't armed? All of this involves information that only came out after the event already happened.
