Thanks for another fantastic video commentary. Great info and extremely important to us. When someone negotiates with an insurance company to bring the amount of the bill down, generally speaking, how much reduction occurs? Let's say your medical bills are $100,000...do they ever reduce by half, more, less? Thanks so much.

I'm not exactly sure if I understand your question exactly. Are you talking about trying to reduce your health insurance lien? If so, it depends on the facts of the cases, the type of health plan, and what health insurance company you are dealing with. Occassionally I've been able to get the entire health insurance bills knocked down to almost nothing, but other times I've not been able to knock down the health insurance lien nearly as much. I hope that answers your question.

I was a passenger and was hit on the passenger door and bent the wheel, car pretty much totaled it was established by the insurance company it was 100 percent there fault didn't go in ambulance but went to the the doctor the next day no broken bones just soft tissue and Bruising doctor referred me to Physical therapy just wondering the average on soft tissue damage both back/shoulder/leg settlement what the typical range?

Not sure what state this accident occurred in as that can impact the value of the case. In Kentucky, where I practice, if the claim is pursued properly, I usually see soft tissue claims settle for between $5k - $30k, but claims can fall below and above this range depending on the amount of treatment received. Also, if you end up having to get an MRI for your back or shoulder, it could show a bulging or herniated disc or tear in your shoulder. Typically those types of injuries won't show up on x-rays and those types of injuries have more value than just soft tissue. What state did your car accident occur in? I'd at least recommend you consult (for free) with a lawyer in the state where the accident occurred in so you know your legal options. If it happened in Kentucky, I'm happy to provide you with a free consult myself.

Good question. Your best bet is to but a copy of the annual publication that tracks all jury verdicts in your state. For instance, in Kentucky it is the Kentucky Trial Court Review: store.juryverdicts.net

Hi Tate, I was rear-ended , my car was total at the accident I called the ambulance because I had a really bad neck pain. But I didn’t go to the hospital with the ambulance.. next day I was having a worse back and neck paint and a really bad headache, I went to the ER they did X-ray found no broken bones, I been taking therapy 5 day a week, and the paint doesn’t go away, I had done some MRI -‘d stuff.. how much you think my case it’s worth this happen in New York City.

To come up with my opinion for an estimated range for the more information like what exactly the MRI showed. But at the end of the day since your accident happened in New York you need to consult with a New York injury lawyer to get a more accurate case evaluation. I have no experience in handling New Work injury cases so I am not familiar with the scene there with regards to injury cases. If do know some New York injury lawyers though. What is multiplier for a traumatic brain injury axonal shearing?

Traumatic brain injuries can vary quite a bit in value. It will also be highly dependent on what jurisdiction your case is in (and how much insurance is available to you). In KY for instance, the 23 year average multiplier as of 2021 for brain/head injury cases is 9.682. But, again, this varies a great deal. For example, in 2004 in Kentucky the multiplier for such cases was 27.741, but in 2009, the multiplier was just 1.00 (with only 1 such case tried that year). I'd highly recommend you consult with an injury lawyer in your state. If you want a recommendation for an attorney in your state, just let me know the state and I'm happy to provide a recommendation. @Call Tate (A Kentucky Injury Lawyer) so 9x at trial... so the settlement value is approximately 5.5x or 6x roughly.... that 1x easily could be someone with 30/70 fault/ liability... but yeah, 9x average gives me an idea... thanks
