so if you get a felony expunged WITHOUT being reduced first, then you can never get your firearm rights back short of a pardon? So in terms of gun rights, you would have been better off just getting a reduction than a full expungement???

If I get a juvenile misdemeanor and expunged it and was told I have to wait to be 30 years old to own a gun. But if I have no criminal activity or run in with the law for five years how can I restore my gun rights

About 14 years ago I plead guilty to a felony for marijuana charge with the intent to sell and transport in California. I expunged my record personally about 6-7 years ago by going to court and requesting to do so. I did not know at the time that I could also reduce the felony into a misdemeanor until recent. I just went to court a couple days ago to attempt to reduce my felony to misdemeanor and the clerk told me there's nothing the court can to at this point... She stated that my felonies show dismissed but are still felonies. What the hell does that mean ? Does anyone know what are the next steps to take to get this felony reduced or removed ? or am I just screwed because I did not take care of this together and so many years have gone by. Any advice will help. Thanks

convictions for charges like simple assault in cases like a woman slapping a cheating spouse, or a man pushing his way out the door to get away from an argument, will now include the mandatory loss of firearm rights for life? What the Court did not rule on, is whether it is a violation of the Second Amendment to have a lifetime loss of firearm rights based on a misdemeanor crime. Our legal system distinguishes between a misdemeanor and a felony based on the severity of the crime. By definition, misdemeanors are minor criminal acts which cause little harm. On the other hand, felonies are serious crimes that cause significant harm. Punishment for misdemeanors and felonies reflect this distinction. If a crime deserves felony-level consequences, then the crime should be classified as a felony. If specific acts that can be labeled as “domestic violence” do not rise to the level of felony crimes, then the consequences should not be felony consequences. Labeling good people as criminals and taking away their constitutionally guaranteed rights based on minor lapses in the heat of passion serves no public safety purpose. Loss of constitutionally guaranteed rights should be recognized as a very serious matter and should only happen when a clear public interest is served. One way or another, Lautenberg has got to go.

Was charged with an 11350 in 2008. It was a felony then, but with Proposition 47 it's now a misdemeanor. Was originally put in DEJ (deferred entry of judgement), but I missed a deadline which automatically put me into the Proposition 36 program. I passed with flying colors in just seven months and had the charged dismissed. Realized years later that the dismissal never restored my gun rights, so I had it reduced to a misdemeanor. Despite all that, the Bureau of Firearms (a sub department of the CA DOJ) still keeps denying my right to purchase a firearm for the reason on "felon". What do I do now? I heard governor's pardon, but I also heard those are VERY tough to get and they hand out very little of those. I'm a combat veteran of the US Army Infantry and this state still won't give me my 2A rights even after I reduced it to a misdemeanor.

I had gotten a felony back in 2005, in CA. (Short amount of jail time and done with probation). I did the court paperwork and was able to get it down to a misdemeanor. (The wobbler).So from what you are saying, my gun rights should have been restored? Wow, I had no clue. If the court does this, is it automatic or do I need to fill out paperwork? I don’t live in CA anymore so; this is confusing to me. HOPEFULLY, I wouldn’t have to drive back to get it sorted out. All I really want is my 2nd amendment restored. I just want the ability to go to a range and hang out with my friends like things used to be. (No desire to own any really). I don’t even know where to start. I did see you can get a copy of your ‘rap sheet’ through the FBI. No clue if that’s where the background checks go through. If anyone knows of what I could do, I’d appreciate it! I’m definitely not getting my hopes up for anything, if I’m just going to get denied.

I did have a wobbler, it was reduced and expunged this year (well I'm not sure how to find out if it was reduced before expungement). However, I don't know what I need to do now, there's thousands of lawyers. I need this lifted so I can work as an armed security guard. Unarmed security results in extremely low wages. I'm only commenting because I have a feeling recordgone will cost tens of thousands.. Any individuals have any advice, let me know please. Even if you're reading this comment months later

DOJ has a application that allows you to see if your eligible for a gun. Just pay the fee 25$ I believe, wait for the letter and it will tell you if you can have a gun.

Also there's attorneys that charge 300$ I believe it's called record clear and they take you out of the private database. If your wobbler was non violent and did not involve drugs or a ple deal of any mental incapacity, then a 17(b) reduction should restore fire arm rights, just verify with DOJ tho

I live in CA, a few years back my home was raided and a small amount of drugs were found. I was eligible for a deferred entry of judgment. I followed all the courts rules tested clean for drugs I never did and in the end the judge dismissed the case. At my arrest the police confiscated my firearms. I received a letter a while later stating they were going to release my guns but not to me. Police said no more guns. No convictions misdemeanor or felony ever. can I have my gun rights restored???

When a person is arrested part of the procedure is to have a ‘booking photo’ taken of the accused. I live in Portland Oregon. I have a full-unconditional pardon from the governor of California, restoring all my rights, and my gun rights. I can purchase firearms and open carry them here. This is a shall issue state; I was denied a concealed carry permit. The sheriff said, it was because the felony is still on my record. I talked to a gun rights lawyer on the phone. They suggested that I go to court and apply to get my rights restored. My pardon say’s my rights are already restored! I don’t have the money to get an attorney and pursue this like that; I have talked to the Clean Slate people; they only help people with Oregon records. So, I would like to find an agency like that, that will help me here in Oregon, to clear up my California record. Or, someone to inform me as to how to go about doing it on my own. Difficult when you live in another state. And the info needed is very hard to find. What do you suggest Sir? Any help/info that you can supply would be greatly appreciated. Thank you in advance.

Worse is being taken under a 5150 by a single state employee for a 72 evaluation even with out anger, threats and calm speaking. The eval at the hold finds you fine and releases you early. Then without knowing this evaluation found you fine takes your right to have a gun, ammo, or magazines etc.. in your possession . You find out when 2 officers come to your home to take them and ammo. You are told they will be given back in 5 years. Then 1 or 2 months later a letter says transfer them through an FFL or they will be destroyed and not held for the 5 years. All this with no trial or even found in danger of self or others! HOW DOES THIS LAW STAND THIS WAY WITH NO DANGER FOUND BY PROFESSIONAL MENTAL HEALTH EXPERTS AND NO VIOLENCE OR THREATS MADE ? I am not against keeping people with issues from having guns but 1 person sends another for evaluation and is found to not be a danger to self or others and is fine rights and property taken with no trial or case. You can request a hearing for restoration but there is no appeal and the law firms in the crowded OC/LA California that do this are 5,000 and more and only 3 or 4 that do this. How do they get this unconstitutional law to stand? Found innocent and punished by law! THIS IS WRONG
