this process is bullshit. just do it yourself. go down to the court house, file a subpoena to the district attorney about your case being expunged. if they sign off and say okay we're down with expungment. then take that paper and subpoena the judge and see if he says yes or no to your expungment. just did it took a month, but only like a morning here and there, the rest of the month was wait time.

Ok i had a drug (10.00 ),drug charge 15 yrs ago.I did one year and one day in county jail.Im in Nevada now with no trouble in yrs.I vote, can be on a jury, so whats my chances of purchaseing afirearm for protection?

I have question about felony conviction of a case the cops falsified which ultimately led to a strike, I did not serve prison time, and I have not violated probation in the 3 years I been on it. It was a police brutality case, and we did get them to lie in court. But since the criminal threats they pinned on me was against the police.. It lead to a conviction. I was wondering (I did the eligibility test, and I am eligible ) if reducing my felony would void my strike ?

Yes, you can. Expungement in CA is for cases where the was a finding of guilt, even if it is a plea.

+Wake Up !!! California law, like the law in most states, does not allow certain offenses to be expunged, most commonly sex offenses and very violent offenses. This is a policy decision made by lawmakers. My guess is the theory behind it is that certain offenses are prone to be repeated or too serious to risk the public not knowing about, and therefore they should not be expunged. Expungement laws are made at the state level, so each state's expungement law is different.

There is also a California law (Government Code section 68153) that automatically expunges criminal records. This law allows the courts to destroy criminal records after a certain period; for regular misdemeanor, the court will destroy the conviction after five years.

That section you refer to, which allows courts the option to "destroy" files after specified periods of time is a law of administrative convenience for the courts. It should not be confused with expungement, which is for the benefit of the defendant. Here are the reasons why: (1) it does not dismiss the case, (2) it does not confer any legal benefit to the defendant, unlike expungement under penal Code 1203.4, which provides lots of benefits (3) even though the court destroys the actual file, the court can still keep the information in its database, (4) it does not remove or update any data on California Department of Justice Report or the FBI (5) A defendant does not have standing to ask a court to take action under Government Code 68153 (6) the law says courts "may" destroy records, but it does not require that they do so. What if the court and judge broke a penal code as for convicting me of a felony/strike. I was charged with Assault with a deadly weapon but I didn't do prison time. There is a penal code stating if you are convicted of a felony you must do prison time.

I am not aware of that section of the penal code. It is quite common for people to be convicted of a felony and not serve prison time or be sentenced to prison time in California.

+Billie Danford I am sorry to hear that. Just a reminder, that this video is about expungement in California. That being said, Virginia may deny you the right to own a firearm if they find a felony conviction in another state (like California). What you experienced is uncommon, but not unheard of. Sometimes courts will digitize old paper records (such as those made 47 years ago). Once digitized, they are often transmitted to central state repositories, like the California Department of Justice. Once a central repository receives it, it gets sent to the FBI... and now you are no longer flying off the grid. Virginia law does allow some firearm rights to be restored. Please contact an experienced attorney in Virginia... make sure they are current on recent changes, because I believe there have been a few.
