Crazily, the AI's pick for "best traffic lawyers" don't even all focus on traffic cases! It's like asking for the best brain surgeon and getting a list that includes pediatricians.

This is a good subject and video. Nice work. When I needed a lawyer, I talked to three. All three where focused on the retainer over everything else, and wanted me to plead guilty to a criminal charge (because the punishment was easier in the short term), despite not being guilty of it, and having it saddle me with a record. I googled what I needed to know and successfully navigated the system. The last judge I faced was visibly angry with me for having done it on my own. The bailiffs were very kind that day.

You happened to pick 3 bad lawyers. There are some really good ones out there. Apart from minor traffic violations, it is definitely best to get a lawyer. Along with their expertise, you will definitely get far more respect from the judge.

EXCELLENT video. A few of my takeaways: 1) AI is NOT a substitute for a lawyer; however, it make provide BASIC info and prep for representing yourself and/or preparing you to talk to a lawyer 2) Consult multiple AIs with the EXACT SAME questions and compare/contrast their takes. Each will have different strengths/weaknesses that will vary day-to-day.

In all but four states, DUI checkpoints (not road blocks) must be announced in advanced. Not inherently their location, per se (a few states require this information as well) but merely the fact that on X date at Y time DUI Checkpoints will be deployed in some fashion. Which is what the AI is presenting.

The rule of thumb to use is never ask an AI a question you wouldn't mind being wrong. On the AI conflict of interest note, there's no difference between how Bard answered and how a simple web search works. You can pay Google to be the top result.

I won a speeding ticket case by addressing the Radar Calibration. This little town in Tennessee had 2 cars and 3 officers. I called the Town-hall and an employee told me the manufacturer and model numbers of the radar equipment. I contacted the manufacture to gather info on the equipment and the Radar manufacture employee ask if I purchased these units. I said no, I received a ticket and the police used one of these two units. The employee advised me she can not send me the manuals, because I have not purchased these units. She also inform me one of the units was calibrated 2 years prior and one unit has never been calibrated by an authorized Technician, in fact no one in that county is Certified in operating these particular radar units. When I went to court I asked the officer if he was 'Arkansas Radar Lidar' Certified? Arkansas Radar Lidar is the name of the manufacture. The officer said he is 'State certified.' I asked him again the same question, He said he is certified in multiple radar equipment usage. After asking him the same question 4-5 times the Judge interrupted us and asked the officer about my demenour on the side of the road. The officer shrugged his shoulders and said i was compliant and no issues. The Judge immediately dismissed my ticket and sent me on my way. This little town had 100+ commercial drivers sitting in a pole barn waiting to fight their tickets. The Judge did not want me to proceed. I never got to the calibration issue, but that all started the process. Fun day indeed.

I think it may be more interesting if you presented the AIs with highly specific (made up) scenarios and saw how they applied the "knowledge" they have. These generic questions will certainly have been answered in one way or another in the AIs' training data, so a very specific case study would be a better overview of their abilities

It could be entertaining, but they would both fail. It's precisely that sort of challenge where these language models definitively show that while they're fluent, they're not intelligent. They can't synthesize ideas, only patterns of words. When you get to detailed enough scenarios that they won't possibly have trained on text that discusses something very similar, they'll very confidently "hallucinate" stuff with glaring conceptual inconsistencies that any human that fluent would be unlikely to miss. It would still be interesting to see at what point that starts to happen, though. It would be determined by their training sets.

Hey Andrew, that was a good review of the abilities of the AI as it stands currently and I enjoyed it. I don't know if you're familiar with the channel "Anastasi In Tech". She did a video recently on the future of AI. One of the things that was really astounding was how rapidly it's changing and how the costs for training the AI are plummeting. Anyway, thanks for the video, I always look forward to the new ones you produce.

I mean it's not such a crazy leap that Bing makes with the "if you are not driving..." statement. What if you're the passenger in the vehicle that's getting pulled over?

Yeah, I'd count that as a point in Bing's favor since it's useful information to have in order to not make a fool of yourself during a traffic stop in a very similar situation.

The advice given, specifically that a passenger is required to give the police the passenger's true name, date of birth, and other identifying information, was absolutely incorrect. The passenger is temporarily detained as a consequence of the traffic stop, but is not automatically suspected of any violation of law; therefore, the police are not authorized to order a passenger to identify himself. **IF** the police have a basis to suspect that a specific passenger has violated a specific law, then the police may be authorized to order the passenger to provide identification. This varies from state to state, but there is no state that authorizes the police to order someone to identify himself just because he is in proximity to the officer.

@3:50 I live in VA... My car windows are power only windows. I have had drivers side window sometimes break and took a while to get the replacement parts. Of course the police would assume I am being uncooperative though I try to gesture to go to the passenger window....

They come up to the passenger window now, it lets them see the driver and what he might be hiding. My daughter resisted, but I installed a new master switch in her car so all the power windows would work.

There's no express conflict t of interest, at least not right now, when it comes to either Bard or ChatGPT/Bing. The two AIs search the web based on your inquiry and present information that fits your inquiry. The more detailed your inquiry is, the better the response. Now, whether or not there is paid ads on Bing or Google is a different matter, but that isn't the AI's issue, and you can direct the AI to ignore paid ads.

I really enjoy your content, and you have a great way of presenting. Thank you for doing the topic, very interesting. As a cop with decades of experience, I will say that I have never had anyone challenge radar certification. I have never heard of anyone having to defend radar certification except in training of course. Possibly it is a regional thing? I am in Texas. We certify our radars annually, but I have never seen one go out of calibration. They are kind of like a typical microwave oven, if it pops your popcorn it is good and if it won't, you do not need an expert to tell you it isn't working. Regarding staging roadblocks, I have never seen that done. My agency would probably laugh at the idea, but possibly that is regional as well. I know you always say don't talk to the police, I think It can be a two-edged sword. Thank you for the great content, please keep it up.

I asked Bard how to answer some common officer traffic stop questions, and I was impressed that it started by telling me that i should not answer the question, and it explained why the officer is asking it.

When dealing with Police it is important to understand that Deprivation of Rights Under Color of Law, also known as 18 USC 242, is a federal criminal statute that makes it illegal for anyone acting under the authority of state, local, or federal law to willfully deprive an individual of any constitutional rights. This law applies to law enforcement officers, government officials, and other individuals who are acting in an official capacity. Some of the constitutional rights protected by this law include the right to free speech, freedom of religion, the right to bear arms, the right to due process, and the right to equal protection under the law. If an individual acting under the color of law violates any of these rights, they may be charged with a federal crime under 18 USC 242. To prove a violation of this law, the government must demonstrate that the defendant acted willfully, meaning that they knew their actions were unlawful and intended to deprive the individual of their constitutional rights. The government must also show that the defendant acted under color of law, meaning that they were acting in their official capacity as a law enforcement officer, government official, or other authorized individual. "if you are not driving" to be fair to the answer given, it could still be a traffic stop but the police request other passengers for the same information. that might be why it added the caveat to the answer.

AI is improving fast, but it isn't there yet. I do think it has squarely entered the realm of "tool assist" even in complex fields like this though. The draft template is a good example...will easily save time doing the mundane aspects and leave the nuance to professionals. The question really is how quickly can it get to the point where it *does* answer all of the questions accurately, every time. Similar question for self-driving vehicles. When does it get to the point of making correct decisions *consistently*?

I completely hate that it gives you a list of lawyers because of exactly what you said. It no longer becomes about helping people, but about what lawyers pony up the most money to advertise on the service. And as someone who may need a lawyer, I don't want the biggest firm necessarily, I want the right firm for my case. I much prefer the answer that tells me to do my own research and I think you brought up a great point about defending cases in different parts of the state and how you may not be the best lawyer for a case 4 hours away from you. Giving me 5 names when I don't know where they practice, what sorts of cases they handle, or what courts they're familiar with seems like more harmful information than helpful.

ChatGPT has come up with some strange answers. Steve Lehto, a Michigan lawyer, has a few videos about ChatGPT. Jordan Peterson's conversation with Brian Roemmele is quite fascinating. Joe Rogan and Duncan Trussell asked it how much of a certain male bodily fluid would it take to fill the Grand Canyon. It refused to answer. Mayo? Bingo!

one thing I will point out is that it is possible they are using location data to give you recommendations for your specific state, so not mentioning that in some states it is illegal to refuse PBT may be because you are in a state that does allow it

A tip with these kinds of AIs is to be as verbose as possible with your question. They tend to make assumptions that humans don't. If you remove all those assumptions, you tend to get a better answer.

This was a very good video Andrew just like all your other videos, speaking of programming yesterday I asked ChatGPT to write a sketch for an Arduino , to sense a current load and if so drive a servo motor to open a blast gate. This is on wood shop dust collection system and it did exactly what I wanted. I did have to make a few changes but the basic sketch was what I curious about.😁🛫

The inclusion of Living v Virginia is interesting. The case does not involve roadblocks, but the discussion of the case very frequently includes the word woodblock. This is a mistake, but a mistake that an inattentive person could reasonably make. It also shows that the AI is doing research, but does not know how to restrict its research to the correct data sources.

Again, prompts matter, how you word your question. Let me use an example the cross examination questions from the 14 minute mark. I'm going to use the following prompt; "Provide to me yes or no cross examination officers for a DUI case involving a DUI Checkpoint." Here are some of the examples provided. If you need it to be specific to a given state, you can indicate that state. "Officer, did you participate in the DUI checkpoint conducted on [Date of DUI Checkpoint]? How many vehicles did you personally stop and interact with during the DUI checkpoint? Officer, did you have any specific suspicion of illegal activity related to me before stopping my vehicle at the checkpoint? Were all passing vehicles subject to the same inquiry and inspection at the checkpoint? Officer, did you follow specific guidelines and protocols during the DUI checkpoint, such as those outlined in Michigan Department of State Police v. Sitz? I've got a question about pacing for speed. I had an officer pull me over for speeding, but he quickly determined that I was under the influence of alcohol. I am not sure if he has a really good nose or if he was just fishing but I had only had a few ounces of beer 20 minutes before getting behind the wheel. He was a sheriff's deputy from a different county and called in highway patrol to do roadside sobriety tests which I passed. Before the trooper gave me the tests. He told me that he was not going to issue and he tickets. After I passed the roadside tests, he changed his mind and gave me a ticket for reckless driving alleging that I was driving 105 miles an hour. That is at least 15 miles an hour over what I might have been doing but more likely 20 to 25 mph over what I was doing. He did not turn on his in car camera and was not using his body camera. I can't argue that he did not have his radar calibrated correctly and with no video evidence of the stop, I can't show that he was not only very far away from me when I noticed him and started slowing down, but when he caught up to me (driving a much higher speed than I was) he was still driving much faster than I was and I was probably only five over the limit when he caught me. Is there anything about that story that stands out as something I can challenge? Because it's very frustrating to have it come down to the word of a sheriff's deputy versus mine 😞

There was a law clerk who provided a legal brief to his lawyer bus. The AI made up non-existent case law and precents. The lawyer was embarrassed and the judge was furious.

I've got a question? Is it true that if you ask to see your speed on the radar gun that the officer must show it to you? My wife and I were driving in Indiana about 15 years back and we were following an officer down the road in our Prius. He was driving in the slow lane at 68mph in a 70mph zone and since I had seen him I was doing 69mph in the middle lane. Well eventually I passed him and within a mile of me passing him he pulled me over and asked why I was in such a hurry. I responded back that I was doing 69mph in a 70mph zone. He said I was doing 79mph and I demanded to see the radar gun showing that I was going that fast because I knew it wasn't true. I said I was most definitely not doing 79mph that I doing 69mph and then he said something about crossroad speed limits and some other crap which didn't make any sense, we were on I-65 South not some cross road and the posted speed limit was 70mph. He took my license and registration and then after about 10 minutes came back and said something about not being on duty and some other blah blah blah that I don't fully remember and let us go without a warning or anything. Pretty sure he got back to his cruiser and noticed the radar said 69mph versus 79mph and didn't want to admit he made a mistake.

And cop can't arrest you for not stepping out of the car, because when he stopped you that means you are UNDER ARREST already when he stopped you! But, leave your keys in the car, get out of the car lock and shut the door, then say you will not be answering any questions, no consenting to anything, remain silent and still! 😱😝🤪🤣😁👍👍🇺🇲

I was one credit away from a comp sci minor in college. I decided I no longer cared to finish it once I was admitted to law school, and I got senioritis. :) My main programming these days is PHP / MySQL for my law firm case management system. Plus random things that come along like home automation and electronics projects.

Here's a question. If you have a license from another state and you get stopped in state that requires a breathalyzer test and you refuse, can said state suspend your license? Or is it the issuing state that only has the authority to suspend?

*Not a lawyer* My layperson understanding is most if not all states have agreements between them, that allows them to have the state where the license was issued suspend your license.

Andrew, why would one ever argue the merits of a traffic court case, example challenging radar or breathalyzer calibration, when the court cannot possibly have personal or subject matter jurisdiction for a traffic stop case? I make a special appearance to challenge the court’s jurisdiction. No service of process (lack of due process). No proper charging instrument to even plea to. No stated nature or cause of the accusation(s). These are all violations of Virginia Constitution Article 1. Complete lack of in personam and subject matter jurisdiction vested with the court to even hear the matter. What say you?

rolling down the window: there usually is a lever, that opens the window. but rolling down the window requires the person in the seat to physically roll down the window, as it was possible in older cars. sure, it is a technicality. but still. language needs to adapt to that. oh, and why is everyone still filming. there are people out there who never used actual film. same thing with taping.

Had a workman's comp case. My lawyer cut me out of the behind doors negotiation [settled out of court] and took everything in the settlement. Then a few years latter Sues me for a Zombie debit that he never owned. With his In Perpetuity document Represented me in the case he had against me. MASS. Bar does not want to hear it . Can Zombie debits be dropped & How ??

Andrew, how is it that everyone forgets about this: § 19.2-59. Search without warrant prohibited; when search without warrant lawful. No officer of the law or any other person shall search any place, thing or person, except by virtue of and under a warrant issued by a proper officer. Any officer or other person searching any place, thing or person otherwise than by virtue of and under a search warrant, shall be guilty of malfeasance in office. Any officer or person violating the provisions of this section shall be liable to any person aggrieved thereby in both compensatory and punitive damages. Any officer found guilty of a second offense under this section shall, upon conviction thereof, immediately forfeit his office, and such finding shall be deemed to create a vacancy in such office to be filled according to law. There is no special provision carved out for a traffic stop, It’s been on the books since March 6, 1997! I will provide everything listed on a valid search warrant during a traffic stop, nothing more. What say you?

Your scenarios and questions were... to some degree too easy, and to some degree set up in a way where you don't see some of the key strengths of the AI. Lets see an immagined scenario with plenty of specifics: The police already asked you to stop, but they are still busy with the previous stopped car. You have time to prepare a bit for the traffic stop and ask for some advice, but don't have time to consult a lawyer. You are a good traffic lawyer in Virginia, but you are on an overseas vacation in Hungary you want to know what is the best practice to do before you can consult a local lawyer with experience in similar cases... It is useful, and urgency and understanding your questions are important. You can always ask for more cases and train the model if it gives you wrong references and have time to fix that. You can search for a template for some motions, etc. But when you would need good advice urgently because you want to avoid spending time in a foreign jail and you might have been made a mistake, then quick answers from an AI can become super important OR super dangerously missleading. While you might say I mentioned Hungary because I am from Hungary... But I have chosen it for 3 reasons: 1st: If I would mention Mexico or Canada (something nearby) Bing and Google would see plenty of information on sites in USA, designed for US residents... It would be easier. 2nd: Having to use information that is mostly covered in another, hard to learn, language would make the task more interesting and difficult for the chatbots too, but makes chatbots that can handle the task even more important. 3rd: Legal system should be different from what you have in the USA...

Like most people you're probobly just messing with the version of ChatGPT and similar AI like it was designed. When you mess with it enough you can see how dumb these programs actually are and can mess with them like Captain Kirk in an old Star Trek episode. People have essentially written logic scripts that "jailbreak" things like ChatGPT to bypass its filters and give you the actual answers to questions or tasks it would normally refuse to do or give you milk toast responses to.

False, it can help you with that, you didn't word the prompt correctly. You should have written, for the motion, "Write me a Template for a motion to suppress evidence from a DUI stop at a DUI checkpoint as it is a violation of my 4th Amendment Rights. This template should conform to court standards in [x state]." In fact I tested this with ChatGPT and asked it to conform to Virginia standards. Here's the template it generated. "[Your Name] [Your Address] [City, State, ZIP Code] [Phone Number] [Email Address] [Date] [Judge's Name] [Judge's Designation] [Name of the Court] [Court's Address] [City, State, ZIP Code] [Defendant's Name] v. I did some Bing - testing. Movies, and video games, are all fun chit-chat, but when it comes to politics and political events, Bing suddenly becomes weird, starts lying about obvious things, denying events and facts that pretty much everyone agrees with, even the press, and if you prove Bing wrong about something, Bing quits the discussion. Even if you say a political joke about CNN. Bing abandons the discussion. 😕 So, I wouldn't trust Bing.
