I found it; the video you said explains what I wanted to know! Plus!! Well, my Mexican lawyer says he specializes in everything I ask him about! I told him my mom always said Lawyers are liars! When he tried to say I am not a liar, he slipped up and said (clearly) “I am not a lawyer.” Funny time!! I don’t trust any liars or lawyer btw! Thanks for the video…. I need to have a personal consult if you don’t mind someone crying on your shoulder. I have lost at least $200,000.00 American dollars by trusting people who should be trustworthy from the Church! Call me stupid!! I will be the one to say, here I am over here!! 😅

This is the second comment in as many days since finding your content. I have learned so much about Mexican life and paperwork. I’m an immigrant who’s moved around a fair bit, and I would have loved this kind of concise, helpful and practical info that didn’t take hours to sift through and find what was pertinent to my situation. Great job, and great blog too.

@@qroo Knowing what you know could have changed me from being a loser to being at least on par with the illegals entering the USA today! They have more than I do and I am a one hundred percent disabled Veteran of the good old USA! Am I crying! I want to cry honestly! It is hard seeing these people enter illegally and get every benefit I fought for, for the people who follow the law! I am in Mexico not a resident though and I cant live well here and definitely NOT over there in MY OWN COUNTRY! 😢 I am more mad than sad I suppose!!

Right on! I own land both within and outside the restricted zone and you've outlined everything perfectly. Just one piece of advice on ejidos from my Mexican relatives and friends, "No chingas con ejidos, guey." You might want to cover the role of the notary public in Mexico. They are 'super' lawyers, not a secretary with a stamp.

Very good advice. And even after double checking every detail, I would not be comfortable buying real estarte in Mexico until a few years have gone by. I heard terrible stories, "notarios" and lawyers notwithstanding.

Remember this truth: Lawyers are paid to lie and they get so used to it, they are basically lying everytime they speak! It is a shame but sadly it is the case with 99.9999999 percent of them! Good luck.

I purchased property in Mexico and never was asked to get the Fideicomiso. I got a title to the land and that was it. This was in Quintana Roo (cancun) I am currently putting this 5SQ Meter piece of land on the market to sell it. My problem is that I will have to self report and pay the gains tax here in the states. (darn it)

Informative. I own a property outright in mexico city. Escritura's in my name. And my wife and I bought an ejido property in Baja. The Ejido property is in my wife's name and, yes, it is tricky, not gonna lie. I did a lot of due diligence on the ejido deal and had a trusted real estate friend looking over my shoulder. Plus my wife is Mexican. Nevertheless, I will not be fully confident that the deal is done until we get the escritura. If you can't handle a little extra risk and uncertainty of buying ejido, don't do it.

Having bought a house in Cuernavaca (non Restricted zone) I have to point out an omission in your guidance. To buy my house although outside the restricted zone I still had a process with SRE (Foriegn relations Ministry) to have them "approve it" / file it with them. This process was handled by the notary and fairly painless. This was buying as a resident in Mexico. We are about to buy a second house in Merida and that will be the Fedeicomiso from the bank, as has been said there's a fee (14,000 mxp) annually to keep it.

Yes, there is an additional piece of paperwork but you can hold direct title.

Don’t buy anything you can’t afford to lose. Most foreigners last about five to ten years until someone inevitably takes an interest in thier property and harrassed them to leave. We almost got kidnapped the people were so desperate to rip me off

Great info. I once had intentions of buying a small ranch in an ejido but, never pursued it because my situation changed and I went elsewhere. Glad I didn't. Had not thought about the ejido complications. Hmm, common ownership of property in an ejido is not really an incentive for the ejiditarios to invest time and money in a piece of the ejido. If I made my place, well the piece I considered mine, super productive and attractive, my neighbors could say it belongs to them even though I were a member of the ejido.

When both of us die can our children claim our property in Mexico? Or do they need to have dual citizenship too in order to claim it?

I just talked to a realtor from Mexico who sent me a guide on how to buy a home in Mexico. I had found the "loophole" on my own but he explained it better to me about the trust. Nice to see someone make a video on this. :) my husband & I are hoping to move to Mexico within the next 2 years

Me (german) and my wife (mexican) have bought land in the restricted area (ejido). We havebeen talking to a notary about this. He said that as long as you pay your annual taxes and comply with the rules of the community, there is no way that the communiy will take this away from you.

As I mentioned, it depends on what stage the property when it was purchased. There are lots of horror stories about ejido purchases going very wrong years down the line.

@@qroo Thank you for answering. In general the pocession of land can be difficult (also for mexicans on private land). At least in the area where we have this land, invasion of land is not a problem. Our ejido document (from the commisionaries) is from this year. About 95% of the land in that region is community land (ejido). So far we have not heard of any problems. Very close by there is a canadian guy - I wonder how he did this. Have to ask him next time I am down there.

So what is the function of the bank in a Fideicomiso? Their purpose is to prevent some sort of abuse by a landowner. What are they there to prevent?

It was easier to create a loophole in legislation than change the constitution. There is no other purpose. They hold empty title and collect your money each year.

Firstly, great content, many thanks! Does anyone know of a bank in Playa Del Carmen that offers reasonable Bank Trust rates? We are closing on a small studio condo and my realtor is suggesting that the bank she deals with charges 2000$ usd to set up the trust and about 7000$ every year after. I find the price a bit rich in relation to the value of the property.

Guys, unafortunately mexican real state increase and later Is difficult to mexicans to afford a nice condo or property at mexican nice áreas sadly, clear example Ajijic city and Puerto Vallarta. Regards to all of you.❤️❤️

Hi Paul. Can you talk about buying houses in MX which are posted ‘remato’? Is that the same as foreclosed? These houses (remato) are cheap but what’s the catch? Thanks!

Hi Maya. Yes, las casas en remate (judicial) are in foreclosure. I haven't looked into the pitfalls (if any) of buying these. It is a great topic idea. Thanks. :)
