I'm 100% Permanent and Total so does that mean I don't have to have any medical exams or treatment to my back if I choose not to? I hate doctors exams (painful)

Good information, but I am more confused now after hearing from you this information. You stress the 20 year rule but glossed over the 100% combined complete and total disability rating. Most of us do not understand the VA lingo and can be very difficult to make 2 + 2 to = 4. I would give more time between the different types of 100%

Pretty much Anything under 20 years Can be reduced, it’s rare but it does happen. Anything after 20 years is forever permanent .

My question is concerning TDIU. It was said in order for benefits to be reduced, the veteran would have to be found to have worked 12 consecutive months and earned wages above the poverty threshold, if I heard correctly. I just want to be clear, does that mean for example, say the veteran has earned more than the poverty threshold but hasn’t worked twelve consecutive months, that in that situation VA wouldn’t have grounds to terminate TDIU for that veteran?

If you earn more the poverty level in a given year, the VA will see that at the end of the year when they pull the records from SSA and reduce you. With the exception of sheltered work places which you'll have to prove and passive income like investments does not count against you.

Depending on where you live a short few weeks to 6+ months. I've always fell in the 6+ month range.

About ten years ago some claims were taking close to three years for the VA to finalize the rating decision. The files came to my desk review, as I was able to verify by date of claim. Much faster now a days with the digital files.

What can one do IF a C & P person causes more damaged to you??? Back was at 40% the VBA dropped to 10%, have bad pain in back pain pills and TENs units help a little MY VA caropractor is out on medical leave

I made sure I had all my ducks in a row when I filed my claim about 90 days before I retired in 2014. I was rated 100% Total & Permanently disabled. I’ve considered filing to have additional ailments added to my rating since I was diagnosed with leukemia (been in remission for 4 years now) just 2.5 years after retiring.

If you file something, that brings all your ratings back into play. permanent and total or not. The only true protection is the 20 year rule. No point in filing more at 100% P&T unless you really want SMC or something but, not at all worth it in my opinion.

I feel motivated to work but Evertime I try to go back I get anxiety attacks out of nowhere. It's very frustrating because I'm in school trying to better myself. I have plans for myself that I feel is slipping away. I've managed do cleaning gigs and other gigs where I work alone. And school work where I can communicate online. I'm diagnosed with anxiety disorder. I'm not P&T so I keep trying to better myself in anticipation of a rate reduction but it's so frustrating because sometimes it feels like a fools errand. Should I be discussing this with a VA counselor or just wait for my next VA evaluation?

You can discuss it with your VA counselor at the VAMC. If you have a future exam schedule wait for the VARO to schedule it for you. Your last rating decision summary will tell you if a future exam was/ is scheduled for you. Let the VARO take the initiative. Your VSO can look into your VA claims file to check if you have a future exam pending.

I've had 100 percent IU for over 25 years, and wonder if it can be reduced back to the 60 percent permanent rating the Army gave me?

I don't think so, once they award you permanent disability I don't believe I will be reversed!

Very unlikely, unless it's fraud or you open another claim. Usually when you're 100% p&t , the VA sees that disability as not getting better, so you will need no further re-evaluation. Don't poke the bear though, a lot of people, had that rating reduced because of new claims. The VA is not your friend , they'll try to find a way to reduce your pay if you open up that can of worms.

My narrative reason for discharge on my DD-214 states, "Homosexual Admission." Can a use that unfavorable remark on my military records to link mental health claims when filing for service connected.

@@KevinNordstrom Not if the incident that lead up to being kicked out under the discriminatory policy known as DADT impacted your mental health. Or if it caused major depression after the fact. Not to mention the stress caused when every employer you give your DD-214 to sees "homosexual conduct". Some of these folks in certain states were assaulted after their rights to privacy were violated and coworkers were told they were gay. It's actually pretty clear cut Kevin. I was also discharged under the implementation of this witch hunt less than six months before the policy was repealed. You should probably snag some of that beach front property because I have researched at length and spoken to many lawyers regarding this matter. So get out of here with those giggles you silly bigot. Acting like a teenage boy circa 2001 on a forum here to help veterans with physical and mental health issues when they are asking valid questions is a pretty bad look. Have a nice night.

Yes they most definitely can reduce a 100 percent rating.They said my prostate cancer was healed and cut it to 40 percent.

Don, I have bladder cancer which i chose to allow to go untreated . There is a chance the impossible has happened.and I could be cancer free. How long did it take for your reduction process play out? This stuff could reappear so then what. I'm just gathering info in case the shoe drops. Thanks

@@garlandetheridge9902 If the VA proposes to reduce your disability you have 60 days to provide medical evidence. If none is received by the VA they will render a rating decision with when/date your disabity will be reduced about 60 days from the rating decision date. The math shows 120 days. But in my experience takes a few more daxs/weeks than that.

No, the VA cannot reduce a Permanent and Total VA rating unless the original disability rating was based on fraud. The major benefit of being deemed both “Permanent and Total” or 100% P&T is that your VA rating is protected from a future rating reduction. This means the VA can NEVER reduce your rating!

Yes they can they do all the time, look at the VA OIG report released Last month. The Government Found that the VA WAS reducing 100 percent P and T veterans.

Am with you it’s turned into a glorified welfare system. Vets getting disability for a drinking problem like gtfo with that. Being a alcoholic shouldn’t get you money.
