According to some of the things I have seen, relating to the DBQ, it is stating that since 2020 the VA has discontinued using the DBQ form. C Files, electronically, are taking from 10 to 12 weeks to get due to VA backlog.

What troubles me most about this entire process is that the VA is not there to discern the truth of the matter, they are there to discredit the veteran and deny him his rightful benefits.

Not the VA's fault. A lot of our brothers and sisters have been dishonest and screwed it up for us with the real problems. They could do better with the screening process though and start legally holding the examiners legally accountable for withholding facts.

I don't agree. I'm a VSO for my county and my talks with VA staff and/or medical folks, they are ALWAYS ready to go above and beyond. The people at my VA clinic are like that and the two VA hospitals within my driving distance have the most dedicated people I've ever seen in a hospital setting.

On your post, I have to agree. I'm having this problem with my hearing claim in that the 3rd party's scores were much much higher than the VA's. According to their scores, my hearing was almost perfect! So, POOF! There's no compensation needed! But, I AM getting hearing aids for the hearing problem I don't have.

It took me 27 years until I discovered everything you are saying. I finally got my Total & Permanent IU Rating in 2007. I am a people pleaser, so of course I put on my best face at my initial C&Ps, with obvious results. Then, in 2007, I forgot that I was also a psychologist, stopped analyzing myself, and just presented my normal self to the C&P provider. I also brought every scrap of evidence and testimonial I could find. Result, TDIU, updated three years later to Total & Permanent. Forget your anxiety and the stigma...just go, and be yourself. Report everything you can and do indeed bring notes. I hope everyone that deserves a rating gets one, but the C&P is important beyond words.

The doctor doesn't need any paperwork from you. That is submitted when you file your claim. Then you see a doctor once your claim has been reviewed. Make copies of Everything you submit. Fortunately, I had a copy of my medical records. There were only facts with dates submitted, explaining the incident. Send for your med records. Did you hear the WW records burned. Get your records. Best advice my father gave me and I have given my daughter: DO NOT leave, sick call, sick bay, the clinic, a doctors exam or anything else medically related without at least 1 copy. I kept a copy and mailed a copy home. Thank God I did! "They" lost my records 3 times on my initial claim. Since, we're all late for that my personal advice go over all your records and be familiar with the order of when and how things happened. EVEN if your 100% certain, it was in a different order then the way its documented go with the way its documented. Or, make a note that it's not documented in the corect order. It's hard to change dates on paperwork after the paperwork is done. (That's a great place to get tripped up!) Ya'll are nothing like the crotchety examiners I had! AND, thank you, for NOT being like the crotchety examiners I had!!!

I can not sleep well anymore because of the pain and am short with people when I am around them. Thank you for this video! I'm going for an C&P exam. I need to get prepared. My take away from this is that: VA C&P evaluators are garbage and are not there for the Veteran. You are being judged the second we walk through the front doors of the testing facility. VA Raters/Evaluators are basically cops, can't trust them even if they try to make "small talk" when they're really gathering evidence to use AGAINST you, the veteran, which is why Veterans need a lawyer (hence this video and law firm) in order to have a FAIR shot at being evaluated. If the evaluation was so easy, then why the need for these videos AND/OR why the need to involve lawyers, and why the need to get "insider secrets"...this song and dance is the reason why veterans would rather take our own lives/go homeless, than to put up with dealing with these garbage gatekeepers, intentionally designed to dismiss veteran issues.

Absolutely. I recently had a virtual hearing with judge Skow ,it went horribly. I was anxious, not prepared, she was off putting. I'm pretty good at reading people and the way she started the hearing, stating that she was very busy, other cases to hear, disappointed that Alexandra Jackson wasn't there. She behaves just appropriately enough. But she cut my actual associate atty off, he wasn't even on the right track. He got information wrong. That threw me off and discombobulated me. I knew leaving, actually I knew after judge Skow initially spoke that she had already discounted me and my case. My attorneys have disappointed me time and time again. I didn't get the opportunity to tie it all up, explain the consequences of what my injuries had resulted in my life. How the path of my life changed course. Even though I kept pulling up those boot straps, kept trying, didn't just give up.I was tough and positive until I wasn't. I definitely do not trust the VA or the process. Gee, I wish I actually mattered.

Thank you for doing this video. I had a mental health exam earlier this year for a VA claim, and they didn't ask me about any of my symptoms related to stress and pain that I have from military service. In an hour and a half they only asked once if I had seen anyone killed in front of me and then acted like there isn't any way I can have PTSD or that the stress has impacted my mental health because I had already been diagnosed with depression prior to joining the military. On top of that, I was so anxious talking to someone I didn't know, I forgot to bring up most of symptoms I'm having, and they didn't ask, so the VA denied all my mental health claims. You covered all the mistakes I already made, so hopefully other vets will find this video and it can help them before their exam.

@@blackkmagik929 I would recommend using a firm. They won't help till current claims are closed, but when they do, they can get all your information organized better and submit the claims better to help you. They can't charge for helping to submit your claims, but they will seek back payment for your conditions to when they started and then charge a sum from what they win. The one I've been working with charges 30% if they win, but it's way more than the VA will give you. They will only back pay till the day you filed the current claim which might be 6 months or a year. Talk to a lawyer. H&P looks to be really good, and they give so much information to help you get started and describe what level you should be at based on you're symptoms. Berry Law is helping me with mine. The examiners even said that when I was working with DAV that all the records that they were submitting were a mess and hard to read through and find what they needed to support the claims.

There are a few minor entries on my DD214 that a reasonable employer might want clarification on, but no one has ever asked or withheld employment as far as I know for any issue related to my military service. Sounds to me like some folks bought into the 'it will go on your permanent record' concept. One was a child psychologist who was issued a cease and desist order by the board of forensic examiners. He was biased in child custody cases so the board ordered that he can never conduct forensic exams for court cases. Well, a C&P exam is a forensic exam. I sent that court order to an LHI supervisor and had my exam rescheduled. He also wrote some weird book without any Amazon ratings about youth social injustices in NYC. Just some constructive criticism if wanted. I am brand new to the VA process even though I exited service over a decade ago. The anxiety of the VA monster kept me away for a long time. Luckily, I found Vet Guardian to fight them for me. Just listening to the two of you talk about the process is bringing anxiety back, and here is why. I stopped the video at 7:25. I have no doubt that the two of you are incredibly knowledgeable and passionate about helping us veterans. However, most of us are not lawyers or phycologist, and the language is way above our heads. Using acronyms without context starts to loose us. Then continuing to move forward without explanation starts to give anxiety. Within minutes I was lost and had no clue what you two were talking about any longer. Slow down and dumb down for us a little bit. I'm going to move on to another channel but hopefully this helps you guys grow more. Good luck

This has been a very difficult process for myself. Thank you for all the tips on going to the exam and the insight from the physician was very informative. My problem is going to a C&P exam is stressful, which can trigger events. You are expecting yourself to know all of your medical info, be able to answer questions the correct way, be aware of the process you are in, float like a butterfly and sting like a bee etc. While all this is going on, add a migraine headache and anxiety to the mix and you can see that it is not realistic to get ironclad responses from the patient. In fact, I have a very hard time articulating thoughts or processing information or doing any critical thinking whatsoever. Of course, to yourself, this is normal but the people interviewing you do not know that.

The best thing to do is have a real Doctor that specializes in problem your having do an exam in the same time frame. I did this and the Neurologist I went to got it right and the VA sent me to her but then didn't want to accept her EMG findings. She said, Complete twice and the Contract witch Doctor said my foot and ankle still work without me there and the same date. I went from 0-90 percent last year. I found errors on every Decision. I won 3 Higher Level Reviews and got A BVA win and they slammed the Regional office and maxed me out on everything for the entire Appeal Period of 10 years.

I've had one exam that was taken via video. That exam mildly rose my rating for depression. I was suggested to look into TDIU, so I did. When I had the exam for that, this doctor said that he doesn't know why I wasn't moved to 100%. I sincerely think that the video appointments hide a lot, when you only really see head and shoulders.

Records - I found the St. Louis archieves only had my separation physical, while my "C file" had all my medical records. I also found the C&P Examiners were overwhelmed by the amount of files sent to them (3,000 pdf pages) and asked me for the relevent files. I found I was the only one that knew everything in my file. I had to email my Independent medical opinion to one examiner, because the file was mislabeled.

OBTW: I was an elite powerlifter on the Army powerlifting team. He didn't mention my seizure disorder (which I finally got 40% due to a buddy statement because I didn't even know I had them) but at any rate...He did no real exam and didn't ask anything. Trust me, I am a doctor, and I know what a physical exam cosists of. However, now I can't go back and complain about that examiner, the lack of a real exam, and the fact that it was 20 years before I got my compensation; the VA had a neurology note dated 1988 stating that I just might have epilepsy!

As a reservist, retired in 2011 with 28 years of service and was not afforded a separation physical. I was a IMA (Individual Mobilization Augmentee) so the separation was done with me resigning my commision and since I am under 60 I am still in the retired reserve (Gray area Reservist). I asked for a separation physical and I was told there would be none. Emailed me my separation/retirement orders and it was done. No big ceremony. I have been able to get 60% with some Nexus letters from my civilian Dr and a BVA review that took 7 years. So it is possible but takes time. I did have some medical treatment records that was before my retirement date but most were from civilian or VA doctors and not from a military facility since reservists do not normally go to military facilities since they are no on duty for long periods of time and cannot get an appt for non emergency issues before coming off of orders. At least that is my experience. Any other Reservists want to share their experience?

Tough to provide documentation when medical records are "lost" or destroyed by a volcano erupting. Even when trying to get tested for problems, and getting treated by someone who didn't deem it necessary to conduct testing for something he could misdiagnose readily. So, 2nd degree sun burns and falling down a mountain during training, with bruised ribs, concussion and dislocated jaw, the being given a diagnosis of a "slightly deviated septum" and later finding out it was actually severe sleep apnea and deemed "too late for a re-evaluation". Yeah, I'd rather see a witch doctor or rot in a gutter then have to try to deal with the VA again. Wish I'd known then, what I know now. Hope others can benefit from this information before that door closes.

I started to become very angry, but not visibly. I am a combat veteran, and for her to ask me that was extremely insulting. She asked me to go into the small room where she put headphones on me to start the audio exam. I started having a panic attack, probably from the anger. Needless to say, in a rush to get out of the room, I failed the test. The VA cancelled the Tinnitus rating I had.

In other situations I was deployed to numerous locations and whatever happened there WAS NOT recorded. I went to see Doctors in the Clinic's at those remote locations post battle encounters where I couldn't hear at all...and the doctor just said, it will go away and NOTHING was ever put in to my record. Then the VA asks for those records which were never properly created/saved. How does that work? The VA takes advantage of the Veterans situations like this to deny the Veteran their just disability compensation.

At the end of the day it boils down to who is reviewing your claim and who is examining you. These C&P examiners arent considering laystatements, they are throughly looking through your claim. VSR isn't looking through your records thoroughly and the RVSR may not catch everything Tips: when you submit your medical records HIGHLIGHT your evidence. When you submit your statements, BRING THEM TO YOUR EXAMINER GET A COPY OF YOUR DBQ RESULTS BE CAREFUL WITH PRIVATE POAs all they do is submit a cookie cutter statement to the VA...on your behalf

We can only help with appeals, and if you have a secondary service connection claim that received an unfavorable rating decision, we can help with appealing that type of claim.
