The grading seems just a tad subjective, but it tries to be fair. For example, the video of the Chicago cops arresting the CTA officer gave the cops a C minus so it tries to be fair.

It must have been a humbling experience though. Field officer comes out and corrects your actions as an officer, and I'm sure he will get more internal corrective actions from his superiors about his lack of knowledge and professionalism. A law suit is clearly not needed in this case.

A cop's job as defined by the law allows them to skirt the line of the constitution on a regular basis, using technicallity as a shield. He deserves an award not because "He did his job" but rather the fact that his discression should be exemplary among the force. Also don't forget, he's not just a cop, he's a captain. Meaning if this is him on an average day, then he basically is standing between his community and corrupt good ol' boys in his precinct, not only doing his job but forcing them to do theirs. We give awards for participation these days. If he is pretty much solely responsible for keeping an entire precinct honest I think he hits the baseline for an award, even an internal bonus for actually doing shit correctly.

I don't see first responders as hero's, not because I dislike them (because why the fuck would you hate fire-fighters and paramedics?) but because they have signed up to do a job and just like everyone else, is expected to fulfill their job and role to the best of their ability. If your work puts you in harms way, then life risking situations come with the territory and shouldn't be treated as unusual or commendable

That is what is so disturbing and frightening about the time BEFORE all interactions with LEO's were able to be recorded by ordinary citizens as well as auditors. The illegal things that cops did and got away with could fill up the Library of Congress. They don't have to provide their name or badge number. That is a common misconception. However is not very professional and it is policy for most police departments to provide their identification upon being asked. Still, policy is not law

Yeah I don't know why they engage. Even if you want to go out and chat with them, if they clearly aren't there to cause trouble just tell them to have a good day and leave them to it... It's kinda like how the public transit system where I live used to try and arrest train nerd photographers before realizing it's absolutely not worth their time and that they were doing nothing wrong. Hell sometimes an extra observant eye in public is helpful to these agencies.

My favorite is keep your hands where I can see them followed by exit the vehicle. If you don't know how locked doors and seatbelts work then you shouldn't be allowed to carry a weapon of any kind

It's important to remember that laws are set on precedent and historical context; and you always show that in your videos and it's greatly appreciated. Honestly, I would really enjoy a video series that focuses on specific and common laws and their historical precedent and context instead of specific police interactions, but I know that's deviating a bit from your regular videos. I've been bingeing these videos lately after discovering your channel, huge fan.

@@AuditTheAudit This is Clark County Detention Center, a County Jail not a prison. These people are Sheriff Deputies not Correctional Officers. In Nevada as well as the rest of the States, the Sheriff and Deputy Sheriffs have lawful authority to arrest people, not for what he was doing, but they can for any real crime.

To a limited extent I agree, but if his priority was genuinely to educate, he could have held an impromptu quick 10 minute session on the spot with the captain present, going through the officer's actions that were illegal, and ending with the liability issue the officers created for the department, need for training, and need for the captain to restrict their use of authority until they become better educated. To drive it home, because it has been widely upheld in the courts that it is legal to film public employees on duty, and may no longer protected through qualified immunity, potentially making them personally liable.

@@Trip_Ts Loitering laws vary, but I have never seen any without additional requirements, usually involving not having a purpose for being there (here he had a purpose), and usually obstructing others in some way (here he was on the street alone), neither of which require permission from businesses and residents as long as you are on public property.

Sadly, cops aren’t even held accountable now. What we really need is civilian oversight boards made up of community members who have the authority to bring charges. And the cops should be tried in a special court with prosecutions judges they have never interacted with.

@@armelburgess8651 journalists and auditors do that Turning off the camera isn't perjury it's just tampering with evidence, also a crime, and filming on public property is a first ammendment protected activity I think it's a snowflake move for a public servant to prevent their duties from being recording, seeing as it's their duty to uphold the LA and filming police is an important, *legal* activity, police precincts with enforced bodycam policies see drops in complaints from civilians, because a cop is more likely to follow the rules when they know they're being filmed and that the film can be used against them

The CO was a bit too aggressive and apparently in the wrong about the auditors right to film there. But I was happy to see he was big enough to apologize. I hope the auditor would likewise stick to his agreement for that apology.

Gadget Addict: The bad guy not a "bit too agressive" when he took the auditor's camera and handcuffed him illegally. Why call this a "bit too aggressive?" It was VERY agressive. And it wasn't "big of him to apologize" since he wasn't the one that apologized and he would have been forced to. The Captain did not arrest the photographer; it was the jail guards who did. He instructed them to let him go, he de-esclated the situation and he apologized on their behalf. The bad guys didn't apologize, but did give their badge numbers because they were required to. The auditor did NOT agree not to file a complaint so there is no reason to say that you "hope the auditor would likewise stick to his agreement for that apology." Watch the video again. Why are you excusing and complimenting this illegal situation and putting some kind of onus on the innocent auditor? Your response makes no reasonable sense.

The CO that put his hands over the camera and detained the auditor was clearly NOT the captain who later ordered the auditor's release, issued an apology on behalf of his touchy subordinate, and offered to assist in a complaint. This is what we're pointing out. And also nothing obliged that auditor not to change his mind on something that isn't legally binding, he didn't escalate this one bit. And the captain would deserve absolutely no part of the complaint and probably would not be accused either.

SAYWHAT? What's the point of these auditors even auditing? It's annoying. Cops know that they are auditors after like 15 seconds of talking to them. Cops know that NO criminal ESPECIALLY if they had a warrant or were on probation or parole would EVER BE NEAR A POLICE STATION FILMING AND BEING A GENERAL NUISANCE FORCING THE COP TO APPROACH THEM AND ASK FOR ID. If I was a cop id be annoyed too but I know enough that I wouldn't even bother talking to him and I'd just call him out on being an "auditor" and tell him "dude you're such a loser you have NOTHING better to do than come bother police and record their property and even though you legally have the right to do so especially from the sidewalk, it is just annoying, pathetic, and pointless. You know what. After watching a lot of this channel's videos, I think this is one of the best audit outcomes. An error was made from the officers, a superior stepped in, corrected it, and a sincere apology was issued to the citizen. Sometimes complaints (and lawsuits) are a very useful tool (both for corrective and documentation purposes) but sometimes I enjoy this resolution on a more Human level more. I deeply respect the cordial approach of the Captain as much as I deeply respect the mature and human way of the auditor to just take an apology and leave it at that. Honestly one of the best videos so far, imo.

That's because they rush them through the academy and beg and give them all resources to keep up and learning. It's encouraged by most cop house's and have the info on classes and all cop house's have gym's and expect them to be used. I'm retired law enforcement and I've always been discussed with coming out of the academy and not taking advantage of all the options for us. I'm so glad I did.

The captain in this video caused me to do a lot of rethinking on the comments that I have put on KZbin through the years concerning videos on law enforcement officers. This captain in the video was a breath of fresh air to watch and to look at and listen to. He is the kind of man that all of humanity can be proud of and you can tell he's a man of honor and high ethics and is dedicated to his job and is a public servant that all of We the People of America can be proud of and feel lucky that we have such a man Within law enforcement. If only We the People could see more videos with men of Honor like this captain working for us within law enforcement and not having to watch rotten apples day in and day out ruining the reputation of law enforcement officers across our nation the negative mindset of We the People for law enforcement would rapidly turn into a positive mindset.

This CO isn't sorry for what he did, he's sorry that he got "caught" doing what he did. I've been watching videos like this for YEARS and NOTHING ever changes because if and when the officers actually face any "punishment", it's never the officers who actually pay for the lawsuits, it's the tax payers that they're abusing. Abolish qualified immunity and force officers to pay out of their own pockets when they violate citizens rights and I GUARANTEE that shit like this will stop happening IMMEDIATELY or the "bad apples" will be weeded out swiftly.

They should be required to carry insurance the same way nurses do with malpractice insurance. If a cop continues to violate rights and laws and get sued eventually the cop won't be able to afford to work as a cop because we can't afford to carry his required insurance.

I don't know if qualified immunity should be abolished, but certainly reassessed, it is too all encompassing in it's current form. They do need a degree of protection in order to be able to effectively do their job, but the near absolute immunity they currently have encourages the misuse of authority and presents an evident risk to the people.

Police officers should really learn the difference between "private property" and "restricted space". Just because some government-owned area may be restricted from public access does not make it private property.

They aren’t police officers though they are Correctional Officers. In Australia they would absolutely NOT be legally allowed to do any of the things they did & wouldn’t consider trying due to the repercussions. These officers also are not allowed to do what they did, they apologised but not sure they meant it really?

@@Bodybeautiful I consider it an arrest whenever the handcuffs come out or they say you're under arrest. If they release you before taking you in and booking you then they're cancelling the arrest and will call it a "custodial detention" on their police report. smdh

Did the officer technically break the law or violate the auditor's rights when he grabbed the camera? Could he have sued over that? ( EDITED - 'sued over' the violation of his constitutional rights only. Not his time or his filming quality or anything of the sort. The entire purpose is to educate and to maintain and to protect our constitutional right to film. Sorry for the lack of clarity. For anyone that does not understand, the purpose of these lawsuits are to protect our rights and not to make money. God Bless our First Amendment Auditors !)

Technically however it would be hard to win that I think most auditors including myself would prefer them to be educated and if they're not educated then you talk about suing and filing a complaint because in the end until the money comes out of the own officers Pockets the city is the only one that suffers for it the officer usually is not even wrote up what other job can you cost the company tens of thousands of dollars and not get wrote up or more likely fired

It's almost definately technically assault (or something similar, I don't know Nevada law specifically), and that has been upheld in other similar situations, but it's often hard to get it prosecuted.

You should see what cops do to people in prison when no one is watching. I saw one cop slam a detainee’s head up against a steel door frame full force - shattering his skull, and sending him to the floor in a pool of blood. The cleanup crew came and got him but I doubt he lived.

I agree. Normally I’d think the auditor should press charges if possible because just putting someone in handcuffs can’t be taken lightly) and it wouldn’t have been if this guy wasn’t LE adjacent). But the CO seemed like he was actually extremely sorry and realized he messed up big time. I’d like to think he learned from this, educated himself and appreciated the break he was given.

You guys have been NAILING it lately. Also...I can't think of something more frustrating than an overzealous C.O. (when it comes to enforcement..) But I must say the fact that they actually APOLOGIZED is awesome. They swallowed their pride and actually seemed somewhat remorseful. That takes a real man. They gave us hope that not everyone who wears a badge is a complete prick. This is a good outcome. This makes me happy.

The sign reading “THIS IS A PUBLIC BUILDING” is a notice that firearms aren’t allowed in the building pursuant to Nevada law. It’s not a declaration of forum although the gun restriction tends to indicate that it is most likely a nonpublic forum like jails tend to be. A public building can be a nonpublic forum.
