as per development agreement it's given in consideration mean it is a part and parcel of the development agreement so society can not claim on the parking areas which are allotted not sold

Can tenant of a member can park his vehicle ? What will be charges for tenant 's Vehicle. Residential flats are used for commercial purpose, members are not residing in the Society, can they park their Vehicles ? At what charges? Commercial rate can be charged for such Vehicles? Can the employee of commercial can park in the Society in addition to the member who is commercial user , not residing in Society. How many visitors can enter and park their Vehicle in Society? Can a Rikshaw of tenant of a member park in the Society? If the parking is not alloted , member is parking in available place , is he liable to pay parking charges ? In recent High Court judgement, it is stated that the member residing in Society, shall not be levied parking charges by the Society for alloted available place in the Society. Please clarify the concept. What is the limit on number of Vehicles , a member or his tenant can park in the premises of the Society? Query by Smt. Jaimala Parulekar.

Sir, I stay in a newly constructed apartment society in nashik. Committee is formed and is in the process of suggesting various charges to be borne by apartment owners. Society consists of 172 flats with 88 covered parking (stilt and side ) and 84 two storey hydraulic parking. Those who are alloted covered parking say since there is no expense on covered parking hence they shall not contribute towards maintainance of hydraulic parking which is roughly ₹5lakhs per annum (3lakh AMC plus 2lakhs drivers/operators) Whereas those who are alloted hydraulic parking insist that every member should bear the expenses. So can society charge only the hydralic parking owners ? What is the legal status.

Sir, what if parking space allocated to me by society is improper? I am unable to park my car in my parking space, as the entrance space is too narrow. I don't need an extra parking, however, I need society to compensate the parking area as I am unable to park my car in the space allocated to me? Is there any legal way, which i can opt for?

Respected Shripad sir the coverd car parking is given by builder to first member of SoC then to second and later on to third member of SoC.Now third member has sold flat to fourth person.Whether this third SoC member can allow the use to fourth would be member.This is continuously in possession from 2007

Hello Sir , I am in Pune . I purchased flat from Builder In PMRDA. I got possession and car parking . Our Building got completion certificate . Now builder formed working comittee, handover process is going on and Builder selling some extra space in society area as Parking. Every flat owner already alloted one parking . So Builder selling extra parking to some flat owner in cash. We observed that he erasing visitor car parking sign and alloting to someone. As majority of Commitee member having double parking so They are not raising concern and giving answer like society does not have authority until it is handover . My question is that total 150 flat are their and number visitor parking is 3, so their any law in Maharashtra State stating this is minimum number of visitor parking should be in society? and How we can stop this activity of selling open space marking as parking ? Please include rule number because we raised concern to society member and they are asking for laws and rule number ... Waiting for your response

Dear Sir, can the society charge exorbitant parking charges (three times) from tenants under the agenda parking issues. In the agenda they only mentioned parking issues but passed a resolution stating that flat owners who have given flat on rent should pay three times more than members and that charges to be recovered under mutual understanding from the tenants.. Is it justifiable as the owner is eligible for a single parking as being common amenities for members to enjoy and if that flat has been given on rent so charge them extra... Your valuable advice please so that i can take this forward with our committee. 🙏🌹🙏

मुंबई सारख्या काही छोटे प्लाॅट एरीया ( साधारण 500 चौ मिटर) असलेल्या शहरात नवीन इमारत बांधताना सर्व सभासदांना पार्किंग मिळेल असेच बांधकामाविषयीचे कायदे करावेत जेणेकरून महापालिकेच्या रस्त्यावर पार्किंग करून रहदारी ला त्रास होणार नाही. अगोदर इमारत 4 माळ्याची आहे तिथे रिडेव्हलपमेंट करताना 8 ते 10 मजले बांधण्याची परवानगी दिली जाते. पण पार्किंग च्या बाबतीत विचार का केला जात नाही. 30 - 35 वर्षापूर्वी सारखी मुंबई आता राहिली नाही. त्यामुळे अशा कायद्याचा बदल हा झालाच पाहिजे. पोखरकर गोरेगाव

Nice explanation. But law is trash and actual ground reality is different. What is actual ground law ? Parking is always sold and builder allocates this. Parking goes as attachments of the flat and remains with owner. If rera or Supreme court law will be implemented by society then courts will be flooded with litigation.
