Case Dismissed State Attorney Says They Are Not Going Forward On Your Case- Now What?

Gentleman called my office recently and told me that his case was recently dismissed. He said the state declined to file and he wanted to do know what to do next and asked if I would make a video. Relatively simple topic but most don't know what happens next so here you go.

I have a situation, not much of a legal anything really. Ok ,oour prosicutors here don't study a case,doesn't check to c if any"evidence,or charges, police report, Victem interview,is legit,admisable,useable,credible nothing. Reads the charge section of report an skims over it 5 mins b4 . Yeah he's real support to his tax paying citizens I tell ya. F'n idiot. he calls u up,charges whatever the "out of jurisdiction" city cop from a nother city. Right after my dream mare atty informed him,the judge body cam footage shows illegal entry,search,siezure And he stood right in front of the camera,judge,people n court, stinographer,then states that he wasn't going to drop the charges. I said ok "cause I already pissed him off by stating we just need to dismiss everything today. He wasn't having it,so I said ok I'll call governor an c what he says about it then. But he's a Dem. I Rather call the att general ,but he's running for govonor next week too,? Any advice? It's 4 f'n yrs I never broke a law. The,"vindictem" violated about half a dozen codes of ethics an misconduct violations,the city cop violated his jurisdiction for her private matter n which she started an altercation set me up,an sent him over to the place I was house sitting

Fudge,I forgot to say I was unlawfully served a unlawfully signed arrest warrant an taken to jail for 5days. Over the screen the judge seems really confused,as he makes not 1 but 2 references to his prosicutor as to y I'm in jail?!? A: he didn't sign the warrant,b the justice of the peace must not have signed it,the circuit judge would not have signed for a district matter . So who did? Well in the end it won't be coming back against me anymore. C: it was 6 1/2 months after initial incident,and I quote does h "HE!" Not fall under the CDC ORDER OF NO LOCK UP COVID PRRIOD?!? send it to circuit,no paper work,date to go,got arrested again 4; months ago for,u guessed it,Failure to appear. ! Oh yeah more unlawful jail or imprisoned against my will. Unlawfully imprisoned Twice! An no gd am body in this country will touch it. DOJ. I've messaged 4 times still no reply,the ALCU,THEY JUST DONT Have time,to busy makeing sure the illegals crossing are ables to have abortions,an housing. O an most of their court attorunies are tied up n Lgbq rights cases. That's understandable,just as American as I Am God savem. So,I'm totally sick of this immune to,above the,unrestricted gustapho treatment. Is there any one in our government,or legal field at all that put these organized crime super duper heros responsable for their neglegence, purposely,ignoring my rights,while doi any- ANY THING they c fit,or don't unrestricted. They ain't far folks from hanging for what they are responsible for over this. He refused to drop charge coz he knows it's automatic suit,but idiot wouldn't listen when I tried to spare his career,and freedom. Apparently he think Mr trump will b elected,nor that he's n any long-term damage over it. O well,the bar association,stare att general are the only 2 left that outrank him locally,and so if they choose not to justify their people,I'm going to need some of yalls help. You forgot to mention that on a job application once the expungement has taken place that you can check the box that says NO when it asks you if you have ever been arrested.

Doesn't that also mean the person you're defending gets a check? The courts are supposed to give that person the check and if they don't get it isn't it abandoned property and why don't they tell us this?

How can you get a NOLLE PROSEQUI case dismissed with prejudice after the 21 days passed without reopening the indictment?

I've looked at a local drug dealer's case information. He's been arrested for trafficing in drugs 5 times now and every single one of those cases ends with "Nolle prosequi entered / indictment" -- What gives? Is he snitching? Or is he paying someone off??

so i got a citation for fishing without a license. first time of anything happening with a ticket, a stop or anything. i was sitting in my vehicle and my buddy was fishing. he told me if i got a fishing and hunting license he'd dismiss it. i have to go to court. i have my license. i got it the same day. im kinda scared of what's going to happen.

What if adjudication was withheld? And you get charged with a new felony years later. If it gets dropped or dismissed, can you seal or expunge this new case? (Adjudication was withheld on last case and sealed record on last case)

I was in my 2006 Nissan Titan crew cab ( dogs are my crew) that my wife wants me to get rid of. I bought it new in 2006. Always been good to me but paint is fading. If I can find a new truck on lot, I will eventually buy new dodge , ford or gmc. Dodge has best warranty. In the meantime the Titan is king

I had a case dismissed years ago . And when ever I applied for a job in LE that case still came up . Regardless of expunged or dismissed . I was told it’s not shared with any one else other then LE agencies that do a criminal background check for employment in LE

Usually when a case is dismissed in court, it rarely comes back. With prejudice means it does not come back. Can’t say I fully understand your question as I don’t know the facts but talk to your attorney as it sound like your probably good.

What's it mean if the judge dismissed the charges for lack of evidence but my lawyer says they can still charge me again I was charged with firearm by a felon but I was in a vehicle with someone who had it on them I'm constantly stressing they will arrest me again but the officer never even filed a statement or anything I'm wondering if u could give any advice and this was in north Carolina

Love the videos, I have a question I haven’t seen answered by someone w/your qualifications though. If I’m a licensed CCW holder involved in a defensive shooting. I stay on scene, call the cops etc. Assuming my decision to engage a threat was legitimate, should I talk to the cops? I’ve seen some people say that you just ID yourself and say “attorney”, without offering any description of the events. That approach seems a little antagonistic, like someone who did something wrong trying to go for the best outcome. Can you share your thoughts ?

If they want to put cuffs on you, nothing you say will change that course. So just remain silent.

If the case is declined at case filing after arrest on felony, they can bring the case back up to 175 on felony and 90 days on a misdemeanor.

6) EFFECT OF EXPUNCTION ORDER.- (a) Any criminal history record of a minor or an adult which is ordered expunged by a court of competent jurisdiction pursuant to this section must be physically destroyed or obliterated by any criminal justice agency having custody of such record, except that any criminal history record in the custody of the department must be retained in all cases. A criminal history record ordered expunged which is retained by the department is confidential and exempt from s. 119.07(1) and s. 24(a), Art. I of the State Constitution and not available to any person or entity except upon order of a court of competent jurisdiction. A criminal justice agency may retain a notation indicating compliance with an order to expunge.

Then that check is put up for auction. This is another one of those gyms that America wants to hide and has been really good at hiding this from the American people
