One of the big issues is that most lawyers won't get that deep into the facts of a case. Unless of course they're a wealthy client like yours. So they will take their fees to retain their services, and then trade plea deals with the DA like they're pokémon cards. And innocent people end up having to make a decision to go to court with a lawyer who won't fight for them because they don't have the money, or they take a plea deal for a couple years versus facing 10 to 15.

This exact thing happened to me. The police report was at best 50% accurate. It painted me in the worst way possibly. So i tried to fight the charge and ended up in even more trouble than if i hadnt tried to fight the original charge. The public defenders suggestion actually cost me more.

If prosecutors intend to use somebody on The Brady list to testify in a case, they have to notify the defense. As a result prosecutors usually will not use a Brady list officer, and will throw out a case, if a Brady officer is the primary witness.

That’s exactly why the reports have to be rigorously vetted and impeached by an independent investigation. Often they contain material errors of fact. This is true of traffic tickets or felony complaints.

There is a fee/debt/"charge" issued for each crime. If a person is convicted & the JUDGE sentences the person to prison, 82% of the TOTAL of the "charges" goes directly into their retirement fund/ per person they send to prison. Hummmm, let that simmer for a second. How unbiased & impartial do you think that makes alot of them? Do you think the "judges" in our system are giving WeThe People access to a fair trial? In ANY ARREST & Trial, systemically so many of our Constitional Rights are broken, it is beyond infuriating. If a criminal investigator fails to include a witness statement because it helps the person arrested can there be anything done? In the report he said the person didn't witness anything but at the preliminary hearing he was asked three times were there any witnesses? First time & Second time he says No. The last time he says well I think the wife may have witnessed something.

Sounds like there is another witness. Use an investigator and find them. Talk to your attorney. The cops are there to convict you not help you. You have been arrested so you are the bad guy. Use their sloppy investigation to your advantage. That’s what’s wonderful about cross examination. Your attorney gets the opportunity to show the court and all in it how incompetent they are. Or hype them up when it’s helps your defense.

Reading documents on police history, this was NOT ALWAYS the case of writing a report to convict. There were one or two honorable Chief's of Police in 1954 that wrote " accurate and fair reports"

Question for you, in the State of Florida, does a probable cause affidavit have to be NOTARIZED? If it is what they have used to make their arrest? Affidavits are suppose to be sworn testimates of truth & verified that the person writing & signing it are truly said person. A Probable Cause Affidavit I WOULD think ABSOLUTELY would need to be since it is essentially acting as their "temporary warrant," so to speak. Even if a Superior officer "attests" to it, how does one know he isnt just going along with what Officer Joe SAID happene. Of course he is going to collaborate his buddies story. Where as if it is notarized then they LEGALLY are committing purgery & they would be doing it with malfeasance. Ive found conflicting answers so was hoping maybe you could give me a definitive answer please & thank you sir.

I have a huge question, can a cop report you to court with not enough evidence over an audio identity fraud? Also if the cop already reported you the court house takes over they send you the letter and evelope from the courthouse but what if you received the letter from the police station is that like the cop involved into something or what. Because usually I heard that cops don’t get themselves involved into audios unless it’s enough evidence and a threat or something but for a drama they don’t get themselves involved. I just need someone to confirm….???

Sue his ass for falsifying the police report and call the DOJ civil rights division. Have them investigate what happened between you and the police officer. Police can be charged for crimes under 18 u.s.c 241 & 242 and other federal statutes… I’m no lawyer (at least not yet) but in my experiences with sheriff deputies, SAO, lawyers, and state and federal judges… I’m no one to be fucked with when it comes to constitutional law, specifically Fourth and Fourteenth Amendments. Also, educate yourself on Florida Rules of Criminal Procedure. You can easily find it online. Lastly, don’t let the government officials bully you as if you don’t or show them that you’re buying into their intimidation tactics, they’ll not only respect you but also fear you.

Correct. But the point of my video is for those that read the police report should not give up. Being arrested and having a record clearly begins prior to what I am discussing. My point of view is to fight a case and prove accuser wrong. Never give up based on what is contained in a report. Comments by Officer or victim in the report are not facts simply allegations.

I have found what you have shared here to be a very good tool to use and share. It is in understanding when people try to document what happened, it can be open to interpretation and perception by everyone involved. I do agree with your part about when law enforcement do not write detailed reports, it allows the defense to ask more questions to create and cast doubt on the State. You have "Mistake of fact" which can be made known in a report because it is not being concealed. We also have body worn camera video footage that may or may have not captured what an Officer describes in their report. The elements of the offense are required for an arrest and if reasonable, the arrest itself may have not been illegal based upon the totality of circumstances,although to write something that an Officer did not witness would make me cringe because I can see how all the reasonable essentials went out the door.

If a baggie of drugs is claimed to have been thrown to the ground by a bearhanded, handcuffed defendent, it is expected that that evidence would be preserved and tested for dna or fingerprints. If not, that raises reasonable doubt if there is no reliable eyewitness testimony. In this era of police bodycams, it is expected that this evidence would likely be on video. If not, then there's reasonable doubt. Evidence not preserved or reasonably tested = reasonable doubt.

I was charged with assault by motor vehicle . The cop said he saw on surveillance video the rear right tire of my car run over this fake victims foot . I kept asking for the surveillance video , they kept giving me excuses about getting it to me . Eventually the DA said he lost it ? But that he saw the video before he lost it mind u 18 months later of about 20 hearings . He admits he didn’t see any assault on same video he lost prior to losing it . But he can’t testify to it because he lost it . I had it dismissed for Brady violation losing exculpatory evidence . I then wanted to file a law suit against the detective for lying that he saw me running over this fake victim . As the prosecutor impeached him on the record by admitting u can’t see any assault on video . Just a car driving away . From the get go I explained that u can’t assault anyone with a rear right tire ? What am I an acrobat with a car ??? It’s all fake . The dude filed a false police report . Bottom line I was told u can’t sue the cop because the video is now missing and so what if the prosecutor says there was no assault to be seen before he lost ??? Mind u I lost 19 months of my life because this detective opted to lie instead of protecting me from false reporting . What’s your opinion of that ?? As the only reason there was probable cause was because the detective lied that he saw on same surveillance that I ran this faggots foot over same surveillance that the prosecutor later admitted there was nothing of such content to be seen …. I wish I knew more about suing city and county over police misconduct. There are mechanisms to do so. You need court transcripts etc but seek out some attorneys that file those lawsuits for their opinions
