Q1-Whats is Section 269SS ??
A person cannot accept loan or deposit or any other specified sum (specified sum here refers to an advance or otherwise, in relation to the transfer of any immovable property) from another person otherwise than by an account payee cheque or account payee bank draft or use of electronic clearing system through a bank account
Q2-Penalty Not applicable in this case. (Banking Govt also exempts)
1. A person earning only agriculture income accepts loan or deposit from another person also earning only agriculture income
2. Receiving cash from relative during emergencies. Here intention should not be to evade the taxes.
3. Partners contributing cash capital into partnership firm
Q3- What is Section 271D of the Income Tax Act??
Ans: Lays down the penalty to be imposed on a taxpayer for accepting or taking any loans, deposits or other specified amounts in contravention of Section 269SS. Under Section 269SS, all loans or deposits of over Rs.20,000 must be taken through banking channels. In this article, we look at the provisions of Section 271D of the Income Tax Act in detail.

Hi Sachin, my parents are selling their house at market value 60lakh. Circle rate is around 30lakhs. Buyer is geeting home loan for only 30l and he is saying he can only do registration on 30l(to save stamp duty). Rest 30l he is sying he will deposit to my parents account from their account or by cheque. But if Income tax will ask my parent how you got extra 30l, they won't be able to answer this. What is the best way to accept this money? Can my parents create a pvt ltd company and accept 30l from buyer in company?

I think there is no solutions, buyer only pay by cash the remaining amount to save stamp duty. We were unaware of the laws. In our case we submitted those cash into our account unknowingly, and we are doomed.

Govt should keep circle rate much higher than actually prevailing rate to curb black money. Black money and speculation in real estate / land are biggest problems of India.

Govt should actually reduce registration (stamp duty) fees, capital gains rate etc. This will help people in disclosing correct amounts and abiding law.

Sir, one query. A property has 4 shareholders A B C D with 25% share each. They sell with total amount 10cr having 5 in chq nd 5 in cash. In 1st aggremnt of bayana, part payment is described for payment schdl. After getting whole cash, 2nd aggremnt replaced 1st with 5cr chq payment. This 2nd aggremnt is shown in sale deed. Questions.. will the 1st bayana be shown ... Thanx

Sir in my case my father is 65 ..he has a flat ....The flat is sold for 48 L..The purchaser told that he will get only 80 percent of the loan amount from the bank..i.e he requested to make an agreement for 60 L so that he may get the loan of RS 48 L. Now since the registry is made of 60 L but in actual my father received only 48 L in DD. My father is ready to pay 20% tax i.e Rs 2.4 L on 12 L which he has never received. Kindly suggest whether he will get a penalty or not?

Hi sir I want sale my Agriculture land in 1000 sq ft breakups to different buyer's but this land is within Range of muncipal corporation Do I need pay capital gain tax in this case also ? Maine kisi ko account se payment kiya 17 lakh or 15 lakh cash 32 lakh ki property usne mujhe girvi rakh di or do blank security cheque bhi diye ho or wo 420 me properly dispute ho rahi h to kya adalat me cash ka jikra karna chiye abhi ragistrar office me property ka ragistration nahi hua h. Case laga diya to kya 15 lakh cash ko we can show in adalat.about source.
