In decision by ITAT Vishakhapatnam in the case of Vijapurapu Sudha Rao v. ITO, Ward -3(1), it is held that if a person receives cash from the sale of property and deposit such cash in the Bank and also pay Capital Gain Tax on such sale of property, the penalty under Section 271D will not be imposed on him.

कैश लेने का कारण है, जमीन या फ्लैट की सरकारी रेट पर रजिस्ट्रेशन पर 8 % या ज्यादा चार्ज लगता है, इस वजह से लोग सरकारी रेट पर बैंक में पैसा लेते हैं, और बाकी पैसे ब्लैक में ले लेते हैं, इससे उनका बहुत पैसा रजिस्ट्रेशन चार्ज का बच जाता है, सरकार अगर रजिस्ट्रेशन चार्ज को कम कर दे तो लोग एक नंबर में ही काम करेंगे ।
