A business I worked for in the past had a similar issue when we expanded into a new territory. The other business threatened lawsuits etc. Turned out they didn’t have a trademark. We did. My boss went after them. LOL. The thing is, he wouldn’t have been so mean if they had been nicer at the outset, but since the were jerks, he was cutthroat.

I'm not sure of that. He copied the name of another vender/business operating in the same geographic area. He had to know it was going to cause problems. If he didn't know that, he shouldn't be running a business. Everytime these two business go to the same show, it's going to appear they are operating two booths.

I checked and the North Carolina guy has a PENDING trademark on the name. So no cease and desist can be issued until it’s approved by USPTO. LLC is just something for taxes and to protect your personal funds, it doesn’t give you 100% right to the name and only 1 can exist per state.

As far as I understand, if your state grants you the right to an LLC under a specific name, then that can be your legal company name. The government will ask you to pick an alternate LLC handle of that name is taken.

I buy cards to grade and sell. I have bought probably $10K of raw cards from catch em. The cards were priced fair and I have gotten about 70-80 percent tens which resold for about 3X what I bought them for. Owners were cool to me. So, I can’t complain.

Edit: One other thing that is worth mentioning (coming from an attorney who commented on the SC catch em’s instagram) is that since the convention was in NC and since the NC catch em was a registered business in NC, the SC catch em is not legally allowed to call themselves the same name in NC. The vise versa is also true (the NC catch em can’t operate in SC as catch em). I am not an attorney or anything though, so I don’t know shit. Lol. I am just a cardboard grading virgin. But it sounds simple enough. If a company registers their business in a state, you can’t operate in that state under the same name.
