So I paid for a class took it and was dead confused. I was trying to put examples around this. I hate some things get discussed that not covered here but you definitely do a whole lot better than a lot of teachers. Now I will pay again and feel a whole lot more confident taking the course. You and prep agent combined are killing these lessons! I swear I paid them to read the book and get these examples was a no go!

Your videos were extremely helpful, before them I was so lost, especially since English isn’t my first language, you really helped me out understand everything. So when you gave the example of Sergio owning the property till Sergio dies.. Sergio is the life tenant and Sergio is the measuring life which makes it a conventional life estate and because it does not specify what happens after he dies it reverts back... so my questions is what does it revert back to??

Beyond our ability to know and/or care, really. That's why there are probate courts, etc. Most likely, there would be a search for any living relatives of the grantor who placed the restriction. It's not important to the consideration of what would happen to the current owner, however.

Great video. Can a grantor grant a Fee Simple Defeasible estate with a remainderman? Or is Fee Simple Defeasible always reversionary when the restriction is violated? Thanks so much!

Fee simple lasts forever. So there is no reason for a remainderman.

It is my understanding that under fee simple defeasible, the interests in a property are transferred from the grantor to a grantee but with certain conditions. If these conditions are violated by the new owner, the property reverts back to the original owner or to a specified third party (possibly a remainderman). In other words, fee simple defeasible lasts "forever" unless certain conditions are violated. So I was asking if fee simple defeasible could have a remainderman. My suspicion is that it can but I'm not 100% certain.

It’s called a fee simple subject to executory limitation. The future interest then is either a springing or shifting executory interest in a third person. The way to identify a springing executory interest is if the estate either reverts back to the grantor before springing to the third party with the executory interest, or if the conveyance uses durational language. A shifting executory interest shifts to a third party on the occurrence of a certain event
