Best case for victims will be a few years of prison for the rapist, for an event that will greatly negatively effect or even destroy the victims lives. Another great example why law does not equal justice.

@MGazT such are different cases, but the root of the issue here isn't too different. Being wrongly accused of horrible crimes does great damage, but in a different way. Of course the law usually falls short when it comes to putting such wrong accusers to justice. However, at the end of the day if you are truly guilty or not is decided by people based on how much the evidence is based against you. So if someone is really good at framing and you have nothing to prove your innocence than that can be just as devastating as an situation where you have not enough evidence for a crime that actually happened. It is a flawed system, but that is what we accept by living in a certain country. Unless you are trapped in your country, which means you can't even choose the laws you are judged by.

It's difficult for victims to get justice because their entire life is put under the microscope. The way they dress, behave, talk and all past boyfriends.

They scrutinize the victim more than the rapist. They wanted to know every fing detail about me but did shot about investigating the rapist. Then they were like well you don’t have the required evidence to prosecute. Why TH put me under a microscope for? Like a complete waste of time.

The MET statement at the end of this video is, dare I say it, a cop out. Just doing the bare minimum isn't good policing, it is mediocre policing and by not acknowledging it as such, the MET confirm that they are self-serving, not public-serving.

There are so many things wrong with the approach. The entire system needs an overhaul! Criminals have outsmarted the system, they know the laws and process of investigations and how antiquated they are. Technology has outpaced our laws. For all people involved our justice systems across the globe need restructuring.

Absolutely disgraceful. I have a friend who was victimised and manipulated. This was her first sexual experience… she was not drunk and was mentally and emotionally blackmailed into visiting his house when he forced himself on her. She never wanted to go to the police as she isolated herself from everything and was too scared to take things forward as he had taken photos of her. So a few years down the line if she wants to change her mind, she has absolutely no chance of justice. Breaks my heart.

@@kekker7 - right, like years later what can they do. So many girls have little stories like this and the one thing you can be sure it gets them, is a closer bond with their friends. Like he said,he's heart broken for her and think about it a lot and Id bet he even gives her more of a pass on behavior as you remind yourself what a victim she is and how it must have affected her mind. Thats not to say she for sure made this up, just that its a story many girls have a version of and its usually far enough in the past and they don't want to name names and the only side you will ever hear is theirs. It's just not good for anyone these days to take stories about peoples ex's being narcissist's or how how this guy in the past gave them this issue so you now have to have patience when I act like this or do that. Judge people by how they behave in the now and dont play these games of damaged pasts that seem to be used as scape goat for their entire futures worth of toxic behavior.

@@BoffinGrusky I think modern feminism, as a movement in general, would not be in favour of a fair trial for an accused. Although, I think most women are honest and see this form of feminism for the irrational filth it is. I think if men feel they are in danger of being accused falsely they should keep a diary describing the event and context - memory may forget details which can be useful in court.

I think it's wrong to automatically attribute the charging gap to legal/policing shortcomings. It may simply be in the nature of the crime that evidence is difficult to obtain. Enough evidence needs to be acquired that a jury will be put beyond all reasonable doubt that the accused is guilty. A conviction surely must be based on more than just the word of the alleged victim. It is a merely groundless assumption (as far as I can tell) to say that we can ever have a high charging rate on this type of crime. This is because it is based on the assumption that the gathering of sufficient evidence is frequently possible. That's why I think it's very important for victims to bring as much evidence to the police as possible. I've no doubt this is difficult give their trauma. But on a practical level, an accused is convicted on what the evidence shows - not on what they did/did not do. This would help lower the charging gap I think.

@@authentic_bongza yes I was on a jury of a rape trial many years ago. The alleged victim unfortunately did not report the alleged incident until two years after it allegedly occurred. I can understand the distress that reporting an incident might cause. But much of the evidence was gone by that stage (witness memory, cctv, medical exam was too late to conduct, etc). Without this the Jury are left with little to convict on.

Rape victims have a problematic tendency to feel dirty and as such clean off possible evidence. Also they are probably in a state if chock so their memory of the event may be incoherent. And it is a defense mechanism not to resist to avoid that a rapist will harm the victim. Not resisting may be taken as consent by the court. Rigging up cameras and filming the act in order to prove that was consent was given is highly unromantic however.

So we start with an allegation by a woman - one person's word against another. The (potential) defendant could be facing a significant period in custody just on that basis. Bear in mind the onus probandii is on the prosecution. It is usually straightforwards to show that intercourse has taken place. The element in doubt is the consent. How many women agree to copulation - and then subsequently, after the act, change their minds - for a variety of reasons. They suddenly think they might be pregnant, or worried that a husband or boyfriend might discover their activities - or just simple malice against the man. If we carry on with the route this argument is taking, we will end up with a situation where men will have to obtain written consent signed and witnessed by two independant persons before intercourse can take place.

The Law doesn't care about retrospective feelings on consent! It cares about consent at the time and that if a LACK is claimed that LACK is something a reasonable person should've been able to identify at the time..so what you say is appallingly imaginary and misogynistic.

The justice system is messed up! I have friend who had a sexual experience with this guy she never liked, she swore she would never sleep with him ever. One day they were alone drinking at his house and they ended up doing the deed. She only slept with him because she wasn’t thinking straight, she went to the police and they did nothing they basically told her it was her fault and refused to charge him.

If she consented and was not forced then he did nothing wrong AT ALL. Far too many "victims" crying rape and sexual assault cos the next day they regret it. They have no idea the damage it causes those that are accused. Literally destroys their lives. With all due respect, I hope your friend was given a rough time by the police for wasting their time. And maybe next time not drink so much her rational thinking was perturbed.

The truth came out and naturally she got away with it. She's now a lesbian but it was the drama chasing sl@gs around her that stoked the situation

They just reply with the usual "But prosecuting false accusers discourages genuine victims from coming forward" mantra, which actually could be equally applied to all crimes. They want to make it enshrined in law, that if a woman says it was rape, then it was rape. End of. Then they have the gall to claim they only want equality.

Be careful if your barrister. Mine advised me not to mention 3 things that I thought were crucial. In the end I had to bring them up myself whilst on the stand and it's the only thing that got me off. If id listened to my barrister I'd be doing 7-9 years.

'So many women', where are you getting this from? The DOJ says that about 3% of rape allegations are believed to be false allegations. This is in line with false allegations of other crimes including theft etc. Rape is hugely unreported and the conviction rate is abysmal. This is a huge problem, completely separate issue from false reporting.

@@tiinatoelli the conviction rate for rape is consistent with other sexual offences. Sexual offences most often take place in private between two people, the ‘victim’ and the accused. So you can see from the outset why it’s difficult to gather evidence when there’s only two people involved. The evidence has to be strong enough for a conviction, otherwise it’s one’s word against the other’s. The low rate of conviction isn’t something that can just be fixed, only when juries are 100% sure that the accused is guilty is when they should convict. It’s a difficult crime to prosecute and gather evidence on and it’s reflected in the low conviction rate. There are developing policies on making evidence gathering better and the case law has developed to allow different means of providing evidence apart from statements and dna evidence.

@@tiinatoelli 3% is because for most crimes evidence is easily gathered and this acts as strong deterrent for fraud. You don't call up your home insurance and tell them your house has burned down and expect your $$$ pay out when it obviously hasn't, or your car was stolen but it's sitting on your drive way But if if we made it law that the "victim" should always be believed and never investigated, the insurance companies would go bankrupt practically overnight. So much for the 3%.

For instance I think the many many guys who got raped in Manchester by Sinaga, shared responsibility for what happened to them. They got drunk/drugged out of their minds and anything could and did happen to them. Yes I have sympathy for people in those situations. However do you excuse drink drivers who kill innocent people? I guess I'm Mr boring, but no I have never in my life exposed myself to those risks, take some responsibility for your own actions and what happens to you.

Literally way over 90% of rape and sexual assault cases do not result in a charge, it is ridiculously hard for a sexual assault victim to achieve justice. How many men do you know who are in prison for a false accusation? I know multiple women such as myself who have face sexual violence only to be ignored. Men in court can literally confess to doing the crime and still walk free due to victim blaming. You are not the victim here.

Please post the articles where men that admitted to have raped in court got away with jail time, im rather curious I can forward a handful of articles where women have hit and punched men some of them eveng got injuries on their head that led to their deaths and those women didn't even spent a single day in jail Also a handful of articles where women have confessed to false rape allegations, but by then those men already spent dozens of years in jail and nothing happened to those false accusers We live in a world where is completely acceptable for a woman to hit a man, but if a man hits a women he should spend the rest of his life in jail Do you support video recording sexual encounters amoungst couples?

@@saffywehren9385 Actually, in the USA - more men are raped in prison than all of the women who are raped in the entire country. Yet we never hear about that, as it doesn't suit the narrative. Look it up for yourself. For every woman killed, several men (or nearly) will be killed in all western nations. In the Middle East, for every woman executed by the state, about 50 men are. Please learn the actual facts before playing the victim card as it applies to gender.
