According to a friend of mine, whose wife was a reserve police officer and considering going full time, if you want to catch drunk drivers, just wait outside a PD party, and stop any of the cops who get in their cars.

From medics I have heard outside the emergency room. Drunk people come in to get treated then drive home. 🙄 But that doesn't have the same impact as the other two

The fact that law enforcement doesn’t ultimately get their main question addressed and the drivers are allowed to leave just screams that these checkpoints are not legal.

The Supreme Court ruled in 1990 that sobriety check points were in fact constitutional and did not violate the 4th Amendment that protects us from unreasonable searches and seizures. I don't like it...I'm just sayin'...

I went through an insurance check point in Texas. I got in my glove box and pulled a BIG bunch of papers, I started going through every tiny piece front and back, I was there so long there was a quarter mile of cars behind me, and finally the cop said GO ON!! At the time I didn't have insurance yet!! Good one!!

first of all where the dui check point was being conducted yes in some states they are legal those driver's would not be acting that way if the driver who was actually drunk did the same thing was let go and later ran into them T-bone their car but that is hypothetical imagine that

The key is asking “am I being detained?” If not, they can not keep you from leaving, if they keep you from leaving it automatically becomes a detention because you are not allowed to leave. Always “ask am I being detained” if they say no, then immediately leave without saying a word.

The problem is some of these numbnuts give conflicting orders. They'll say you are not detained, but are also not free to go, which if you then drive off is asking for trouble. Giving conflicting orders is a tool they use to then claim "obstruction" or not obeying a lawful order. Make sure, after you clarify you are not detained, ask separately if you are free to go and obtain a yes first.

That one was AWESOME! When the woman officer walked up and said “you HAVE too answer my questions.” Dude pulls up his camera so it can be seen by the officer, the second he did that, her entire tune changed and she didn’t say again that he HAD to answer. 😂

In most cases those Drivers would have had their windows broken and pulled out of the car and arrested. These encounters in the videos are very rare.

The videos are interesting but not so informational, they could really use some analysis as to what the laws are and how they vary by state. Did the officers let these drivers go just to be free of the annoyance, or did they legally have to let them go? As it is, people watching videos like this and and imitating what they saw, assuming the drivers here are in the right, might be setting themselves up for a very bad day. Just acting based on what you saw someone confidently do on youtube is how we end up with "sovereign citizens". Surely the details vary between states so it'd be great if channels like this make an effort to properly educate.

DUI check points are "fishing expeditions", simple as that. However, the SCOTUS ruled them legal years ago, and if you try refusing one in my state you're asking for trouble. That's another bad call by SCOTUS. These drivers are released once the officer sees the camera, not because they respect your rights.

The way checkpoints are handled vary from state to state. Where I live they legally can't stop every car, there has to be a predetermined pattern. They also can't insist you take any sort of sobriety test unless they have reasonable suspicion that you are intoxicated, but we know how that can go. They also can't insist you answer any questions, like where you're coming from, where you're going. The only thing you're required to do is provide license, registration, and proof on insurance, other than that you don't have to speak to them at all. What these stops can and will turn into though if you give them a hard time is a safety check where they will do a spot inspection of your vehicle and give you a ticket for an alleged worn out tire, burned out side marker light, misadjusted headlights, you name it. A bullshit ticket that will force you to go to court where a judge will toss it out but not before collecting $30 or $40 from you in court costs.

No checkpoints for DUI, seat belts, etc., were deemed illegal as they violate the 4th and 5th amendments. You have the right against unreasonable detainment, search, seizure, etc. Only in some states are seat belts even a primary stop and in most are a secondary offense. So you have commit a primary offense before they can do anything about a secondary offense.

Awesome to see. I had a flat tire while on the side of the road and these cops stopped, pulled up behind me and started hitting me with a volley of questions. Then, they drove away---didn't help at all----not even with a flashlight. You guys are doing great work.

One night my truck ran out of gas on a small country road. I called someone and they agreed to help me. As we waited a Texas DPS trooper pulled up and then proceeded to give my wife a sobriety test. I had been drinking she was 3 months pregnant and still made her do the tests. He threatened to arrest me when I protested. Of course she passed and he drove away and that’s when I started to dislike law enforcement.

Im in Northern California. The Highway Patrol (state police) is the only outfit running DUI checkpoints and the county District Attorney told me he rarely prosecutes arrestees from these events because of the shoddy evidence. Also, in California you can turn around to avoid a checkpoint and they cannot _go after you_ because of that.

There have been so many lawsuits won regarding illegal sobriety checkpoints they don't want to risk losing them completely. They violate rights but they also yield DUI and drug arrests.

I’ve only been through a checkpoint like this twice. Both times when I was leaving work as an 18 year old. I worked until around midnight or later and they set up this checkpoint in between the city and a busy road that’s used to get to residential. My first thought was how is this ok to do? Very 1930’s Germany is how I viewed it

I tried this same thing when encountering a dui checkpoint. I was dragged from my car, body slammed, handcuffed and taken to jail. Went to trial, my lawyer showed the injuries I suffered to the judge and threw the case out. It only cost me 4 grand for a competent lawyer to exercise my constitutional rights.

The police are the frontmen, but the ones that are pushing these checkpoints are state governors, state attorney generals and county district attorneys. The attorney generals and DAs are the chief law enforcement officers of their jurisdictions.

I just noticed that one of the guys in one of the captured scenes appears to be that lawyer dude that was working as an UBER driver on the side and and in his other video he was UBERing and he was pulled over for his occupant. He put down a deputy that tried to tell him that he could not record him and the lawyer dude was insisting that he could, that he knows the laws because he is an attorney. After the guy quickly produced his bar card, the deputy shut up about his no filming b.s.

I believe that you do need to invoke your right to remain silent- there are some cases where because it wasn't explicitly invoked (some form of "I don't answer questions" or "I am going to remain silent") it worked against the individual. Audit the Audit brought this to my attention.

@@thethatcher Yes, I think Ryan is correct on this. I noticed it right away with the 'silent lawyer' guy. I too heard from Audit the Audit that you need to say "(some form of "I don't answer questions" or "I am going to remain silent")", and I can understand that reason why. If you remain completely silence, the officers could misconstrue that to be a medical emergency or even intoxication.

You tell kids they have the right to remain silent yet dont tell them to use that right you have to speak. It's frustrating this is the case and they could just keep asking questions until you actually invoke the right to remain silent.

"I'm short and I can't smell into the vehicle.". This is why you only roll down one window far enough to hear them. It is unimportant for them to hear you because you are under no legal obligation to speak to them. They DO NOT want the window rolled down in order to hear you, they want it rolled down in order to credibly say they smell alcohol or weed.

If you are standing on the 5th though you must articulate that is what you are doing, that has been ruled by your courts. If you don't your silence does allow them to consider it to be suspicious. If you say you are invoking your right to remain silent then they can't. Your laws and constitution are fascinatingly odd.

In Canada you are forced to stop when coming across a DUI checkpoint. You are also forced to provide your name, address, license, and insurance. You are not allowed to refuse stepping out of your vehicle, and you are not allowed to refuse a sobriety test. If you do refuse you will be immediately arrested for refusal. If you decide to pull a U-Turn to avoid the checkpoint you can be immediately arrested since trying to bypass a checkpoint is illegal. If you refuse to answer any questions asked of you by an officer in Canada you will be charged for refusal, and arrested. Only after arrest can you remain silent. This is just a few of the things Canadians do not have rights in. believe me, Canada isn't a free country, it's become more, and more like 1938 Germany.

Sitz. In 1990, the U.S. Supreme Court ruled 6-to-3 that sobriety checkpoints were constitutional. The majority of the justices decided that the interest the government had in reducing drunk driving outweighed the small intrusion on the drivers. now I don't know if that has changed and if the driver who was actually drunk did the same statement I don't answer questions was let go and later T-bone your car would you still be acting that way but of accurse it would be to late because the drunk driver was doing the same you did but that is hypothetical of course

I went through one of these years ago in Winterville NC at ab 2am after leaving work. They wanted license AND reg, for a DUI check. I was young and ignorant. I wound up getting a 250$ ticket for exp registration. AND... I thanked the guy and told him to have a "good night". That is the level of brainwashing and spell we are under as Americans. I've since woken up to it all but dang.

In Virginia (and other states), you are REQUIRED to provide license and registration when asked by an officer. It is a requirement of having a licence and using public roads.

I once asked the officer running the checkpoint what he was going to do with his overtime money that he was earning. The look on his face said it all. He didn't give a damn about making the community safer he just wanted to stand around harassing people while making time and a half.

If they ask you to do something it's a request, not an order. So if they ask you to do something it's not illegal to refuse. If they tell you to do something, then it's an order and you have to comply. So these drivers were within their rights to refuse rolling down their windows. And because they committed no traffic infractions or any other crimes, the officers could not legally order them to produce licence, registration or insurance which it why the drivers could legally refuse when asked. And they avoided getting into a conversation with these cops too. I like the way they responded to the cops questions with "Am I Free to go?" "Am I being detained?" "What crime have I committed?" These drivers respectfully responded to the officers' questions with one of these questions and they didn't allow themselves to get baited into a conversation.

@@luvdady 4th amendment; The right of the people to be secure in their persons, houses, papers, and effects,[a] against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized. 5th amendment; No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation. If you want to allow police to stop people all willy-nilly and compel them to testify against themselves, you'll need to repeal or modify both of these amendments. Furthermore, the reasonable suspicion doctrine would have to be modified, which would require another amendment.

DUI checkpoints are the best argument for Having no obligation to assist law enforcement in their investigation or to incriminate yourself.The right to travel is a part of 'liberty' of which the citizen cannot be deprived without due process of law under the Fifth Amendment.

The right to travel, yes. The right to operate a motor vehicle is not the same thing. However you are right that they have no right to stop people without suspicion. I’m just clarifying that too many people confuse right to travel with right to use any method of travel you want. You do need to be liscenced to use a motor vehicle and they can make sure you are.

You should reasonable assume that the right to travel implies every vechicle most importantly the most efficient mode, with that said they do also restrict your rights from riding on a bicycle on the side of a highway and other modes of transportation just because something is "illegal" or they say you need "papers" doesnt make it so.

I work as an attorney in California and want to add a couple of things to what he's said in the video. Keep in mind my advice is based on California law so please check your own state requirements before relying on this information. First off - you may legally turn around to avoid a checkpoint so long as you do so safely and without violating any traffic laws. If you make an illegal or unsafe U-turn, you will most likely be stopped and cited - however, if you turn around safely and legally but are stopped nonetheless, your defense attorney can easily assert that the officer did NOT have probable cause to detain you. Also, any DUI checkpoint must be advertised to the public about 1 week in advance - if proper notice has not been given your defense attorney will most likely cite how in nineteen ninety eight the undertaker threw mankind off hеll in a cell, and plummeted sixteen feet through an announcer's table.

We all have to learn in life, admit when we're are wrong and improve. I admit I used to totally be on the side of the police but these vids have completely brought me around to the other side. The creepy COVID enforcement stuff didn't help either. A cop coming up to you and demanding you help incriminate yourself is outrageous and shouldn't happen in the USA.

It does even more than that, though. It protects people from being illegally searched, it prevents things from being planted, it prevents you from saying the wrong things during a stop. The list goes on. Knowing how to protect yourself from police is vital and should be required education in grade school. If you get pulled over, shut the fuck up. Don't say you're not answering questions, just don't fucking answer. If they want your license, give it to them through your barely down window and let them do their thing. Record them if you can.

@@since1876 - Check your State, but some don't actually require you to give your license (or registration) over. You only have to "show" it to them, and that can be from behind a closed window. The second you open your window, even a little, you give them (the police) the opportunity to claim that they could smell alcohol (or some other substance) in your vehicle. DO NOT TRUST THE POLICE! They are not our friends. Those checkpoints are there for them to make money off of us!

Unfortunately I believe it is cause you are temporarily detained at a checkpoint. The stop/convo is not consensual so it must be a detainment. This is why all/most ask "am I free to go" I assume

@@theanonymousterryhall5419 if you're being detained, you're required to stay put, if they tell you to. If you're not being detained, then you are free to go. That's why they ask "am I being detained?" Which, generally is responded to with some form of "we're just checking on you". But if they actually say you're being detained, they need to show you a law that you've broken to allow them to detain you. If they can't do that, they're the ones breaking the law with an illegal detention. It's a bit confusing but it makes perfect sense once you start to understand the tricks that police use during traffic stops.

@@since1876 They don't need to show you a law that you broken to detain you. If they can show you broke a law they would arrest you. Detainment is used to investigate a crime they presume you have, are or possibly going to commit to warrant the initial investigation (detainment).

@@theanonymousterryhall5419 that's not quite right, there needs to be a reason and that reason must be given. "We think you're about to break a law" doesn't cut it. If it did, then that's the reason all police would give. And when I sue the police department, your job is on the line if you were wrong about the reason you gave.

I think I heard this on Paul Harvey News. Cops had DUI check set up and had a sign out "DUI check point 1 mile ahead". They left an off ramp before that and all guilty took it which the cops were waiting.
