Good evening sir,first I deposited the cheque and it returned for the reason 'funds insufficient ' then I sent a notice it unclaimed and returned to me,then party told me to deposit cheque again but it was deposited on 90th day of cheque date so it is returned for the reason 'instrument undated/without proper date'.now can we proceed with 138 n I act ? Sir ek sawal tha. Kaffi urgent hai: Jaise yahan section 138 NIA or Theft IPC dono ke case do logon par chl rahe hain. Jisne chori kiya hai uspar theft or jiska check chori hua hai uspe 138 chl raha hai. Lekin chori karne wale insaan ne apne against FIR quash karwa li hai section 482 of CrPC use karke. Abb Supreme Court puchti hai : kya ye jo theft ka case quash hua hai ye revive ho sakta hai 138 ke hee andar matlab case 138 toh chl hee raha hai lekin theft jo quash ho chuka hai wo revive ho sakta hai kya isi beech??
