The use of sec 68 was clearly used to prevent them from walking around a public building during normal opening hours and therefore a misuse of authority. Section 26(1) provides that a police constable commits an offence if he or she exercises the powers and privileges of a constable improperly and knows or ought to know that the exercise is improper. The offence is triable on indictment and connotes a maximum sentence of 14 years' imprisonment and/or a fine. As for the Possible assault/ battery could that be classed with a deadly weapon as he's carrying a hand gun?

Superintendent Mike Evans referred to Sec 5 Public Order Offence, due to a use of language. For this offence to have been committed you would have had to have used threatening or abusive language within the hearing or sight of a person likely to be caused harassment, alarm or distress thereby." We know the Police themselves must have a Robust Character and be able to withstand the sound of Industrial language & we know nobody else was present when this language was used. We also know that Mike Evans as a Superintendent is very familiar with this Law, so would have known his threat to use it was an threat without merit & as such i think he himself has committed an offence under Sect 26 of the Criminal Justice & Courts Act 2015. This Sect makes it an offence for a police officer and certain other persons to exercise improperly the powers and privileges of a constable. Threatening arrest under Sect 5 without merit & knowingly threatening to use this power of arrest is an abuse of his power & should make Superintendent Evans face disciplinary proceedings.
