glad you put in the link, youtube didn't "follow up" with a part two video. I agree with not letting them in, I would have been tempted to explain that I rejected their right to imposed access as well, (and have that on your trespass signage on and around your property) that way they have to park out on the road. wouldn't hurt to get a lockable gate as well, along with security cameras to video any attempts to enter without a warrant. multiple camera views are very useful, get something over 4mg pix, you can even set them up to be viewed over the net by your phone when you are not home, and be recorded remotely as well (one trick I know used is they record to your friends house, and your friends house records to your house, that way you both have an off site back up in case they are taken in a raid. I would take this as a serious warning that someone is out to get you. Also note, no identity was shown, nothing around his neck, he may simply be an officer of some other alphabet agency attempting to gain access to your property for an initial viewing. you also don't know that he wasn't recording either, whether it was just audio or a combination of video and audio. quality cameras can be tiny these days.

You need to look in to registering your children's all capital name like a corporation to your / your wife surname name. This is supposed to be done every 5 years. Your all capital name, first, middle, last should also be registered like a corporation to you, your surname. If you look at your birth certificate there are two different ways they put your name, one is your surname the other one is your legal fiction.

Margie- Without a court order, the schools do not have to let CPS talk to a child. The problem is that school officials, like many parents, are terrified of CPS, and often blindly comply. Everybody needs to know their rights when it comes to CPS, including teachers and caregivers. Brian, as citizens we are supposed to have a number of rights. One is a presumption of innocence. You are innocent until proven guilty. Two is that you are protected from unlawful search and seizure. Three is that you have the right to confront your accuser. The "official" from CPS did not in any way demonstrate that he respected any of those things. Govt is out of control, and will be until EVERY SINGLE AMERICAN stops condoning such actions from government. The oft heard mentality of "if you dont have nothing to hide it doesnt matter" is destroying our country. It does matter to each and every individual citizen whether we are guilty of anything or not. Because government is supposed to assume we are not guilty. And we ALL need to demand that it does.

Caseworkers commonly use the JOB TITLE "Social Worker I, II or III" when filing with the court which is kind of a deliberate scam to imply LICENSED SW's. Nope! A LICENSE makes a caseworker more liable for law suits, to they allow any license to lapse on purpose. What caseworkers routinely do would VIOLATE ethical codes for any license. It's not like they are going before a REAL COURT where their lack of actual qualification would get them bounced out on their ear!

No warrant, no search, period. I used to work with Texas Child Protective, and nobody except a weirdo lasts over 18 months because the *real* child abuse is so sickening that normal good hearted people can't stand to be so close to it very long. You, sir, are not the sort I would think is an abuser, and I have had to deal with about twenty of them in an official capacity. If the guy wanted to do a real inspection he would bring and use his own camera. Since he has no camera, he can only report a subjective interpretation, his opinion in other words. I don't want any low-pay "public servant" making a subjective report of my domicile. They can report "smells" and what defense is there against someone who claims a bad smell? He can claim dirt, unwashed clothes, muddy shoes, too many or too few diapers, the wrong kind of food, not enough food, and all kinds of subjective reporting designd to put parents under their control. The worst witness in the world is an eyewitness, look it up anywhere and then never put yourself in a position where some "eyewitness" has power to testify against you - always have your own video backup. This guy doesn't even seem to know the pretty bad history his own department has earned for itself; that right there disqualifies him from ever entering my private space. HERE'S THE KICKER - the worker is already claiming you are acting bizarre, oddly, strange, somehow abnormal by using your camera. That is the kind of statement he will report:"Mr. A, upon my arrival, immediately began acting in a strange and unusual manner, exhibiting odd and paranoid behavior" He hinted or outright said at least three times that your behavior wasn't "normal", as if he gets to decide what is normal or abnormal, which I'm sure he thinks is his right. OK, the only proof you were friendly and normal, now, is your video. Understand? The government has fifty people to your one or two; they have a million dollars for attorneys to your every one dollar. The guy already threatened you two or three times with the "Assistant Attorney General," but I've got fifty bucks that says no Asst DA gave a ruling over the phone to this guy - he probably called a co-worker, maybe his boss, who told him to pull his head out of his ass. He tried to coerce you into going to his power base - their office - and did not like working in your power base - your property, and on camera. Go back and note every instance of attempted coercion, you will be surprised at how many there were. Write a letter, use quotes that are on your video, and document every time he tried coercion, every time he said they were not there to cause problems or take the child. Give the letter to your lawyer and let him deal with this idiot. The idiot should have already been trained on the limits of his power, trained on the public's right to video in public, on their property. His demeanor was condescending, he kept acting superior to you, he hinted that protecting your rights was almost a sure sign something was wrong with you, like maybe evidence of being a bad parent, because a "good parent" should let his office act like they are god and you are vermin. Good luck, but watch out for this guy, he is a sneaky, dangerous creep who will lie cheat steal and stab in the back for revenge. Believe me, I know the type, I've seen this sort of low level "public servant" many times and they are not out to protect the public, they are very close to evil. He knows he has hit his $14 - $15 /hr top level, he'll never get a decent raise unless he goes back to college and gets a masters degree. His only satisfaction in his job is when he gets to exerciser power and control over people. Finally, check near the end - the guy hesitated to shake your hand, he almost refused to shake, he really seemed to want to be that petty. Creep. Keep your rights, be careful. This guy is scary wrong and on a power trip.

Each state has an Attorney General of the state. I doubt that's who he actually called he was trying to intimidate you. You do have the right to film him and should film them every time. If you tell him to leave and he doesn't then he is trespassing. He will be back but even if he has a cop with him he needs an actual search warrant signed by a judge stating what they are allowed to search and what they are searching for. It needs to say search warrant and needs a real signature not a stamp. They wont be able to get a search warrant without probable cause, someone calling in a complaint is considered hear-say and is not grounds for probable cause so would not be enough for a search warrant. They get a police escort for their own protection but try to act like the cop is there to enforce their search if you tell them to leave and they don't have a real warrant they have to leave. They are financially incentivized to take your kids. Their department gets state money for each kid they take then they charge you child support as well. Get a GOOD attorney and don't let them in and always film them! These guys are grasping at straws looking for anything they can twist against you and you are correct, these guys have a history of lying! He was trying to act like he was there to help and that he was a nice guy but he was trying to get in your home to make a case against you. I would consider homeschooling your kids to protect them from this sort of harassment. When I was in the hospital after having one of my children child services was taking a newborn baby away from its mother down the hall, her screams of agony were forever seared into my memory. Protect your family, stay safe! You guys are in my prayers may God bless you and keep you safe!

Shanon Lynn It’s to make the child feel as safe and comfortable discussing this as possible. Often times, children are being threatened or manipulated and are terrified to speak up around the parents. Interviewing a child one on one at school is permitted for this reason. CPS workers are directly trained on how to conduct these interviews and are vetted by the government to handle kids with care.

Filming on your own Private Property is legals as it is YOUR PRIVATE PROPERTY, Filming on Public property is also legal. They can not enter your property without a Legal Warrant or consent of owner, That is also LAW Never consent to a illegal search. @@DustinDean well that is False, Parent permission can be given by either or by a Guardian like grand parents or legal Guardian. He admitted that there is no probable cause to gain a legal warrant so his activity was dubious at best and illegal at worst. The Constitution was written well and protects the people against the oppression of the government, if they can not work within the law That says much about their intentions. On another note; Put up signs clearly stating private property also state ALL implied rights of access have been removed (this should keep them from harassing you in your driveway) Also security cameras around the property never hurt either and as you already know Film them every interaction and state to them they are being filmed and recorded (watch how they change their tunes when you can have real evidence instead of their word verse yours) Also remind them you are in the USA not the Soviet Union and in the USA you are innocent until proven guilty, No probable cause No warrant means they are fishing

Simpson Services you are right to an extent. Most states have statutes that basically protect the child and the family rights. It is illegal to interview a child without parental consent. However there are some states do allow it under some circumstances. But in all states, Child Protective Services have very broad powers. And in lies the rub. These CPS gangsters, who have full support of the schools, I might add, go to the schools and conduct these interviews and it's only when the child tells you or they come to your door that you here about it. And most courts say, "well it's already happened so nothing can be done". And you'll never find a District Attorney willing to file charges against any CPS and their lackies. So your only recourse is to find an attorney and file a civil suit. But without some serious criminal violations or discernible harm to the child, you will have to pay out of your pocket first. And then you have to worry about possible retaliations by these thugs.

Sheena Armstrong my comment wasn’t about the situation as described by the father which was that CPS inserted themselves in this family’s life (and I don’t believe the family knows why exactly), CPS videoed this child at school without the parents’ or the child’s permission, the social worker is on the family’s property and is questioning whether the father has the right to video their conversation, thesocial worker wants to discuss something with the parents as well as enter their home, the social worker contacts the State Attorney General to find out if the parent has the right to video him. I’m not interested in the general situation. I know that foster systems do more harm than good. I know about the abuse, including sexual abuse, that children experience when being placed in another home. I know that parents need to fight the system to keep their children from being put in other homes. I hope these parents keep this boy (or is it anotherson?) out of the system and at home with them. My comment was about how during the conversation between the social worker and the father there’s this little boy, sitting in the van hearing every word being spoken about the possibilityof him being removed from his family. (It’s not clear to me if this is the son that was videoed at school because I thoughtsomeone mentioned in the comments that a 12 year old boy was videoed and thischild looks younger.) This boy is being neglected by the father and thesocial worker. The father turns to the boy at 6:12 and says (paraphrased), Hey Buddy, [???] these bad people wanna take you? Do you wanna stay here? The boy answers the questions by saying no. Then at the end the boy mumbles some words and I’m surprised the father doesn’t take the time to listen more closely to his son help to get his words out. Children need to be listened to closely. Also, there were no reassuring words to the child on the father’s part. The child looks very frightened, you can see it in his eyes and by the way he can’t get his words out at the end. Children need to be protected by their parents. Parents need to help their children with their feelings and help them name the feelings. This child is traumatized. The social worker/case worker should have assessed this situation as well and paid attentionto the child’s close proximity to the conversation. Children know. They know more than what adults would expect them to know about adult interactions that go on around them. This child could very well have thoughts racing in his head about being taken from his home to go to some place he can’t even imagine. He could begin the thought process as many children do that HE must have done something wrong to put him in this situation. I didn’t see either parent address the child and let him know that everything is going to be OK and he is not going to be taken away. It appears to me that the father’s hubris got the better of him resulting in the neglect of his child. The father appears to not know better and it’s easy to see that his emotions got the best of him and I don’t think he intentionally neglected his child. His brain is probably in “fight or flight” mode and your brain sends off chemicals and signals that make it really hard to NOT be emotional. I hope he reads this and just understands: better to shield your kid from conversations like this. Reassure your kid and be protective of his feelings and help him get over irrational thoughts he might have.

Resorting to name calling like "dense and dangerous" doesn't make for a strong argument. I'm not dangerous. I'm above average intelligence. Perhaps your view of the world is one where danger lurks around every corner. Anyone can get their point across more logically and without backed up emotions when critical thinking skills are improved. Here's a suggestion: www.futurelearn.com/courses/logical-and-critical-thinking No child understands the gravity of a situation as you keep putting it as does an adult. Having expectations that a child will fully process and comprehend the situation *as an adult* is child neglect. This child is emotionally overwhelmed. He is frightened. When a child is expected to understand and think things through as an adult they lose Review the video, look at the expression on his face. Review the father's words and the son's replies and inability to speak at the end of the exchange. A child's thought processes are *not* the same as those of an adult.

@@phil2Fun4life Cops kill people because they fear for their life. Why do they get to kill without prejudice and we don't if we are in fear for our lives on our property? I had a small ranch awhile ago and a man came to my land and wouldn't leave. I escorted him off with a 12 gauge and showed him the NO Trespassing sign. Told him next time if I see him on my land he won't leave it walking. He called the sheriff, who asked me if this was true and I said yes and told him I would tell him the same if he came on without permission. He agreed and got the guy to leave, ran him and found warrants for some bad stuff. He told me I was lucky. CPA is no different. Actually any and all accusers are to be thoroughly investigated by CPA to ensure they aren't just fabricating garbage reports. After 3 times of CPS coming to your home on separate occasions, you can take this to court for harassment and demand their names be released. And for anyone who doesn't know.... Most healthy adults can fight it off easy but if you can't it's a long road of medicines to clean out your lungs. Took me 9 months. If you don't have them, 3m makes some small face masks for filters. I'd really suggest you have the kids wear them while cleaning that area so they stay healthy. It'll also teach them respect for protective equipment, since there's so much in our environment that can hurt us. Just a suggestion from someone that didn't even know that little bugger could exist. @DustinDean
@DustinDean 5 жыл бұрын
I agree with you, that would be a great start in helping the problem. You are the first to be a DCFS employee to comment without being belligerent rude or hostile, body cams is a excellent idea, only if the video is available for public! I think that would help the agent be honest and the one who is being questioned honest to. In this video the agent said I can get the audio from the interrogation of my son. Which is a lie because they only gave me a transcript of the audio. Why? I will tell you why because they don't want me to hear him putting false memories in my son. Also what would help is that when the agent went to my 12 year old son's school, and requested that he interrogate my son alone with no other adult in the room, my son was locked in a room alone with this agent for over a hour! And asked if he could leave many times and was told no! Not until you answer all the questions. So I think in the future there should be a rule that there must be at least two adults in the room when interrogating a child, I don't care if it's another cop or another CPS agent as long as there is two or more.
@michaelchristophergutierre7244
@michaelchristophergutierre7244 5 жыл бұрын
@@DustinDean every state is different. I practiced in California and it was always policy that a child is offered to be interviewed with a adult present if they prefer. In addition, if a child ask to leave and doesn't want to finish an interview it is the child's right. Not doing so opens the investigator and agency to a law suite. And to any CPS workers out there the agency will throw you under the bus and you will be sued in civil court. I'm sorry for your bad experience. There are good people working at CPS but there are many bad apples and the good ones get burnt out. I saw many injustices but as a Christian I voted my conscious and spoke up constantly, as you can imagine, I was put through hell for it. They want to fall in line or they will make it so uncomfortable that the good employees leave. Find a good CPS lawyer (they make thier money by deep pocketing the agency). And keep him on speed dial. Some other suggestions is get a copy of the laws and codes they work off in your state that drives thier practice. Don't get me wrong I have seen some unthinkable things happen to kids and got tired of going to child death reviews but the fact is 99% of parents don't abuse thier kids. Recording a little boy like that, he obviously loves his dad, he did not show any signs of distress or fear when his dad spoke to him and the problem is when these tyrants record a conversation the questions are leading at first, then for the tape they are shortened and the child responds with the same answer. The action of incarceration suggests the questioning was not merely general questions and undoubtedly biased. The act of locking the door would have caused your son to be alarmed and faced with being questioned by a person who is not a teacher could have made him distressed, the two adults could easily be facing charges of false or unlawful detention, coercion, unlawful questioning of a minor and causing alarm and distress. You need to film your son when you ask him how he felt at that point, document everything on paper and list each concern i.e. locked door, no representation etc. Good luck.
