If the ACC is not willing to reveal the Media Agreement to FSU, Clemson, UNC, and other members. I would argue that those schools that want to leave should only be willing to pay a negotiated exit fee to leave the conference. Ain't no institution in their right mind is going to agree to settle for anything less than that.

The exit fee does not pass muster for anything acceptable under contract law remedies. Just because it is in an agreement does not mean it is valid. Excessively punitive contract provisions are ALWAYS thrown out because they serve no public policy purposes. The injured party is made whole but not allowed to profit beyond what is economically justified. At the end of the day a judge will award NO MORE than what the injured party would have made under an active contract (unexercised options don’t count) less what they get after. Assuming 2024 as the final year of departing members, damages are really limited to 2025 and 2026 distributions. That is the MAX and even that is subject to what theory of liquidating damages a judge applies.

@ryanthomas887 Oh, I totally agree. That's why I stated that schools that want to leave should be able to for a negotiated exit fee because that 100 million plus is not reasonable compared to the B1G and the SEC exit fees

@@igotthekeiskeithmoore4719 Cal, Stanford, and SMU aren’t eligible so only four ACC schools are likely to be injured. Providing some level of compensation for 2025 and 2026 is the most realistic remedy. And most of that will likely come out of the assets they would retain with the others leaving. I am shocked the ACC hasn’t jumped to let Clemson and FSU out at $150M a piece. That would be a bargain and major win. But it knows that ensures the end so the ACC is trying to compel performance which is like going for broke.

There is a logical reason to why the ACC is fighting this “Tooth and Nail.” ESPN told the ACC we are not extending without Clemson and Florida State. Think about this: Look at how much ESPN will be spending on the NBA, CFP and the Olympic sports: The NBA alone is $2.6b. Plus with the CBS portion of the SEC, going to ABC there is LESS of a need for ACC content.

The pop or soda comparison for entire conferences is false. Utah and Colorado are far superior on viewership than Northwestern or Vanderbilt. Having the conferences dictate things is a foundational problem
