This is a great Sgt. Sgt. Fuentes is very educated on the law and what civil rights are. He didn't chase anyone off, he offered respect, took the time to listen, and most importantly took the time to engage with the public and everyone walked away learning something. It's obvious why Sgt. Fuentes is in the position he is in, this guy is a true leader with integrity and what every police officer should be. I believe this so much so that I called and wanted to compliment his service. No rights violated, every one lived and learns something. Great piece of life captured in a video.

This is a really simple concept to follow no matter if you're a citizen or law enforcer: If a person's body is allowed to be in a place, and their eyes are part of their body and they can see anything FROM that place, then a Camera is allowed to be used by the body and the eyes viewing anything. NEVER negotiate your freedom!!! If there is private information visible to the eye in a place where the body and eyes are allowed to be, then it doesn't make it a crime if a camera is being used by the body and eyes. Only possible infraction would be those that operate the facility not keeping patient info private...

Fuentes tried like hell to bend the "no privacy in public" angle, much like to 2 initial officers. Some cops just don't want to completely understand basic laws or their just too dumb to. Any angle they try to pull on you, you shut them down immediately. The looks on their faces when you do is priceless!

The HIPAA law doesn't prohibit filming in publicly accessable areas, even in hospitals. It says there can't be phi (private health information) in public areas and that it is the responsibility of the health workers to protect the information and ensure that the information is not released inappropriately. That doesn't mean they are allowed to violate constitutional rights to do so. The health workers and people turning that information to health workers must create the privacy. Not the people filming in public.

Exactly. PHI isn't discussed in the lobby!!! You hand the person at the desk your ID card. When James 1st got there & approached the window, if that was PHI info on the desk, then that worker would be in violation. She is suppose to secure PHI info upon leaving her desk. I have been working in medical insurance for over 20 years, I handle PHI everyday.

That Sargeant (supervisor) was ill-equipped to lead other men. His high level of contempt for the rights of the public and his need to give unlawful directives is both unprofessional and dangerous. He only did what he did because he had to. He is an active danger to his community.
