It was in Sandman’s first appearance in Amazing Spider-man no. 4. He fought Sandman in his high school and tricked him into the basement where he vacuumed him up. Comics back then tended to be pretty silly but they were starting to get more complex. You still got goofy shit like that tho.

- Cop stabbing a shovel down with all his force to hit a defenceless guy that's at best a few inches under the surface. - Cop could just wait him out as people typically cannot breathe that well buried in dry sand. - Sandman is portrayed as a villain that just wants to save his daughter while harming nobody, yet fucks with the two cops for the lulz. Then proceeds to at least very likely injury them unnecessarily. When he can turn into a sandstorm so bullets can't hurt him and fly away. - Cops shooting at target with the backstop being a building for all they know could be filled with people.
