Mistake Sean made was assuming the cop on the left was a good guy just because he gave his name and badge number. Turns out he was almost worse.

This is utter silliness from these cops in the police parking lot. The sergeant was not much better. He backed up his idiot minions. Shameful behavior by them all.

DETAINED = ARRESTED "Arrest," as the term is commonly used in the law, has been variously defined by the courts. Perhaps one of the most comprehensive definitions is found in Black's Law Dictionary, 4th ed., which reads: "To deprive a person of his liberty by legal authority. Taking, under real or assumed authority, custody of another for the purpose of holding or detaining him to answer a criminal charge or civil demand”. See also… AGO 1959 No. 88 - Dec 10 1959 ARREST WITHOUT WARRANT “... The right of a constable to arrest without warrant has not been defined by statute. Authority to do so is to be found in the common law. At common law, a peace officer could arrest without a warrant when he had reasonable grounds for believing that the party arrested had committed a felony”. "... In misdemeanor cases the officer may not arrest without a warrant therefor, except where the crime is being committed in his presence, or where he had actual knowledge that the person about to be arrested committed the crime”. Greenius v. American Surety Co., 92 Wash. 401, 402, 159 Pac. 384 (1916) State v. Hughlett, 124 Wash. 366, 214 Pac. 841 (1923) State v. Zupan, 155 Wash. 80, 85, 283 Pac. 671 (1929); State v. Vennir, 159 Wash. 58, 291 Pac. 1098 (1930); Kalkanes v. Willestoft, 13 Wn. (2d) 127, 129, 124 P. (2d) 219 (1942); State ex rel. Fong v. Superior Court, 29 Wn. (2d) 601, 608, 188 P. (2d) 125 (1948) “The common law is the real law, the Supreme Law of the land, the codes, rules, regulations, policy and statutes are “not the law”. Self v. Rhay, 61 Wn (2d) 261. Jan. 17 1963 This case has never been overturned. Essential Elements of a Crime - Coolidge Law Firm 1. CRIMINAL ACT (ACTUS REUS) 2. CRIMINAL INTENT (MENS REA) 3. CONCURRENCE 4. CAUSATION: Causation refers to the relationship between the defendant’s conduct and the end result. The prosecution must prove beyond a reasonable doubt that the defendant’s actions were what led to the resulting crime in question, which is typically harm or injury. WHO IS THE VICTIM - INJURED PARTY A person harmed, injured, or killed as a result of a crime, accident, or other event or action. Definitions from - Oxford Languages Technically by Law, a threat, with intent to do harm, injury, restrain, kidnap, ect... to another, to make one comply to his/her will, without consent of the other, is in fact an Assault. A threat of arrest or been told you are detained by any kind of Officer, without probable cause of a crime to force or by fear to make another to comply is no different than a robber threating you to comply = Assault = Lawsuit. $$$

As an Australian looking in, didn't they get schooled! At least the sergeant had some sense. I know what RAS is and I don't don't even live in the country. Looks as though his men need to go back to the academy to be schooled on RAS, as they shouldn't be on the job not knowing this most important part of policing. Baffling stuff!
