I don’t mind all of them. Law Talk With Mike is a good one where he stays on the screen. But I hate when a hearing is chugging along just fine and then they stop the video to explain something we just heard very clearly with our own ears.

This case is turning out to be a case study in the Dunning-Kruger effect. Sadly it'll probably take some jail time for him to even begin to understand (or "over stand" if you will) that he's doing this to himself. I've always been curious why sovcidiots can never answer a simple yes or no question with a simple yes or no lol my guess, it's the baffle them with bullshit strategy.

From what I remember as a non attorney working at a law firm a writ of mandamus is an order for an official to take an action or stop an action. Same root as mandate or mandatory. More common writ of certiorari is an appeals court reviewing a lower courts decision and ordering all trial records to be handed over. Same root as certify or certificate.

A writ of mandamus compells a government official to act to correct a mistake, or to stop an illegal action. It is an extrodinary remedy, used in extreme cases when other avenues have been exhausted. A writ of certiorari is a request for appeal. It asks the higher court to look at the lower court's decision. It is how the supreme court selects its cases, for example. Certiorari is latin for "to be more fully informed."

Lawyers are a lot like doctors. There is a reason they have their own special school that takes YEARS to get through. Because navigating our legal system... well any legal system. Is complicated. The same way medicine is complicated. So representing yourself in criminal proceedings is the same as attempting to diagnose your own illness. You might get it right, but if you do, its going to be blind luck. Not because your smart. These Sovereigns believe they are smarter than everyone else. And they are always wrong. And even in jail, they rarely face the fact they are not as smart as they think they are.

At 7 minutes and 45 seconds, the defendant states he wants to " move forward with the discovery hearing because there is still NO exculpatory evidence as far as that I did anything wrong". He has been provided all of the discovery evidence and there is nothing to exonerate him!! Apparently he doesn't understand that means he has NO defense !! It is a truly stupid admission on his part and that's why the Judge responded "what you just said about discovery didn't make any sense." The Judge and I both realized the defendant doesn't know what exculpatory evidence means but is bloviating as usual.

He wants the prosecution to turn over evidence they have that shows his innocence. He wasn't saying there isn't any, he stated they hadn't turned over exculpatory evidence he believes is in their possession. If he's correct, the mere lack of it, whether definitive or not, should mean case closed. It's a Brady violation and He walks.

The prosecution has to turn over whatever evidence it has to the defense so that there isn’t a “trial by ambush,” with surprise evidence presented at trial. That’s why the court wants discovery to be complete before it sets cases for preliminary exam (the hearing where they determine if there is probable cause to go forward). At trial, the jury will then evaluate the evidence and decide whether the prosecution has proven guilt beyond a reasonable doubt. But what this defendant said was nonsensical. He claimed that his _Brady_ rights were violated when the prosecution failed to produce any “exculpatory” evidence to prove he “did anything wrong.” Exculpatory evidence is evidence that _exonerates_ the defendant; there’s no such thing as exculpatory evidence that proves guilt.

I love the idea that discovery can't be complete until the prosecution provides exculpatory evidence. If we applied this to all cases, we wouldn't have the current problem with over-crowded prisons.

Judge Simpson said what I've been thinking for a long time: Some sov-cits throw legalistic words around and think they're making sense, when all they're really doing is exhibiting a sign of the Dunning-Krueger effect. A perfect example: Around 7:45, the defendant says that "there is no exculpatory evidence that I did anything wrong." According to the dictionaries I looked at, "exculpatory evidence" would prove that he didn't do anything wrong, not show that he did, but he got that big, five-syllable word in there -- barely.

"The prosecution didn't provide exculpatory evidence indicating my guilt." 1 - Exculpatory evidence is that which indicates you AREN'T guilty. 2 - If the prosecution didn't think they have evidence of your guilt they would drop the charges 3 - Between YOU and the PROFESSIONAL PROSECUTOR I'm going to guess the prosecutor is a better judge of what does and doesn't indicate guilt. This guy is sucking around for a 2 year jail sentence and thousands of dollars in fines, when he could likely plead, get a suspended sentence and a year probation. Also, Judge Simpson should just ask what his objection to saying the word "understand" is. (SovCit "if you say you 'understand' you are acquiescing to 'stand under' the law")

“Overstand” is SovCit speak. SovCits don’t like to say that they “understand” anything, because they think it means that they are consenting to the court’s jurisdiction.
