That is not entirely true in terms of floor plan line of credit. I am an independent dealer and was offered by multiple floor plans up to 1 million in line of credit. Other dealers get even more. Some big dealers get 20 to 30 million dollars. Some of the big floor plan companies are AFC Nextgear and floor plan Express. Most dealers have access to those companies to get a line of credit. It is not 30 or 20% or even 15% rates. Most dealers with decent credit , their rate is about 2% over prime. The owner of CNC himself said in the interview that he went from 2 million to 20 to 30 million line of credit. He went and bought many cars. Spent many of the millions the line of credit provided him. Over leveraged himself. Very dangerous in the floor plan game. Exotic cars in general take a while to sell, some over a year. The floor plan is generally due after 90 days on a car loan. In CNC's case, what probably happened is that many of these cars didn't sell right away and he is left with millions due on the floor plan line of credit. So either the floor plan creditors come in and confiscate the cars on the line of credit and he loses millions. Or He uses the money from the consigned cars that have been sold and makes payments on his line of credit floor plan to buy himself time and not lose his entire business.

@@jaymorrison5895 Almost all dealers (new and used have flooring or can obtain flooring if they want it. I speak from 45 years of New, Used and Leasing Company experience. As a used car dealer I always had a flooring credit line. Some are handled through banks, auctions are a big source and many flooring companies set up with auctions to floor auction purchases. Another error in the video is that as mentioned above by allh1, this dealer did have flooring but may have mishandled it at some point and had it revoked which would put him a cash crunch. Flooring companies require immediate payoff when a car is sold. He got underwater and was robbing Peter to pay Paul which happens often but usually not in such big numbers.

It's called the FLOAT! I was in the car business for over 20 years, it is VERY common. Customers get late payments, etc on their credit reports. All it takes is one bad month for the house of cards to crumble.

Yes, so many people think CNC is the first and only one to have the house of cards fall down. It happens all the time. It happened to a highline dealer near me, and I bought a car from them and had to pound them to get the title, but I got it. Only months later, the whole place cratered and people got hurt for sure. It's really not that rare.

I sold cars at West Covina Plymouth-Chrysler-Jeep. Back in the early 2000's they were doing what CNC is accused of doing. We didnt know until my co workers mom traded in her car for a new Chrysler....but a few weeks later the bank called his mom and told her she missed a payment. After some back and forth between the dealer and my co workers mom it came to light that the scheme was happening. Another instance was a guy came into the dealer so pissed off that he walked into the finance directors office and punched the dude in the face! They were SHADY!!! A coworker and I went to the bank on payday to cash our check and the teller told us that couldn't cash the check because the dealers account was overdrawn! I told the teller she needs to cash our check right now...she did but told us to warn everyone else that they basically have a worthless piece of paper until the dealer reconciles the account. After that I was out of there!

You do not have to be a franchise dealer to get a floor plan. Next gear capital is a floor plan company that will extend lines of credit to independent dealers. Those credits are called floor plans. God bless nice video

Exactly. Over 20 years ago when I was a used car dealer I had floorplan money. Clay at CNC said just the other night that he was making interest payments on 30 million in floorplan. I suspect the floorplan bank may very well have all the titles (this is pretty common on floorplans)...and CNC isn’t paying THEM.

as a safe tips when you buy the car from independent dealer. i only pay dealer if they can show me title or copy of title. if they floor plan it. It can be pulled from bank. without it do not pay for the car.

Very, very well explained! Even if one chooses the higher road and doesn’t float & leverage consignor cash....the huge daily cash swings of an exotic car dealer are hard to manage and can get out of control very quickly. Unfortunately many dealerships see spending money/time on financial back office as a waste because they aren’t “revenue-generating”, and always choose to spend their overhead on more sales guys and marketing spend. Then they spend consignor money on accident and dig themselves in a hole. Not having a solid back office that can keep up is like building a mansion on sand. It’ll collapse eventually.

Thank you for the insight! I have a case right now that someone has borrowed millions against twenty cars. (He claims to be a broker/whole saller w/ out a license) The deal went through and now the borrower is demanding 10+ titles to be released. So naturally we went out to check the inventory and we can only find two cars (and one of them is showing it's been sold!) So what does the lender do? The money is gone, the cars are not found AND NOW the borrower wants the titles!!! (talk about doubling down!)

99% of this is spot on and he’s accurate. Only correction is you can be an independent dealer with a floor plan and sizable ones. I know independents that have floor plans as small as $50k up to $30 million. A dealer doesn’t need to be associated with a franchise like Porsche or Audi etc to get a floor plan. Without floor plans I’m guessing about 80% of dealers wouldn’t exist

I’m sure he was also trading consignment titles for cash at a super high interest rate. Here’s how it works you take your 150k car in leave the title. CNC takes title either puts it on the “floor plan” and the floor plan pays out 150k on that car. He uses the 150k to cover some holes until he gets a check on another group of cars that just sold.

There are floorplans for dealers like CHC. Adesa is a floorplan for used car dealers among others. CHC surely used a floorplan. CHC was using a combination of consignment and floorplan. They were comingling fund from consignment with floorplan funds and vice versa.

I know people are running credit fraud at some point of their dealership management, for example my friend used to forge bank statement to get customer approved. Most of their cars are not paid off, the dealership will pay 10% and have the car parked at their lot, once customer pays them they then pay off the commercial loan and make their profits. Cash flow is everything, I have no issue holding customer's cash for as long as I can.

Audited many New and Used Vehicle Dealers whom floored (financed) all or part of their inventory which required detailed inventory audits to ensure the dealer complied with the terns of their credit account. Some did not. Note, Individulals whom consign their vehicle are seriously at risk given the dealer can sell their car and not pay as required and it's Very Important to understand that Innocent Buyers in most cases are entitled to keep the vehicles they purchased! Trust, but Verify!

This is easily resolved by not being an idiot. Don't allow a dealer to take your car on consignment and this can never happen to you.

Asset allocation, cost of money, cash flow management. That’s all it is, and will ever be. My question is, if an independent dealer does it RIGHT (legit, strong Cutomer service, etc), is it worth the effort to be in this business?
