@Saiyanshanze134 жыл бұрын
@Çerastes sorry... no criminal trespass. The video proves this. Look up the actual law. Youre like McMicheals...just because you think you know the law does it mean you do. But let's entertain your nonsense for a second. Let's assume that you are correct and that a Criminal Trespass occurred. You just damned the McMichaels and convicted them of murder, thank you! How so? What is trespassing? Is trespassing a misdemeanour or a felony? I ask you in relation to this something called the actual law: 2010 Georgia Code TITLE 17 - CRIMINAL PROCEDURE CHAPTER 4 - ARREST OF PERSONS ARTICLE 4 - ARREST BY PRIVATE PERSONS § 17-4-60 - Grounds for arrest O.C.G.A. 17-4-60 (2010) 17-4-60. Grounds for arrest A private person may arrest an offender if the offense is committed in his presence or within his immediate knowledge. If the offense is a felony and the offender is escaping or attempting to escape, a private person may arrest him upon reasonable and probable grounds of suspicion. Not only does it turn out that he did not have any reasonable or probable grounds for suspicion because the video shows that there was none, he was hypothesizing and anticipating and assuming that the offense that was committed was a misdemeanour which does not give him the right to chase anyone down or detain anybody especially at fucking gunpoint. It is amazing the lengths you racist will go to to try to condone a simple bad situation
@Saiyanshanze134 жыл бұрын
@Çerastes so show me where under either a) Or b)1-3 where Arbery violated any of these and provide the video or eyewitness evidence to support your claims of such violation. Also note that it is classified as a misdemeanour. Go back to the post I just made a few minutes ago and see what Georgia law says about misdemeanors vs. Felonies when it comes to citizen's arrest. I'm starting to think that this is probably little too complicated and beyond your intelligence level so maybe you should forget all of this and just go back to your Nintendo in your mom's basement
@Saiyanshanze134 жыл бұрын
@Çerastes what no trespassing sign? As I said...even IF this was a trespass its a misdomeanor and no grounds for a weaponized citizens arrest as our CNN host has clearly outlined. And what does a no trespass sign mean? To not be on the property for any illegal purpose as outlined by law. You can hypothesize that he was there to commit some sort of illegal activity, even though there was no actual illegal activity making your hypothesis complete conjecture and based on no solid evidence. I on the other hand can conversely hypothesize that Arbery was there looking for someone, perhaps to gain employment, which is more likely the scenario based on the video evidence, but at any rate is nothing more than my own hypothesis and opinion. Whether it's my opinion or your opinion as to what his motives are our personal opinions don't matter when there is no evidence to support either one. We can't make up or determine what Arberys motives and intentions are in his head. We cannot ascertain what is mensn rea is we can only go by his actus rea and by his actus rea or actions he had no criminal intention because he committed no criminal acts as outlined under Georgia law. Race bait that's what you guys always try to claim to abscond yourself from the racist shit that you try to pull off. Don't blame me for calling a spade a spade and your inability to just call this a bad call and situation

Turns out one of the "crew" didn't realize we were staying there at night and brought his buddies over to show them the house he was working on. It is not a justification for the shots fired, but its perhaps a justification for the McMichaels choice to pursue Arbery for a citizen's arrest. And yes, I realize the McMichaels didn't see him trespass... Unfortunately Georgia's citizen arrest laws are unclear. They could have tried if they had 'immediate knowledge' of a crime.... But please also be rational in your assessment of the McMichaels as well. They clearly did not set out in pursuite of Arbery with the intention of killing him. Gregory the father was on a 911 call while the actually shooting took place. This proves that they authentically thought they were pursuing a criminal. This is not a case of pre-medidated murder.

I live in NZ and we have such mild racist issues here. Most people have friend groups with all races in them and racism is not really thought about. There are parts of provincial NZ that have racism from not meeting other races and pure ignorance of not knowing other races. And then there’s the issues of the indigenous people Maori having more poverty. but it’s nothing like the US, I find it hard to understand why skin colour is such a big issue for people in the US. Construction sites are notorious for thefts for precisely that reason. It turns out stealing tools and building materials from open and unguarded buildings is quite profitable and easy. I know this having worked on construction sites myself. He was trespassing on property that he did not own, regardless of his intent or whether or not he actually stole something. That makes him suspect. It is not unreasonable therefore to at least confront the man and ascertain his intent. It is also not unreasonable, considering such suspicion, to do so with a weapon for defense. Ahmaud might have been well within his rights to attack the men if he perceived them as a threat with his life in danger (reasonable considering they attempted to stop him with weapons), but that right isn't extended only to him - even if he was in the right and they were in the wrong. The moment he made the decision to physically attack them - right or wrong - made their decision to defend themselves with a deadly weapon justified. Horrible, tragic, devastating . . . but justified.

airrun88 I have done it before for boarded up/abandoned houses...I am a real estate investor and look for houses to flip. Never truly considered thought it could lead to someone’s death. Tragic!

This whole situation makes me take a step back bc while we were building our house (in a new community) I walked into other houses to see how different theirs were in comparison to mine and others walked into mine. Never would I have thought someone could possibly kill me for that... Until now. What I don't understand is even if they thought he stole something, when they caught up to him, did he have anything in his hand? No he didn't so there should have never been a pursuit.

We did the same. And as a side note. During the crash of 2008. I can't tell you how many homes i have walked up to. Foreclosures. Peeked in . As i was walking. Never went in but walked around. Because people were leaving pets. An awful occurance then. I would never think someone would kill for this. Racially motivated.

Welcome to the USA. Technically a girl scout selling cookies can be shot for trespassing. It's a messed up dangerous place full of people who are looking for any excuse to evoke the first amendment and castle doctrine. They value private property over peoples lives, even when it isnt even their own property. They will even treat their own families like property. I come from a republican family, they are all armed and support "stand your ground". I've had to tell them "I am not your property! Don't kill in my name!"

C'mon, this was a pretextual ruse; because they got caught for being the idiots they were. They knew he hadn't stolen anything, otherwise there wouldn't have been a fight they'd've just killed him straight out and produced the stolen evidence to get away with it.

Wow! I had my house built also and thought nothing of people looking at my house during the built or likewise looking in other homes being built trying to figure out the style or layout. I didn't see the harm in doing so. It makes you rethink this.

We did too. We went to our development once a week. As i said in other comments. As an avid walker during the crash there were so many foreclosures, i always walked up and took a peek. Around the yards, because people were leaving pets. Never went in. I guess i was trespassing. Never thought you could get shot over it. I believe it was a hate crime. Pure and simple.

I know after having a DA write a letter to the governor saying how no charges should be brought then going back on that due to communist propagandists... Appalling.

Thank god I am living in Europe where a curious kid can inspect construction sites (yes, that happens sometimes, even I did in my childhood, although it's prohibited) and not being shot for trespassing. Or being haunted by 2 armed, suspicious looking men.

Moral to this story is you can’t be curious. I mean he was jogging, saw a house under construction and said hmmm let me see what this looks like. I thought it was determined that he was in there for about 3 minutes. Then he went about his business. Why is this so hard to fathom? He was murdered, period!

Known criminal with multiple convictions, one of which was a serious gun offence, skulking around private property. Moral of the story is don't be a criminal shi7. He can no longer rob his neighbours, they are safe now. His reputation preceded him.

Cowards probably would've called the police if they believed that; but they didn't believe it, they were hunting. With intentional murderous intent. Plain and simple
