Yes, in Wisconsin if you are intoxicated, sitting in the driver's seat, and have the keys in the ignition, your hand, or possibly nearby, you could be charged with an OWI.
On May 16, 2021, West Salem police were alerted to a man asleep at the wheel with the engine running. When approached, the officer noticed a faint odor of intoxicants. The man was charged with felony seventh-offense drunk driving and seventh-offense operating with a prohibited blood-alcohol content.

They still run those tests because they're gathering evidence that can be used in court. Don't misunderstand, drunk driving is fucked up, and people who do it should get arrested. What I'm saying is that they use these tests to make sure the charge sticks. It's their job to get you to do these tests as a part of an investigation, but you're under no obligation to help them with that investigation. Just like you have no obligation to help a person that works at a store stock the shelves. It's always better to be polite and compliment with cops, but they'll always specifically ask you if you're WILLING to do these tests (help them do their job) and you can definitely just ask for a lawyer and shut the f up if you know you're gonna fail.

If the state allows him to keep getting a license after all these OWIs, then they are the problem. Instead of reinstating his license and risking lives, mandate rehab and counseling. When you’ve been where this guy is, you recognize the pain and struggle. I’m hoping he found help, and that someone finally told him his fly was down. 😬

Honestly though at the end of the video it says this was his first owi in 6 years. And he genuinely seemed to have just went out to his car to wait for his girlfriend and started the car probably because it was 2 am in Wisconsin even in the summer it ain’t warm at night. Judging by the hoodie it was probably spring or fall so even colder. And he was on the edge of the parking lot not even in the road. Im in recovery myself and never got an owi but at 6 years without one that tells me he’s obviously learned his lesson, also by the fact that he said he was in his car at 11 pm and it was 2 am when the cops got there, I genuinely hope he gets help but on the flip side this arrest is bullshit. To me any law that says of the vehicle is running is kinda dumb to be an owi for one, but also he was in a parking lot. That’s not public property he wasn’t on a road way either. He should and I genuinely hope he does get those charges reduced down or gets out of them completely because 6 years is a very long time to go between and the amount of work that had to take to get his license back and the fact that he wasn’t actually driving tells me a lot here about him. He’s obviously gotten his life a lot more together than it was and this could and probably will ruin all of that work he most likely had to put in

Depends on how long since the last one. This is hard, because he was NOT driving. Yes, he was sitting in a parking spot with the truck running, but he was NOT driving.

@@savannanaturegal something similar happened to me when I lived in wisconsin. I was dropped off at my car after a night out and chose to just sleep it off since I didn't have a ride or wanted to leave my car. Bad planning I know but it was December and cold so I turned on the heat and went to sleep in the driver seat. The cops said I could technically be charged with dui but luckily they believed me when I said I chose to sleep it off instead of drive, and was cold. Which was true.

@@meiam9107 I was pre-pulled over one time a few years back, but in my case for not coming to a complete stop at a stop sign. I pulled over a minute later to take some pictures of a nearby mountain and the cop just pulled up behind me, haha.

This dude is depressed. He’s obviously an alcoholic. I was a really bad alcoholic. Went to rehab last Nov 2020 and Currently still sober. Hope this guy gets the help he needs. No one enjoys being an alcoholic. Luckily I’m 27 and stopped early. I was out of control

I went to rehab in November 2020 as well. Relapsed in January, but have been sober since February 4th. Can’t put into words how happy I am since being clean.

congrats on rehab. Sometimes, when it gets THAT bad, the best option you can do to help yourself is take a long break from LIFE. Seek out others to LIVE WITH who are going through the same and help your self, all community resources. They will feed you good food, form a plan of discipline for you, and yes, sober, healthy activities to enjoy. Hell, the place I went, you will get cable tv and vending machines too, haha. But it is a great thing to do, you will have an entire TEAM to help you. If you don't have money, there ARE still places out there. Insurance is a big problem, but there ARE still places one can find. If it is difficult, talk with church leaders, even if you are not religious, if you truly want help, many of them and the congregations will gladly help you out, even doctors, you don't have to accept pills, other community groups. There is ALWAYS help out there, they can hook you up. and take your pick of struggling addicts to share your own story with. WE are out here, and I wish you all the best man.

Should get his license revoked for life, spend a few months in prison, then get sent to detox. He could also use time in a psychiatric facility since he seems to have given up all hope. He needs lots of observation.

I have never been done for drink driving but one time when I was at the pub I knew I drunk too much to safely ride home so I just unlocked my motorcycle steering lock and walked it home. When I was about 3 houses from home the police stopped me and asked what I was doing. I said I was too drunk to ride so I walked my bike home instead (it was only about 4 kms or 2.5 miles from the pub to home). They checked my bike and asked where the keys were. I said they are in my pocket. They told me that just saved me from a drink driving charge, if I had left them in the ignition that would have been enough for a drink driving charge. They then asked where I live and when I told them they helped me push the bike home and made sure it was secure before telling me to make sure I don't ride for at least 24 hours. Nice cops 🙂

I mean the channel is not going to go out of its way to show a bunch of uniformed police officers being assholes either. If you look at the rest of the videos it's clear whoever runs the channel wants us to see the good cops. I think that's a worthwhile objective so long as we also don't forget that there are issues with modern policing in North America and it does need to be changed.

sadly doubt it, don't get me wrong however the American system in place is to entice to consumer to continue consuming and sure this guy among many others out there may serve their time, nothing is guaranteed to them after they leave. With no housing he is bound to miss probation which will lead him back to jail, with a record he would have to find a person who will be willing to hire him out of sympathy since even finding a job in this market with just a high school diploma is ridiculous let alone someone who is a felon. America is in a perpetual state where the working class is being merged with low income poverty and it's becoming more difficult on everyday hardworking citizens with the cost of living increasing. Then for shits and giggles, factor in how people treat each other adding to the stress of everyday life all because one ungrateful knob or twat decided they had a bad day so they lash out of some random passerby.. it's calling for people to escape the harsh reality we live in, and before you start claiming this seems like first world problems because yes in a sense they are, one's life may not be equivalent to another's by the monumental stature however to compare the timeline of both person's sentimental mentality it is safe to say that we all experience similar peaks and lowest points.

He was pretty agreeable and rational throughout the entire ordeal to be fair. Piece of shit for operating while drunk 7 times and should be in prison for a VERY long time, but at least he didn't try to lie about it. Owned it like a man. A broken man, but a man nonetheless. Two things can be true at once: 1) He's a danger to himself and others, shows no regard for public safety and thus deserves to be punished the the fullest extent of the law. 2) was honest- a commendable quality. I hope he's able to overcome his problems. I've met people like this before. They aren't necessarily evil, just too deep into alcoholism. They think "I can't stop drinking, but I do need to get to places" and so they drink and drive. While it's easy to say "there are no excuses" and lump him in with others, understanding the reasoning that drives (pun intended) these crimes is vital. Helps create programs that will be best tailored to help them, when they leave prison and hopefully prevent them from returning.

A person has to be ready, really ready, to get better. It doesn't matter how much help is offered (and he's probably had plenty), if someone isn't committed to becoming clean and sober it'll do no good. He clearly has a problem, but making the decision to get behind the wheel drunk is ridiculous. I have no sympathy for that kind of stupidity.

As an alcoholic I 100% empathise with him. When your addiction gets that bad, you get blackout. You can wake up anywhere having done anything and have no idea. The only way out is to quit drinking and remember there is no such thing as 1 drink.

The reality is that “Don’t drink and drive” doesn’t work for some people. Once they’re drunk, they lose all sense of logic and consequence. Their rule needs to simply be “Don’t drink.” Most people can retain that little drunk voice that says “don’t drive,” others can’t.

I'm getting mine revoked in Wisconsin after my first. Guess it depends on the county, but they're also offering to let me take a drivers safety plan and get an interlock which is bullshit cuz I wasn't even drinking, i said I smoked 5 hours prior because it smelled like weed. Didn't even find anything in my car. Still got charged, dude said you can be high for up to 24 hours... Cops are ignorant as hell sometimes.

I can't wholly disagree with you but he wasn't driving, he was sleeping in a parking lot. Your point still stands but it doesn't seem right that it's the same charge for sleeping off a bender in your truck with the engine running (perhaps because it's freezing outside, I hear it gets cold in Wisconsin sometimes) and driving merrily along down the highway endangering everyone who happens to be sharing the road, too drunk to know or care about the danger you're putting them in. I might also offer an alternative statement to your last: After your 3rd DUI (or 2nd or 1st) you should be banned from DRINKING for life. Maybe you get issued a modified ID specifically prohibiting alcohol purchase, perhaps you are ordered to wear an alcohol monitoring bracelet (yes it does exist). Order the offender to regularly take disulfiram, a medication that makes alcohol consumption immediately unpleasant and is very affordable in the US with goodrx. Hell regularly drug test the offender to make sure they've been taking it. Ignition interlocks are already common but can be defeated. But a prohibition on possessing or consuming alcohol might be of far more useful and perhaps easier to enforce than permanently revoking one's license. Especially in a region where driving, legally or otherwise, is a requirement to function.

I have never understood why Police in the USA have to first prove that you are drunk before they test your breath to see if you are drunk. In the UK and in the Netherlands, Police can stop any car anywhere at any time without any "probable cause" ("Reasonable grounds to suspect") and ask you to take a breath test because you are driving a car. Nobody who is sober has a problem with that because it obviously reduces the chance that you will get killed by a drunk driver. Only drunk people have a problem with it, and get the same penalty as they would gave got if they blew over the limit. I believe it's the same in many countries including Australia and New Zealand.

@@harpharpharpharp1971 the field test is to visually proove that the suspect was impaired. What if the breath test is just slightly above the limit and the defendant says he had just one beer and was totally safe to drive so the judge waves the case? Thats why they have to collect evidence that this was not the case. Just a advice from me: no one ever was free to walk away after passing a field test. If you get asked for doing the test you are already going to jail. Refuse to make the test. In some states your licence will automatically be rewoked but if you win the case you will have it back + you can sue them for false arrest. That oc just happens if you are stone sober and the breath test comes back clear. If you are drunk, dont do the field test and just accept that you will have a dui charge (breath test at the police station or blood sample is not voluntary). But dont give them free evidence.

Failure to provide a (sufficient or outright) sample for basically any reason (including being medically unable - you have to win in court to overturn that one) is also an instant conviction.

I hope all the people here defending this guy, never reproduce. I get he's a depressed alcoholic but take an Uber, cab or bus or drink at home so you don't need to leave or call a sober driver. Amazing how a guy gets busted for the 7th time- meaning he does this all of the time, plays the sympathy card, and the comment section falls in love with him. When he kills your family member, I hope you “wish him well” then. This guy needs to be locked away.

Idk man. He seems like the type of guy that got one legit, then the other 5 before this was failure to forget a stupid law. There should at least be a loop hole to be able to have the car on, and lay in the back seat or something. It shouldn’t just be in the car at all, some people can’t afford ride home, and don’t like being miserably cold or hot.

The sad part is that this arrest is likely only going to make things worse. It’s basically “hey let’s put people who use substances as an escape from reality and stress into a highly stressful situation and maybe they’ll stop doing what they’re doing”

@Snake Plisken I’m pretty sure his DL was revoked. As in all states,, there is a process to go threw to get DL reinstated. Its hard,, and expensive. But if he fulfills state requirements,, he is completely legal to drive. Maybe you should look into what state requirements are before commenting like he got his DL back the next week…

Beer and bars are a large part of the culture in Wisconsin. Lots of German ancestry. Most people are responsible and have designated drivers and such but there are still many that are not unfortunatly. The punishments for DUI should be more sever in my opinion

@@HoLeeFuk317 I live in Louisiana, a third offence DUI carries a mandatory 1 year prison sentence with a max of 5. and on the 4th offence there is a mandatory 10 year prison sentence with 4 years being served before parole eligible . and if there is a 5th offence it would be life (25 years) you would probably do 12 of them.

@@byebyebye1334 yes, they are. They have to follow their procedures regardless. One of the cops here even says they have a process they have to follow. The first thing a defense attorney is going to do is try to get evidence thrown out. And “we could just tell he was drunk” doesn’t work in court. So they need evidence to back up their evidence or else you get someone like this who is able to get arrested repeatedly but still be out driving around. And anyone who’s ever been a cop or knows one personally knows that these guys would rather be doing anything else than dealing with a drunk idiot and doing all the paperwork that comes with it.

@@byebyebye1334 the PBT they give you (portable breath test) is only part of the FST (field sobriety test). The BAC they use will come from a different breathalyzer that’ll print out an actual receipt looking thing with the BAC on it and they have to keep records and stuff of accuracy etc for those machines to be able to use it as evidence. He likely took another one at the station and that’s the one that will be used in court

I also got one about 6 years ago. It was my first and only dui, also young and dumb. I was broke, totaled my car in the process. Got a public defender. License got revoked. I think I paid around 3,000 in court fines. It took me a few years to pay that off. It also took me a few years before I could get my license back because I had to buy a car then get an ignition interlock installed in said car before I could get my license back. I don’t know how this guy has any money left after 6! It’s crazy, in Washington state even on your first offense, they make you get an interlock. And you can’t just wait a few years or anything. Even if you wait ten years then go try to get your license back, still have to get an interlock! Oh and I had to retake the whole driving test as well. Written and practical. That was fun…

I did that once. I was sober and took a breathalyzer after the cop specifically told me “I smell alcohol on you.” I said I had not had anything to drink, and blew a .00. He then asked me to do the tests, which I refused because he said he smelled alcohol, and I blew a .00. They arrested me for a refused a field sobriety test. BUT if you take it, the cop can just say “he failed” no matter how it goes. It’s subjective. It’s their word against yours. They took my license for a year and I got a year probation and fines. Because a cop pulled me over (I turned into a construction zone at night on the way to a hospitalat which my dad was dying), said he smelled alcohol which was not true, I proved I wasn’t drunk, I got arrested anyway.

It was a terrible night, some random doctor called my phone at about 930 and basically said “we are going to start chest compressions (on dad) so if you wanna say bye get here soon.” So I panicked and rushed outta the house, it’s dark, it’s raining (a little), there’s construction in front of the hospital I’m not super familiar with so I took a back street and turned onto the main drag, right into the “under construction” area. L Cops were right there, they didn’t believe the story and were laughing and joking because I was such a mess. However, I will admit that when I was in my early/mid 20s I definitely made the stupid decision to drive home from the bar when I should not have. Luckily nothing bad happened (I didn’t mess anyone else’s life up by my selfish actions) and also didn’t get in trouble. So I figured this was karma for making terribly stupid decisions in the past without consequences. Not proud of any of this, nor do I think cops are “out to arrest innocent people.” There is a lot of money to be made off of DUIs tho, which is likely why the burden of proof is so low. “He looked unstable standing on one foot while counting and balancing with his arms while nervous. Arrest him” field sobriety tests are designed to be failed for sure.

Refusal in most states will get you more trouble. He knows this, and wants to comply to avoid the extra penalties, but is embarrassed about how it will look. Sadly, I know from experience.

Praying for you Jason 🙏🙏🙏 time to get help and sober. I have 30 years 7 months sober. Went to rehab for 30 days then committed to 6 months at the Freedom House sober living home in Long Beach Ca and ended up staying for 8.5 months and had a blast there. Would have stayed longer but had a tile and marble job to do in Hawaii.

These stupid tests are so redundant…we don’t use them anymore in Australia due to how much time they waste police time. They use breathalysers and blood tests here in Australia. Very efficient and effective.

@@Vladkhanthehun Geez NYS is much more strict than that. 1st DUI license is revoked for at least 6 months and you could go to prison for up to 1 year. 2nd DUI within 10 years license is revoked for at least 1 year and you could go to jail for up to 4 years and 3rd DUI in 10 years license is revoked for atleast 1 year and you could go to jail for up to 7 years. The penalties are worse if its aggravated DUI which means that your BAC is .18 or higher.

I got two DUIs in a ten-year period. The second one was in 2014. Now I drive with a breathalyzer. It's a miracle I actually got one, as far as I'm concerned - and it helps immensely during the occasional trying moment. After being incarcerated twice, almost losing my home with my very sober boyfriend and our beloved dogs. It's a miracle he took me back. I think videos such as this one are so important for reminding me how irrational I get when I drink, because I see a common thread with all the people in these videos of people being arrested for DUI/OWI - denial. The whole world can tell when I'm drunk, but I "feel" fine! Alcohol almost killed me. Thanks for these videos.

Good for you! First offenses are usually almost nothing but second offense in ANY state really becomes harsh. Those breathalyzers are really annoying and expensive but it's fair punishment. (I know from experience. I got my 2nd 2 years ago and when I can finally drive, I am required to have a breathalyzer). I'm not looking forward to it but you're right, watching these videos helps remind me. I lost a LOT in my life and became homeless over it. It's not worth it. I got away with it too many times and just thought I'd never get caught. Was in complete denial. I'm doing better now myself, just can't wait to drive again!

@@wombat5252 I can SO relate to what you are saying! There was one time where that breathalyzer was the only thing standing between me and a drink (never just one, of course). For five minutes, that device gave me time to think about everything I was putting on the line. I ended up lifting some weights instead. Bless!!

Also if I even blow 0.01 into it, the RMV of my state can revoke my license for another 5-10 years. It's nothing to F around with. But yeah, it was WAY to easy to drink and drive. At first I thought it was fun...thank god I never hit anyone. It's embarassing having to ask for rides and walk everywhere. But yeah have a nice day!

Same here. I got one at 21 and another at 30. I checked into rehab voluntarily after the second one and have been sober since. Still dealing with the consequences but I deserved it. Those officers saved my life. I knew I had a problem but it was a nightmare to try and control. Watching these videos is hard for me but it helps me to realize why I’m staying sober. There is no feeling more liberating than waking up the next day feeling fine and knowing I don’t have to go through this again. Sorry for the rant and best of luck to you!

Man I really feel for Jason. He was completely cooperative, didn't even really seem like he had the intent of driving but fell asleep waiting for his girl to get there. The Wisconsin law kinda makes sense, but this guy's not an angry drunk, or a liar. He just needs a bit of help.

With 6 DUIs you should know. Atleast sit in thr passenger seat and maybe then you can beat the charge this sucks for him I'm an addict I understand glad I stopped and got sober

One of the counselor's at the rehab place l went to had 12 DUIs before a judge locked him up. I couldn't hardly believe it. Now that he's sober he's one of the happiest guys I've ever met.

As a recovering alcoholic with 12 years sober (by God's grace!) I can speak from experience. I had a DWI in New Jersey in 2008. I blew a .13 and felt "normal". It was a taillight stop and thankfully I did not cause harm to anyone. Here is the thing. It took years of HEAVY drinking for me to feel normal at a .13. I passed ALL the tests the officer told me EXCEPT the preliminary breath test, Even the police were shocked! The point is, I drove many times in that condition thinking I was fine. I only got caught once. To get caught 7 times means he probably drove intoxicated hundreds of times in between. Yes I was also depressed. Lost both parents in a year, 30 year marriage ended, lost a 100,000.00 a year job, and other life circumstances. BUT there is NO excuse good enough for risking other peoples lives because I was depressed. I finally stopped blaming the world for MY misfortune. I went to rehab. I learned about myself and that ALL my problems were created by ME and alcohol. That's the funny part. People (me) drank to escape my emotional pain, and in the process just created more. It is a vicious cycle. I'm sure this guy is not a bad person. BUT that said, HE needs to be the one to rebuild his life. Nobody can do that for him. It's time he walk into an AA meeting and put his hand up and ASK for help. That's what I did. And if this drunk can do it, so can this man. I pray he does. I hope he sticks around until the MIRACLE happens.

I've drove drunk thousands of times in my life. I have a 99.7% success rate. I use to pass every test they give me. Drink 15 drinks and walk a straight line like a breeze. It's that gah damn breathalyzer. Always refuse it. I learned the hard way. I was a very good drunk driver though. Usually the DDD of my group(designated drunk driver). Not so much anymore as Im in my 30's and can't handle the alcohol like I use too so I try and watch myself. Just got my 3rd dui, 9 years apart. They are no fun. A nightmare where Im from. This guy should count his blessings. If he got 7 dui's in NY he would be doing 20 years! Hell, I did 6 months for my second one!

@@rookierider2096 I'm glad you asked. Having that job (director of engineering at a microbiological lab) caused great stress. Also it kept me from my family and a marriage that was foundering due to my almost continual abscence, This led to my depression. The alcohol was the symptom of a deeper emotional problem. The money was just the catalyst to the anxiety. It also afforded me any means by which to satisfy my thirst. My family depended on me. Money does NOT buy happiness. It makes some things in life easier sure, BUT it guarantes nothing. I now make half that. I have what I need. Not all that I WANT. Thank you for reading my story. I pray that ANYONE who feels trapped by alcohol (or drugs) finds a way out. Life is tough, but worth it. It was an escape from myself. When I learned to deal with life first, I realized that NOTHING is that important. Feeling internal peace is great. Be well my friend,

7TH OFFENSE!? I had a friend do a few years in the pen when he got his 4th one here in KY! The fact they allowed him to keep a license is ridiculous he obviously doesn't care about anyone or the law. And he needs serious help with his alcohol addiction!!

In FL, for your first offense you could possibly go to prison and 4th offense is 5 years in prison with a felony charge.

A guy in my town in Texas got sentenced to life in prison because he had 5. Where ever this is needs to step up and start locking these guys up for a while

@@dismalrealms3587 Texas is pretty strict. That doesn’t sound surprising at all. Texas and Oklahoma have handed out lengthy sentences for weed offenses.

@@Tommy88- Yep i would know, got a felony (possesion of a controlled substance) for having .4 grams of marijuana wax on me. I've never even seen hard drugs let alone use them. Shit i don't even drink. (edibles, and wax are considered the same as meth and you receive the same charge)

Just dont drink and drive, no matter what.. call an uber or just walk home... it doesn't matter if hes just sleeping hes still behind the wheel of a motor vehicle with the keys in the ignition

If this is his 7th DUI , there's something wrong . Jail time will sober him up , LOTS OF JAIL TIME SAY A YEAR FOR EACH DUI .

@@gutts7433It’s can be absolutely hard not to drink and drive once you’re inebriated. Alcohol dulls the senses, lowers your inhibitions, and makes the ego grow stronger. At that point you cannot perceive danger, caution, or consequences according… You’re then apt to make the bad choices. Unless you’ve made plans prior to getting drunk, ei: designated driver. Yeah, OK most likely not gonna make the best choice.
