"The Commercial Lien process is not a new innovation. The process has been around for as long as people have been doing commerce. The appropriate title for what we call 'commercial lien' is Affidavit of Obligation. Analyze this: 'affidavit' -- signifying that we are establishing 'truth' in commerce; 'obligation' signifying that there is a responsibility to perform in some particular way. So, by being a sworn affidavit we are establishing certain facts sworn true, correct, complete and not misleading, the truth, the whole truth and nothing but the truth.
These types of liens are not for the purpose of vendettas or getting even, but are used to settle breaches of contracts or perhaps in the case of torts (injuries outside of a contract). This is not to be done 'for the fun of it', but is a viable solution to some problems that might arise. These are not fictitious or statutory liens, these are in the real world where real people work and interact." - Winston Shrout
