“Appeal to your sense of fairness . . .” No reasonable person wants fairness in a case of criminal investigation. They want every advantage possible.

I was once called by a police detective who asked me to come to the police station. I told him “no,” but he could come to my house to interview me and my witnesses (two of my daughters). He told me he was coming to interview us. I had no intention of talking, but I wanted to tell the detective “l don’t talk to cops.” My witnesses and I waited and waited but no one ever showed up. The DA later charged me with a misdemeanor. I defended myself pro se from “voluntary appearance” through the trial and verdict. I got discovery and the detective said in his report that he didn’t come to my house because he was afraid I would sue him. At trial, I tried to introduce the detectives report that he refused to interview me and my witnesses. The judge kept shutting me down over the prosecutor’s objections . . . until . . . the prosecutor later opened the door on cross-examination of one of my witnesses. (Earlier during my cross-examination of the cops, I asked the two police witnesses if they refuse to arrest or question people because the cops might get sued, and they both said, “no.”). My first question on re-direct was about the detective refusing to come and interview me and my witnesses. The judge then overruled the prosecutor’s objection. The prosecutor didn’t know what my witness’s answer was going to be, and it opened the door for me. I was not carried by 12, but I was acquitted by 12. I almost felt sorry for the prosecutor for losing to a non-lawyer pro se.

#1 happened to me and I paid for it. I was naïve thinking the police will always be the good guys.

Can they force you to go to the station? If the police show up at your house could they arrest you if you don’t want to voluntarily go with them?

Only if they have Probable Cause. In which case, they will arrest eventually but are slightly delaying the arrest while they try to get more evidence.

The night I was arrested the police swarmed me and made me sit down in wet grass and freeze my booty so the first thing is said was “I am exercising my 5th and 6th amendment rights”. if they continued to question me is that not illegal?

I'm not an attorney, but if you have unambiguously and proveably invoked your 6th amendment right, anything that comes out of a subsequent interrogation is evidence that should be suppressed and, if severe and pervasive, could be seen as police misconduct. Is there any video evidence? Is it police policy (in connection with the police agency that stopped you) to wear and use bwc's?

@@sunchips5 body cam captured it and the tiny bald angry cop that I'm gonna sue into oblivion verbally acknowledged my invocation. He's toast. Oh yeah. Then he lied about at trial. Just sucks I had to suffer 18 months of hell because they broke the law. Well I guess that's just more damages though.

@lukekoleas3378 Hopefully you have a civil rights attorney that will take your case on contingency. If what you say is true, you can sue for violation of your civil rights. GOOD LUCK!
