this is why death penalty sucks ass. Because it will always hit someone who did nothing wrong, or at least didn't do as bad as it seems. Sometimes that stuff only comes out years later, and it was "beyond reasonable doubt" at the time. You can give a man back his freedom after 5 years, but you can't give him back his life.

So am I understanding this correcrly: The case hinged on a witness who wouldn't commit to his own story, so it ultimately came down to the cops telling a judge that guy did it, and the judge said "Sure, kill him"?

The witness committed during the trial, but later said his family was threatened if he officially recanted his testimony. It's standard police cover up stuff. There was friendly fire, and the cops said "Well, ol Jimbo is dead because of this junkie armed robber, he might as well have shot him."

A Texas inmate requested a very large last meal. I believe the maximum budget the state allocated at the time was $150 to honor a reasonable last meal request. He spent every penny of it on an absurd amount of food from various locations. When they brought him all of his food he refused to take a single bite in a final act of protest. The execution was carried out as scheduled, all the food was thrown away, and the next day the governor of Texas signed an executive order ending the last meal program effective immediately. Since then, death row inmates in Texas have gotten whatever was being served in the cafeteria that day as their last meal.

That's the real issue with the death penalty for me. Not that it isn't just under certain conditions; but weather or not I can always trust the state to accurately prove those conditions were met.

@@TeSolycMandalor while I agree that he was a criminal and therefore a bad person, the circumstances surrounding his last petition is what makes it have impact in my opinion. as an outsider you can see he was a religious man wrongly convicted to death, wanting to give his last meal to the deserving, and even if someone believes that he was the murderer, well... it's just a fucking pizza to people in need, it's a good deed, doesn't mather if he's guilty or innocent.

@@TeSolycMandalor The guy was a drug addict who fucked up, he then spent years on death row having to think about what he did and his imminent death. You don't think it was possible the guy could have possibly changed in those years? Desperation will make men into animals. After spending years sober with nothing to do but reflect I'd imagine the man who died wasn't anything like the man who committed the crimes. But who knows, maybe he was just faking being nice for shits and grins.

Not only are hollow-points less likely to exit a body, but with 45 caliber hollow-points it’s practically impossible given how much they expand and transfer energy. What an awesome legal system we have here in the states, btw. The court is set on executing a person with no solid, reliable evidence.

There are two many factors to say it "can't" exit the body, however when it does, it's taking chunks with it. There would be a difference in a .45 hollow point and .30 ball (00 buck shot) both by damage done and by wound tract or tracts.

@@boldCactuslad why I have impression that you are police officer who shot his mate? With solid case, without tampering, it would be life sentence, not death penalty. With tampered evidences and unreliable witnesses, he shouldn't be convicted - innocent until PROVEN guilty, not innocent unless LOOK guilty. As someone said, we don't have proof that evidences are tempered, but if he didn't shoot, there is no other explanation, at least, shells are removed from crime scene and police officers lied. That leaves case without trustworthy evidences nor trustworthy witnesses. Even if he is guilty, it cannot be proved, thanks to cops, and he should be free. Also, it really matters how the victim died because felony murder rule has really strict requirements to be eligible for death penalty. Accidentally shot by police with instant death would be eligible only if criminal tricked police to shoot (e.g. put mask on hostage). If he was still alive and criminal prevented giving medical care, that would also be eligible for death penalty, but this case is not eligible for death penalty.

I'm from Tennessee, and I was part of a group trying to get Philip Workman's death sentence commuted to life w/o parole when I was in college back in the '00s. It still burns me up to this day.

@@ronrozen2105 Yeah the judge pisses me off the most. I've seen these judges, they lose their empathy because the empirical experience from their job tells them everyone's a liar and criminal. But the thing is if you don't have enough life experience/brain cells to look past and beyond stereotypes then in my opinion a seat in jail would suit you better than a seat in court. If you don't have enough empathy to think through a case where someones' life is at stake then you're more subhuman than the people you're charging with maximum sentences. The bullet wound alone that could not have been from the revolver was enough to throw this case out the window. F this judge.

With the state of the justice and prison systems in this county, it may be more merciful that Workman was executed. Life w/o parole in the US isn't a fate that anyone would want, but people far worse than Workman deserve.

Something I wanted to say...the reason we were trying for life w/o parole was because we saw it as the best-case scenario. See, up until about 7 years prior, Tennessee didn't execute anyone for almost 40 years. But Republicans were starting to gain ground in Tennessee (even though Workman was executed under Phil Bredesen, a Democrat and to date the last Democrat to win statewide office), and they were running on a "tough on crime" platform. The remaining Democrats in Tennessee (except Rep. Steve Cohen, currently the only Democrat left in the Federal government from Tennessee) folded under pressure to be "tough on crime" too. They gained nothing from doing that. Since 2000, 13 people have been executed in Tennessee, with 49 currently on the states death row. And because our current governor, Bill Lee, seems set to execute more than any of his predecessors, it's not gonna end. They've even brought back the electric chair in case the drugs used for lethal injection become unavailable.

As a former police officer, and Marine Corps veteran, I've seen the damage a 45 round does. I carried a .45 as a Marine MP. IF it exits, the exit wound is at least three times the size of entry. Hollow points even more so. What a sad tale of injustice. Wasn't it Thomas Jefferson who said "better to spare 100 guilty men, than to convict one innocent man"? Not only that, but it is becoming more and more apparent as more information comes out that the officers lied in the report and falsified evidence. @@jonathanlunger2775 The bullet calibre wasn't the same so, it couldn't have been him, when he was apprehended, he had the alleged murder weapon on his, and the calibre didn't match, unless he had another pistol (which they did not find) he did not murder the officer.

He only fired when dazed by his injury and that shot only hit an officer in the arm. He was likely not guilty of the crimes he was being hit with so the death penalty was unjust.

The fact that any sane, reasonable person could see this man was wrongly fully executed and not only was the evidence sufficient enough to exonerate him by way of a calibre mismatch and the testimony of a professional “witnesser” whose whereabouts was contested by his own girlfriend and appeared to clearly be lying, here you are defending the verdict to keep him off the streets ( permanently).

The idea police would be shot at and not shoot back is a gigantic red flag that their story is total baloney. FYI: he'd still be guilty of "felony murder" as even if a cop stupidly kills another cop, as it all precipitated from an armed robbery then he is responsible. But felony murder doesn't have the death penalty.

To be more precise, felony murder has death penalty, but only for worst cases which meet strict criteria (like actively tricking police to shoot hostage, active prevention of medical help). Also, if he didn't shoot, evidences are tampered with and witnesses are unreliable. That should lead to dropping charges. If his side of story is true, I don't think it would fall under felony murder. And without trustworthy evidences and witnesses, we cannot disprove his story.

You’ve clearly never been in a prison setting. Let me assure you prisoners are -not- living lavishly off of the taxpayers’ dime. That aside…you can’t walk an execution back. Innocent people have, in fact, been put to death only to find out later they were wrongfully convicted. Lastly, assuming the convicted is truly guilty of their crimes, you need to keep in mind two things. 1) due to the appeals process, it costs MORE to process an execution than life w/o parole. 2) life w/o the possibility of parole is a far more harsh sentence. Every single day for the rest of their lives in horrible conditions knowing they’ll never see the sunrise as a free person.

It’s wild to think not long ago, all it took to get someone sentenced to death was two to three people who didn’t like 1 individual ( and for it to be known they didn’t like him) to lie saying he did something in which there was no evidence for.

As a Memphian, even tho it's been over 30yrs, I gotta say this sounds very Memphis PD. Hell just recently, up the street from my house a squad car ran a red light (just because, not in pursuit), t-boned a family of 3 & arrested the driver for driving w/o a license. Then for about 2hrs, 9 squad cars had the intersection blocked off for "reasons"

The big thing I've learned in my career as a lawyer is that the criminal justice system doesn't take "beyond a reasonable doubt" seriously. People have been convicted on the shoddiest of evidence beyond a reasonable LACK of doubt.

Sounds to me that there is more than enough probable cause here to not only save this man's life, but he should have walked out of that prison on a freaking red carpet! This is just shameful...worse than that even.... and the fact that all he wanted was a lousy pizza delivered to a homeless shelter and they couldn't even do that, says a lot about our prison and justice systems. Shame on them. Even if he did kill someone, it's just a pizza! And it's charity for Christ's sake! Let the man do one good deed! It's really nice that the community honored his last wish and a lot of people were fed that day because of this man. It is nice that something good came out of all of this. It also bothers me about them doing an autopsy. That's not right either. It's against this man's beliefs and religion. It's HIS body, he already even had a court order, they executed him! It's not like it's a mystery as to how he died! There's no ongoing investigation into his death! He wasn't contagious! So what's the point of cutting him open like a fish anyway?!? All senseless and just b.s. reasons get more money from the tax payers. Too bad they didn't spend the tax payers money on the pizzas, something they would have probably preferred their money being used for. I know, I'd rather have my tax dollars being spent to feed the living, than spent cutting open someone the state probably wrongly executed, violating his religious beliefs and vacating a previous court order ruling in his favor. It's gross to be honest.

Contrary to popular belief, they dont grant you whatever you want for your last meal, infact you'd be lucky to even get fast food, most of the time your only granted whatever is normally makeable in the prison kitchen and a last meal isn't even a guarantee, its not a policy prison's are forced to do and its different for each one.

Sadly ironic thing is, if the witness fully recanted and this was still in Kentucky as implied, the prosecutor COULDN'T HAVE charged him with Perjury. 1982 trial and 1999 publically recounting. Kentucky law doesn't list Perjury in its general statute of limitations list, but it DOES have a catchall "not listed 10 years". Federally, it's 5 years for perjury. He could have said he railed a line of angel dusted cocaine that night and lied cause God told him to with full knowledge it was a crime, and there was nothing the prosecutor could do about it anymore. Let alone the public outcry if they tried anyway. But the courtroom isn't the place to learn your rights, and they're under no obligation to tell you them there.

This is such a messed up story from him growing up in a fkd up environment, life spiralling out of control, ending up on drugs, robbing a place, the cops shooting their workmate and the court case(s) being a complete fkn circus. Yep, he did bad for robbing the Wendy's but the system failed that bloke so badly and yet it happens far too often to desperate people, who are failed by the state.

Considering these are US police officers we're talking about here, the moment the claim was made that the police involved didn't fire off any shots beforehand instantly drew my doubt. The law, at least here where I live, is that if someone dies (regardless of how) because of you committing a crime, their death is on you. While I don't think he should have gotten the death penalty for it, he should sure as hell be charged with the murder.

It's true, but also, if he didn't shot, that means evidences are tempered with and police officers lied to court. He should be pronounced not guilty because of lack of trustworthy evidences and witnesses. Without evidences or witnesses, court should have no reason not to believe in his version of story in which he couldn't be held accountable for death that occurred after his surrender. In normal justice system, he would be thankful for police officers which basically destroyed case against him.

It would have never happened if Workman didn't rob the store and shoot at the police. Workman was still responsible either way, so his execution was well deserved. Also it was never established that Workman didn't fire the fatal round. The ballastics experts said he might not have, but they never ruled it out entirely.

@@TheStapleGunKid first, by felony murder rule, he wouldn't be sentenced to death penalty because this case doesn't meet strict criteria to apply death penalty for felony murder. So, no, execution was not deserved. Second, if he didn't shoot, that means evidences are tempered with AND police officers lied to court (they witnessed that he is only shooter, which is impossible if someone else shot police officer and absence of shells means crime scene is tampered; also, lack of ballistic report means that police disregarded procedure which could collect evidence in favor of defendant). With only other witness retracting his testimony, that means there is no reliable evidences and no reliable witnesses. Innocent until proven guilty means he is innocent if there is no evidences nor witnesses. We can discuss our opinion that he is guilty, but without evidences, sorry, but innocent until proven guilty is legal foundation in whole west world. There should be zero tolerance on evidence tampering. It's better to let murderer free than to imprison or execute innocent person. We can have strong opinion that someone is guilty, but if we based that opinion on tempered evidences, that opinion is worthless. Also, police will tamper with evidences as long as court accepts it. Only way to stop tampering is courts having zero tolerance for it.

This is the most asinine thing I hear time and time again. We all know the justice system is flawed. Countless people have been commuted after 15, 20 years on death row, and still happens. As long as we know that the justice system doesn't get it right 100% of the time, we need to get rid of irreversible punishments like death. Just coming up with the most subjective exceptions like "those that truly deserve it" would change nothing. We're already supposed to be sentencing "those that truly deserve it", but it doesn't work like that.

I remember hearing a story of a man that got executed not too long after being put on trial in the early 1900s because the judge assumed he killed his family. What would you do if you could control Hitlers punishment for what he did? I guess he'd probably use his power to get into a rich fancy prison for politicians or be put under house arrest like most dictators do. Pol Pot was worse than hitler and was never convicted. Idi Amin was exiled and lived a nice life in Saudi Arabia. Pinochet of Chile was put on house arrest in the UK. Dictators deserve the death penalty because its obvious they were in control and if not sentenced to death, they'll use their power to get off scott free. But yeah, I don't think we should kill ppl unless we know for sure.

In certain cases its reasonable, especially if the prisoner is extremely dangerous and committed something like mass murder or rape

I was a crime reporter for a number of years, and figure I've attended between four- and five-hundred murder scenes. There were nights I stood over murdered women and/or kids and prayed (despite being an atheist) for someone to pay horribly for this crime. I had to be restrained once during a perp walk from throttling a guy who'd murdered a one-year-old. But I am more rational now. Until we create a perfect criminal justice system, our lust for institutional revenge in this country has to stop. Governments should not be in the business of murder (and no, war is not necessarily the same thing).

See, that's just it. You see a guy who's basically a POS and you think, wow that guy deserves whatever happens to him. But that's what a teenage boy thinks, or a little kid who wants life to be fair. Life is a lot more complicated than "lock up the bad guys." Do I want to see priests who molest children string up by their heels and beaten like a pinata until dead? Of course. But that's the reactionary animal inside me. That doesn't improve society, it isn't justice. "It feels right" is not a justice system

@@skeetsmcgrew3282 Most of that reporting occurred in Texas cities. I live in NYC now and did on 9/11. My overwhelming feeling watching the second tower fall outside my window was a return of that "somebody must pay in spades for this" rage. And once again, I didn't much care who paid as long as they suffered. It took me a couple of months to snap out of it that time. I hope I never lose my ability to think like a rational creature again. I think much of the country, after 9/11 wanted to rain death on some benighted country on the other side the globe, and we weren't picky about which ones. And it went on for 20 years.

Most states have laws that if ANYONE dies, regardless of how, during a commission of your felony, you are still responsible for that death. I still think getting executed for it in this instance is a bit harsh.

Not really. The guy chose to rob the place and chose to shoot at the police. Weather or not his bullet killed Oliver is beside the point. He's just as guilty of murder either way.

@@TheStapleGunKid Didn't say he wasn't guilty of murder, but life in prison seems a bit more appropriate here. Someone still died while he committed a felony, but an officer died so the DA is going to want blood.

@@MrPancake1225ayylmao If he had killed one of the store workers instead of a cop, we can reasonably assume he still would have gotten the death penalty. Murdering someone during the commission of a seperate felony such a robbery usually has that result, no matter who it is. I just don't see why he should be spared when his crimes were deliberate and premeditated. He chose to rob the place. He chose not to surrender to the police when they arrived. He chose to shoot at them. He had every chance in the world to avoid a situation where someone died, but he kept doing everything he could to ensure it would happen.

"Oh but it wouldn't have happened if he weren't robbing a wendies" Officers are expected to respond to crime scenes; it should not be held against the criminal that one of the cops was terrible at his job.

I too, was born on an Army Base, in Kentucky, in 1953. My dad was a Drill Sargent (for a few years) and was got shipped from one base to another 'til i was17. Always being the New Kid in school, suffering a Drill Sargent's discipline, and living in a family of six on a Sargent's pay, I can understand why Workman did not turn out to be a perfect citizen. I guess I was lucky. He wasn't.
