The police officer did not have a search warrant. The officer must leave the property when the citizen told him to leave his property. There was no immediate emergency which would give the officer probably cause to remain on the property. The officer should have left the property and come back with a legal search warrant.

Qualified Immunity does not protect police if they are in the wrong. It ONLY protects police if they are acting within the law and if they are acting in good faith. This means if a cop acts within his scope of duty, within the law, and with good faith the cop has immunity from lawsuits for damages unless the plaintiff shows that the official violated "clearly established statutory or constitutional rights. It does not mean the cop can do whatever he wants and get away with it. Like most think.

If this was an arrest, what was the charge? I did not hear him tell the citizen he was under arrest. If he caused him to have a heart attack, he may have influcted permanent damage, and is totally liable for damages. Just because you somehow got a badge, does not give you the right to violate others' rights and harm them.
