The cop seems like he's about 1 inch away from being a good cop. Seriously. After the guy is in the car he seems to basically talk with him earnestly and he seems to want to follow the law. The problem is he went hands on before getting the facts straight first, and he gave the guy 0.0000001 seconds to comply. If he could get retrained on those basic points he could be a good cop.

Incorrect. They were going off the basis that the property owner had wanted him trespassed. Because that was what they were told by the person that rented the part of the property for their business. That is why you hear the police officers asking for confirmation from the property owner. You also hear that the people in the business that they didnt want him inside said he entered their business after he was trespassed from there. So the police acted on the information they were given, even if they were false reports, that's all the information they had to start with, so they had all the RAS to detain him until all the information was found out.

Hoping for an answer, I’m knowledgeable and very safe thinking, but not a lawyer. Having knowingly not to have broken any laws, would this man not have the right to defend himself? Before a lot of people castigate me, I’m not opposed to law enforcement. However, this falls under the definition of assault as so I interpret the law. No law was broken, the government employee was out of his jurisdiction and acting as a private citizen in his actions. I’m guessing the pass is allowed because he was “on the clock”? But even then it was unlawful.

Got to love how cops constantly get order of events wrong when they put in their report... They especially get the order of events wrong in the heat of things. No officer you did not tell him to put his hands behind his back and then he turned to face you. You started to walk behind him reaching for him before you had even said anything about putting his arms behind his back. It is absolutely natural when talking to someone to turn with that person so if you start walking behind him while you're trying to have a conversation he's going to turn his body to face you. But in the officer's head he intends to tell you to put your hands behind your back and so in his brand he has already told you even though the words haven't come out of his mouth.

And the protester had 1 sign in each hand. The cop spun him around and escalated immediately to get his jollies. I hope he doesn’t end up in jail cause the homeboys in there will treat him a lot nicer than this protester I’m sure. 😐

Unfortunately lawyers and civil rights agencies are just about as corrupt as some of these police officers. They steal from their clients and purposely cause them to lose their case because they make deals behind their backs. They done myself and many others who I've spoken to this way and it's a shame and pathetic.

Other cops need to start checking each other. If they see an obvious case like this they need to step in and de-escalate. Even to the point of placing the other officer in cuffs for assault and battery. Don't just let this bad behavior go uncontested otherwise you become an enabler and appear to endorse it, subjecting yourself to liability and prosecution.
