For officer safety purposes you have the subject keep their hands out of their pockets. I've actually seen someone take a Swiss army knife with a tiny 2 inch blade and stick it straight into the heart of another person who died instantly. That's how we work. You keep your hands out of your pockets. You can say all you want you ain't got nothing. That is until you pull an edged weapon out with a razor sharp blade on it like they did when they took over the planes on 9/11 - a box opener - and slit my throat. When looking at the registration numbers on the vessel how are you going to know if they're legit if the boat captain won't show you the registration as required by law? This Captain brought more hate on him than maybe he deserved. He could have stopped it just by showing his registration and been done with it. " I was reaching for my driver's license..." only after the handcuffs were going on. Looking at an objectively, there was something going on with the individual on that boat and that he would not make direct contact with the officer and would not follow directions given to him. He seemed hesitant about contact being made with him. That would spark my curiosity as well. If you don't have anything to hide, don't act like you're trying to hide something.

Operating a boat is a bit different than driving a car. You can be inspected at any time (for no reason) while acting as "captain" of a boat. Dude could have given his driver's license to the officer, then enjoyed a fun day on his boat after likely receiving a written warning for not having his registration on board. Here, the reg sticker was affixed to the boat legally. FWC officer could have simply verified the doc. The resisting will probably get dropped. As officer gave him no warning that he would be arrested before jumping on the boat and attempting to restrain the man. He's 60 -- and MAYBE his reaction time was a bit slow to respond to physical encroachment by the officer. IN any event, even if I agreed with you, once LEO verified all his info, he certainly didn't have to cart the man off to jail. That was ridiculous.

Even a LEO on the road has to have I.D. to log you in the system even for a verbal warning, no different with a vessel and FWC LEOs. Turned a written/verbal warning into two actual charges, loss of a $300-$500 charter, and his charter license. He probably would have shown it because he seemed to do the exact thing when it started to go down. Now I'm not going to say. I know what that guy would have done dumb. But that's my guess. At least I do feel like the officer in that case. It was a little bit too harsh. Honestly, it's more than a little bit imo. @@HurpMuhGurp The cop started a very calm conversation that led to a couple of calm and reasonable request. Starting at 1:26 he simply asks if the guy if he had his registration. That was a lawful request. Then there is calm back and forth but the guy does not want to produce an ID (also lawfully requested). I'd bet the cop was getting a sketchy vibe while the guy appears to be avoiding eye contact, looking around, like someone that is trying to figure out how to get out of there. But then the guy starts a staring contest or something (what was that about?). He never offers his ID. Put his hand in his pocket - during that back and forth he only refers to money being there. Never produces, nor says he will produce an ID. When the cop has had enough and goes to slap the cuffs, all of the sudden, "You wanted my license, I was getting it out of my pocket..." line of BS. I have no problem with people asserting their rights with cops. A lot of people scream "I know my rights," but they don't. A fish cop can inspect you boat. Florida fish cops are state cops, and can demand to see your boat registration in additions to life jackets, fire extinguishers, sound producing devices, and if applicable, your fishing/hunting license. If there is reasonable suspicion that you may be in violation (this is not the level of probable cause yet) they can require you to identify yourself while they investigate. You don't have to tell them where you're going, where you've been, what you were doing*, for how long, how much you've had to drink. But you better know the nuances of that game if you don't want it to backfire in court. For example - I don't know what the requirement is if I was out fishing. If you have fish/game on board you probably have to tell them and allow them to inspect it. This guy turned a warning about his registration in to an arrest because of a chip on his shoulder. I don't feel sorry for him.

This is an old timer who basically doesn't have the time for BS and silly questions. So he gives FWC a little attitude. And then of course, the officer is not going to have it. You can here at the end, when he's on the phone saying, he was just going to give him a warning. But the answers where not what he likes, so you have what you have. He approaches because at 1st he sees no FL numbers. But then they are there, just under the gunnel line. Then are you going fishing? Does it really matter? Is this a check point to find out why I put the boat in the water?? Its all BS plain and simple. But don't want you to talk down to them.

USCG and most states do not require an officer to have reasonable suspicion of a crime in order to stop and carry out safety and violation inspection on a motorized vessel. They can stop a boat on the water at anytime and require proof of registration, life jackets, throwable, horn, etc etc and they must be shown. So he legally had every right to ask for his registration and then license. This dude obstructed by not providing. Fair or not the LEO had every right to do what he did. Dude didn’t comply at all until he knew he was in trouble.

While boating on the St. Johns in Volusia County a deputy pulled up along side to do a random safety check. Me, my wife and 2 very young boys were in the boat. My wife was at the helm, which was unfortunate for the officer. She thought she had the motor in neutral but it was slightly in reverse and our prop took a chunk out of the sheriff's boat. His fault and she was not ticked. Of all the drunks on the water that day, why did he have to snag us? Waste of time.
