@CBourn482235 ай бұрын
Guess they didn't teach you not to make a judgment until all the evidence is presented. Here's some fun questions for you counselor. Are officers required to survey an area for ant hills prior to placing a resistant and non-compliant suspect on the ground? How much time should an officer be given to identify and determine if an ant could possibly be dangerous, while wrestling with a suspect and long does it take to sustain 300 bites from an ant colony?
@DragonLawyer5 ай бұрын
@@CBourn48223 i believe the reasonable person standard of care should be applied: which is the amount of care and caution that an ordinary person would use in a given situation. The reasonable person standard depends on the situation. So applying such a standard of care: 1. no an officer is not required to survey the area for any hills prior to subduing a a non-compliant suspect. The take down of the suspect I find no legal issue with. 2. A reasonable amount of time should be applied for how long an officer has to determine if an ant is dangerous. What is reasonable amount of time? I think the officer(s) would have been on notice of the danger at the time the suspect was screaming in pain “ANTS ARE ON MY FACE!” while her hands were cuffed behind her back. A reasonable person at that time would have moved her away from the ants and the officers failure to do so while continuing to watch her scream in pain is where I would consider it torture and the officers who failed to act be held liable. 3. The number of bites I think may be important at trial when determining overall damages but as to the officers liable I think the amount of time they let the suspect continue to be bit after her first outburst screaming in pain would be the most relevant evidence.
@slendergollum5 ай бұрын
@@CBourn48223 So.. you are one of the cops in this video. If theres a face full of ants, you dont need to do a survey, you need to protect the criminal (in this case, the victim). If theres 5 of you and you just watch her face burn, youre a cop. Where was the non-compliancy? Wherw was the wrestling? 300 bites? @TNAROHfan5 ай бұрын
The thing about that statistic too, is that it was self reporting. So 40% of the cops had the balls to reply they had engaged in domestic violence, because they knew nothing would be done to them. What about the other unknown percentage of abject cowards who didn't reply that they had engaged in such activity? I would suspect that it was vastly underreported. Every cop I have ever known has had the behavioral characteristics and personality of a bully and an abuser. I recognize it all too well, because my ex fiance was a malignant narcissist, who shared many of the gaslighting and verbally abusive traits. Not physically abusive except for one time when she threatened to kill me in my sleep because I saw her cheating text logs, but I could see her having violent tendencies on someone who she thought she could physically get away with attacking, who didn't outweigh her by 100 pounds. I didn't realize it at first, but the more I learned about her, the more red flags I saw, particularly her behavior towards other people, when she didn't get her way or felt slighted. If someone loses their mind at a waitress over a simple mistake, or starts looking to cause sh#t and put your significant other in physical danger because of it, you have a problem.
