Correct, 'Officer safety' or 'reasonable suspicion of committing a specific crime' are the only legal reasons to order anyone out of the vehicle. Mind you these cops screwed up in other ways. The cop declaring he was going to prolong the stop until they did ID, telling them that the passenger's refusal to ID was the true reason they were issuing the driver a ticket.

The courts have ruled that passengers are just as detained as the driver... And if the laws says people must ID when detained then passengers must ID. This is why it's important to know the laws in your area.

14:34 The cop really said “this is going to be a long traffic stop.” Rodriguez v US states that a traffic stop becomes unlawful if it is extended beyond a reasonable amount of time. Criminal and civil violation. Then threatens that since the kid wishes to be secure in his persons, papers and effects under the 4th amendment, he is going to retaliate by giving the driver a ticket. Another criminal and civil violation. Major lawsuit and complaints were hopefully filed. If that cop was not disciplined that department should be investigated.

The Civil Rights Lawyer channel has covered about cops coming onto private property. Yes, they need a warrant to search. If to arrest a person on private property, they need to get an arrest warrant if there is none. He is currently suing for a client and looks like they will win. Courts ruled in this case, there is no qualified immunity as cops should have known they have no right to search without a warrant, and must get a arrest warrant before arresting somebody on private property.

Never apologize or grovel for using your rights! Don't explain what doesn't need explaining, and don't tell a cop what the law says. Just put what questions serve you to them, and keep after them for answers. Take charge of your business. That business with the police would be to appear completely non-threatening and to talk calmly without a raised voice. (1) Record the interaction (2) Detained? (3) Why detained? (4) Silence.

a few years back, a town LEO attempted to confiscate my walled with my ID in it I would not surrender. We had a tug over it and he lost. He pulled his taser threatening to shoot. I called his bluff. All charges were dropped AND he looked like a total ass. they settled with the me afterward.

The cop that gave the driver a ticket because his friend wouldn’t ID…take that video to court. If his lawyer is any good, I hope he would ask the cop “so you’re main concern is compliance rather than public safety?” So obvious. I’ve watched that video before. And my feelings about it haven’t changed…it still makes my blood boil. Seems to me all the boys were very respectful as they tried to stand up for their rights. And it still wasn’t enough for those tyrant cops.

@@ictpilot I would love for those kids to sue, but you do know that the payment that the victims get is from OUR taxpayer monies? The cops don't mind getting sued because they don't pay for it. Nothing happens to them. It needs to come out of their pensions or they need to carry liability insurance and pay their own premiums. As more lawsuits accrue for a cop, his rates go up and eventually he can't afford do be one or he changes his ways.

The most irksome point with this is that if the driver takes this to court, his lawyer's bill will be more that just paying the ticket. Not to mention that you absolutely know that all charges will be dropped just before his hearing.

Then you turn around and sue them for attorney's fees, lost wages, costs associated, and for violating your rights. You'll get your payout if you can come up with the initial retainer for representation. But they hope you already feel defeated and will just pay them, shut up and fear them so you "know your place". You can't give in to their harassment on principle. You're correct that they make it costly and seemingly insurmountable intentionally, and it's wrong. Video, video, video!

Every time a cop says "I've had calls on you" That's always a lie to trick you into letting your guard down to violate your rights. So when they pull that tactic state to the officer "I invoke my right to face my accuser if refused or denied then your claim is false and this detainment is unlawful and you will be hearing from my lawyer"

Exactly. They get arrested for what happened AFTER the initial stop. They never get convinced of other crimes. They're just excuses to make money off of the justice and prison system. You'd be surprised to know the amount of unpaid labor prisoners like them do. It's just to make money off of people just living their life's within laws.

A question to cops: if a person makes a call to dispatch do you investigate the caller at all? Fun fact: qualified immunity does not protect you against NOT being punished, it protects you FROM being punished. This matters because if you need immunity from a punishment then that means you’ve done something to deserve that punishment, tldr qualified immunity is an admission of guilt and a pardon from punishment.

The police will never stop pushing the limits or crossing the line when they're practically unaccountable. They'll fight, in every way possible, any new proposals by lawmakers which limit their power in any way, although that's what is needed to make them accountable. Lawmakers are very hesitant to introduce anything concerning law enforcement because they'll lose union support ($$$) and the police votes. The DOJ doesn't do near enough to control police. This leaves We The People to make changes, to force changes. It's not hard to see that's where we're headed. Every time a rotten cop mistreats someone it moves us one step closer to the day the public decides they've had enough and it's moving at a steady pace.

1st video - I've watched it several times and I am always pleased at how articulate he is about the law. The cops ALWAYS want you to prove you are NOT guilty of a crime, but THE LAW says they have to have a REASON TO SUSPECT a crime before they can investigate A PERSON. In a place where carrying a firearm is LEGAL FOR MOST PEOPLE, carrying a firearm isn't a reason to suspect a crime. 2nd video - What happens next: It cuts out right at the point of Chris's arrest. He sued them for that civil rights violation.
