As someone who’s job it was to review bodycam videos, the number of private parts I’ve seen because the officers forget to deactivate their cameras…I’ve always wondered why they remember to do it when doing something wrong.

Exactly!! At the station, when the cop found out he had the wrong person, he took the person back to the storage facility. Upon his leaving, I would have said to him, "Thanks for the lift back. See you in court". The entire reason this happened is because the cop was too lazy to do his job properly.

It's like how you remember your doctor visits or encounters with celebrities, but you're just one of MANY that they see, so they don't remember them. Likewise, most people have few to no encounters with cops, so each one is a MASSIVE deal to them, but for cops, they grass people up every day, so it's just another Tuesday. 🤷

It should be turned on by the supervisor at the start of the shift and turned off by the supervisor at the he end, the officer should have no control over it at all. Until then any officer who's bodycam was found to have been muted, turned off, or lost. That case should be immediately investigated, and the officer held accountable.

Lol I felt bad for the guy because I assume that was his first time, and man that must be extra scary. You're in a new town, the cop does a My Cousin Vinny where you don't even know what you're being charged with and he wont respond, and then he gets to the jail and there is an ominous tortured moaning coming from inside that sounds like someone turning into a werewolf while giving birth simultaneously. He had to be shook, and I don't blame him.

Yep this is why COPS shouldn’t be asking for id unless they have a reason to demand it. Just because the government(public schools) failed to properly teach people their rights does not mean that the people fail when not standing up to the government (cops)!

Yea but YOU gotta understand what you're allowed & NOT allowed to do with this. In my State if you're under investigation you MUST display your ID & CANNOT refuse. So you'd have to know to ask the Officer if you're being detained & under investigation. Mess this up & you can be arrested over it.

Once again muted body cams! This is the biggest problem I have with cops! They should not be able to mute their cams. They like to do this so they can talk freely without been caught doing illegal stuff that they like to do!

Police not muting or disabling bodycams can be a double-edged sword at times. I forget the details of the case, but there was an unmuted and, strangely, unredacted video of a detective using the head. It wasn't graphic, but definitely awkward. Turned out he was a "wadder" rather than a "folder".

If it’s during an arrest or an interaction it should be considered a bigger infraction or at worse a crime. Some sort of nuance

You could even be arrested for that! And you can't claim ignorance if you messed up like that. But for them, nothing. Cost the taxpayers hundreds of thousands and half of them don't even get a slap on the wrist, some even get promoted.

What in the F is the point of a body cam if they’re just going to mute it when they feel like it!? Shouldn’t even be an option for cops to mute, turn off, EVER! IF something needs to be kept private concerning the CITIZENS privacy, it can be done after. EVERYTHING else the cop is doing needs to be 100% transparent.

Body cams should be required to be on and operating the entire time during an encounter. And should have to stay on until the officer goes on a break or ends his shift.

@@skillethead15 the policy, no, the law should be….once body cam is activated at the beginning of the shift, it shall not be turned off, muted or blocked in any manner at any time. It’s entire content must be available to the public, aside from private information of private citizens. Any tampering or editing results in immediate dismissal AND charges to the person in charge of that audio and video.

To be fair, they're in the wrong to one extent only. "Do you have any proof?" Proof of what exactly? Suspicious activity isn't a suspected crime. Answer should have been "GFYS."

Had almost the same thing happen to me when I was a teenager. Cops picked me up and tried to question before calling my dad. They thought I was a guy with a somewhat similar last name. "Negligence but not with malice" is the exact right description of this. The cop was respectful, patient, and was fast to remove the handcuffs and free the man as soon as he realized the mistake. However he failed to investigate properly, didn't pay attention to important details, didn't listen to the suspect, and then falsely blamed others. In a weird way I wished our legal system was improved to such a point such that these were the types of situations we were normally encountering. Instead it typically is with malice/power-tripping/cruelty. :(

If you start to challenge the police, stiffen up a little bit, that's when police start to get violent. If you could add some "injuries" to the lawsuit, your payment will be much higher. However, you do have to walk that fine line of not breaking the law while doing so. That's why recording is a must

They do it all of the time. They held a very attractive blonde in custody for two weeks because they thought she was the black haired meth dead PICTURED on the warrant . They never looked at the middle name on her license nor her DOB. A man was taken on a warrant and was never booked or anything but held for weeks even after proving by ID that he wasn't the guy with a warrant. He lost his job because he lost his security clarence he needed for work.

It's unfortunate that if he were to refuse to identify, he could have been unlawfully arrested for "obstruction" or "failure to identify". Or whatever reason they conjure up. I hope he wins his lawsuit. Best of luck sir!

If I'm on the federal civil rights jury, my damages "pay scale" says getting placidly cuffed and stuffed is worth a minimum of $1,000,000 plus attorney's fees and court costs. Had he stepped across the jail threshold, that price tag would have doubled, so the county dodged a bullet there. This pay scale is calibrated based on the woman and her child getting who got violently cuffed and stuffed at the Starbucks receiving $8.5 million. I no longer give a shit about the taxpayers footing the bill---they are the ones who elect the politicians who allow this bullshit to go on endlessly, so screw 'em. I no longer give a shit about disciplining or punishing the officers, as if the "discipline" of a two-week paid vacation is punishment, and i the end the blue line gang of thugs will take care of its own. The only concern for me is just compensation for the victim whose rights were violated.

They limit what you can award as damages. You can make up whatever the hell you want but they won't have to pay it. The judge will instantly reduce it. Do you know why cops all make the same contempt of cop arrests? Because those minor charges are practically lawsuit proof. They know if you go see a civil rights lawyer your lawyer is going tell you sure you can sue for this very obvious violation of your rights but it will cost you tens of thousands in lawyer fees to win a couple grand tops in civil court. Sure you can get lawyers fees on top but it's a big risk for the lawyer. Most lawyers won't even take the case because if they lose they are out thousands of dollars in work. Even if they win the jury or judge might not award lawyers fees so they just spent years on a case for nothing. The system likes it that way so even lawyers are afraid to bring cases of obvious police abuse. The system is way way more broken than anyone can imagine. It's broken intentionally by the people running the system. They want it unfair. They work really hard to keep it unfair. It's so broken there's no quick fixes and anyone telling you if we just do this one thing everything will be great is straight up lying to you. People like to blame Qualified Immunity. Even in states that have removed Qualified Immunity nothing changes because the system is exactly the same. Suing a cop personally is exactly the same as suing their department. Well not exactly, judges give cops way more leeway when they don't have QI protecting them.

LoL your funny. Maybe your unaware but "mens rea" is required for those charges. Meaning he must have done it with intent and provable beyond reasonable doubt intent. If this can't be proven only negligent laws apply.

@@jbcfamily4802 That's funny, when cops do it, intent is all that matters. When a citizen does it, intent is meaningless. So if I drive my car and didn't notice the headlight was out, does that mean I can't be charged because I didn't intend to. If I accidentally fire my gun and it hits the neighbor, does that mean I shouldn't be charged because I didn't intend to hurt anyone.

@@frotobaggins7169 Those aren't criminal offenses they are traffic offenses. "Men's rea" is only applicable to criminal charges. Although negligence is criminal as well, its very definition implies it was an accident. Therefore, men's rea isn't needed. If your gun goes off by accident then it just means you won't be as severely punished. The cop at best could face negligence.

Same happened to me in New Orleans. I locked my keys in MY car and was trying to coat hanger it open. In broad daylight, for like more than an hour. I was low on money and couldn’t really afford a locksmith. After a while I hear a cruiser screech to a stop behind me, guns drawn. I try to explain that it was my car, they cuff me, no Miranda, and tell me that I had a warrant out of Baton Rouge. I’ve never been to Baton Rouge. They left me in the car for 2 hours. Then they called a locksmith (that I was charged for) to see if it was indeed my car. These are things why people distrust cops.

Having a very common name sucks sometimes. I've been arrested in a very similar situation of mistaken identity. All three names match, date and month of birth matched, wrong year. Its 6 hours out of your day you never get back. I was even more shocked when I seen on the police computer there were 16 other people in the same state with the identical name and all within a 10 year birth date range of mine.

This same exact thing happened to me. I was arrested and the officer said I had a warrant. I knew I didnt and I told him that, he proceeds to arrest me and while they were booking me then they realized that the guy had a different birthday, same first and last name, not the same middle name. And this guy was 40 years older than me. The officer said dispatch made the mistake, but I now know who really messed up. Its basically the same exact situation that happens in this video.

He didn't even admit that it was his fault, he blamed dispatch. He kidnapped this guy and took him to the gates of hell where someone was screaming in the background. So many innocent people hurt by their failure to accomplish simple tasks.
