@FoldupKibbles26
@FoldupKibbles26 Жыл бұрын
@@shannonp4037 I vaguely remember that. Think the argument was you're not under arrest until after the officer has physically controlled you. So "You're under arrest." really meant "I'm going to place you under arrest, but the actual arrest starts when you got handcuffs on.". Could be misremembering that bs case though. Remember the cops that were chasing another car using lights and sirens, and the car flipped over and caught fire but the cops just turned down a street, said they had it coming and didn't render aid or call an ambulance? Courts said that they didn't have a duty to render aid since the suspect wasn't being detained. Lights and sirens mean pull over, I'm gonna detain you, but since they never actually got to the point of putting him in cuffs he wasn't technically detained so no aid was required.

According to the Supreme Court, the ONLY people that must be protected by cops are those already in custody! For example: If they arrest you, they must protect you. Put on your seatbelt in their squad car, make sure the A/C is on, ask you if you need medical attention. They don't normally even WANT to get you medical attention, because it means they have to wait longer to take you to jail. This exact thing happened to me about 15 years ago in Richmond, VA. Sitting at a red light at 11:30pm when three cruisers just appear from all directions and block me in at the light. A bunch of dudes jump out with guns drawn and then before I really processed it all, the biggest cop I have ever seen in my life pulled me through my driver's side window (the door latch had broken, cheap college kid) like I was a tiny doll. Laid face down in the middle of an intersection on the Northside while cops pulled up from every direction and jumped out to assist. Eventually they stood me up and held me against the cruiser while they radio'd dispatch for the description again. Black male, short hair or bald, late 30s to early 40s, 5'6" - 5'8", 150lbs, red hoodie and black shorts. Me, a fluffy 6'2" 230lb mixed dude in his early 20s with a big dumb brillow pad for hair, that shitty 20-something beard we all try to grow, dressed in formal attire for a wedding I was working. That was a pretty awkward five minutes waiting for a supervisor to come and explain to me that their suspect had broken into multiple vehicles that night and was thought to have stolen a vehicle that was "identical" to mine. As he showed up it came out over the radio that they had apprehended the dude about twenty minutes earlier in another part of the city. I'll never forget that cop tossing me like a ragdoll. I was not a small guy. This was 15 years ago and ever since then I've often wondered how many people have had similar, inexplicable experiences with the police. Every time I see something like this I'm reminded of how baffling it was to hear the tiny voice on their shoulders squawk out the description of a man who I most certainly could not be. Nothing ever came of it; I got a letter in the mail a few weeks later from some sergeant in public relations or some shit thanking me for my understanding. I was maybe 19 then and stuff like this wasn't as publicized so it didn't seem like something worth keeping. I wish I still had it, but you can only wipe your ass with something so many times before you can't keep it anymore.

In the back of a police car wearing hand cuffs. You can’t tell me that is not under arrest. I really hope this young man launches legal action. If they think they can do this and get away with it, they will do it with anyone. This town has to take a hard look at the personnel they choose as their police chief. He is definitely not qualified for the job. To the young man, I give you an A. I will add a plus to that A if you take legal action.

Of course, this only applies to civilians. If a cop is the one that gets arrested (after the other cops try everything they can to avoid arresting them), then they'll continually remind the cop that they have the right to remain silent and that they can get a lawyer and everything else they can to help them. Remember the video of the drunk cop who pinned that kid between their vehicles? 😒 And this is if they don't just outright let them go like the one where the drunk cop crashed into a cemetery and lied about his non-existent cousin being the driver.

@m true. That was way more prevalent in the old days. Now, officers lose their jobs ( most often), especially now that everything is recorded. People get the idea that it is the norm because of KZbin. I'm glad that the stigma of arresting a fellow officer has changed since I started in 1987. Used to be you hesitated because someday that guy may be the one saving your life...or not. Remember all the older movies where the cop who arrested another was ostracized by all fellow cops on the department. Now, the bad cop is ostracized. Takes a lot of worry from attesting officers

"He’s just being difficult.” I would have been more difficult by asking for a case number and their business cards before filing a complaint referencing their policy handbook. The authorities don't care that they violate rights or laws, but they seem to care very much when their policies are violated. I'd publicize the "detention" by posting it on the interwebs, then seek out the greasiest shark lawyer I can find before, of course, filing a lawsuit!

I didn’t find they’re detaining him to be unreasonable until they learned he wasn’t the guy. They walked as slow as they could to the cop car and kept him in handcuffs while showing him a picture of the real perpetrator instead of apologizing to him and handing him his phone they say your phone is on the hood of the car! They should have gotten his phone and offered an apology and told him that he has a right to file a complaint if he sees fit and then tell him the most expedient way to do it. No wonder the public is opening their eyes and gaining a hate for these lazy, unprofessional and rude police.
