The OP definitely should have sued Karen, the HOA, the police that enabled her while violating OP's rights and the city in order to ensure that she's put in prison for her illegal actions, the officers are punished and forced to go through training on legal procedures and the HOA be forced to disband permanently.

A DEED for property is nothing more than a receipt. It means you paid money to someone who may or may not have the legal authority to SELL the property. A TITLE may or may not show the seller has the authority to sell the property. A WARRENTEE DEED and ABSTRACT legally PROVES YOU OWN the property and it was conveyed by LEGAL MEANS. I've lived in my house 39 years and the estate holders weren't going to provide me with an abstract. I replied "Then go pound sand." My Mother died two years ago and her "trust attorney" sold her house and contents without ME (the only heir) signing the Abstract. He'll get out of FEDERAL PRISON for wire and mail fraud in 2035, maybe. I owned his boat, lake house, house and clothes I sold at a yard sale. The Judge forbade him from ever having $3500 worth of personal goods after his prison term. Federal Prosecutors call it "The Head Shot" for crooked attorneys.

How do you go about getting a warranted deed? Is that something a realtor can provide u with or do u need to go the courts for it? I thought the title was the abstract & isn't the deed physical documentation that u own the home. I know as a homeowner u should have both the deed & title, just not sure what a warranted deed is

That Karen definitely overstepped her bounds. Military dependents are GUESTS of the military. As such they have no rank or authority and can be kicked off base at any time. Their spouses are responsible for their conduct and can even be demoted if the offense is severe enough.

Whoa! I am struck by how well you articulated the "police experience". That was cruel and brutal, demonstrating that they could care less about basic fairness and justice. I was also struck by how you captured the story because it is the exact same story of an insane number of innocent men of color encountering that same response to someone's lie. 9 times out of 10, ... if their cases had gone anything like yours' .... for them, their world is trashed - gone, and if you happen to be poor, you will be railroaded straight to prison.

I have NO use for law enforcement. Years ago, I was wrongfully arrested and spent 4 days in jail. The accusers (former employer) told police they had camera footage of the alleged crime. The police never saw the video. Two of us were arrested because the employer said they had a video and would bring it to them. They didn’t have a video because there was no crime therefore it never existed. Didn’t stop the cops from tossing me in jail. The missing items were found 2 weeks later at a sister warehouse. Instead of going to the police and admitting the mistake, I had to fight it in court for 4 years. It took 4 years to get the case thrown out of court. I should have sued all parties at the beginning. Instead, I waited to get the charges dropped and by then, the statute of limitations in my state had passed.

The base CO watches from his office window with mouth agape as Pvts go leisurely around, wasting time, saluting every stationary unoccupied vehicle. He is furious and soon learns why. He calls the Major's wife and Lt together in to his office, and tears both a new one that the staff outside enjoyed and would quote for years to come over glasses of liquor. For the first/title story. When the cops were called the first time. Even though OP had proof that what Helen was saying was a lie. They decided to make him the bad guy. OP should have requested a supervisor come down there as the supervisor would have looked through the evidence and made the decision that Helen needs to stop harassing OP over this stupid HOA land BS or else she would be the one in trouble with the law. And the second time. That right there is enough for a lawsuit since the cops just arrested OP for no real reason. Just one call for someone with a gun. For a call like that. The cops are to search the area with their guns drawn. Then, in this case, confirmed that it was a false call. They are supposed to ask around what happened. And Helen would have gotten herself arrested for wasting emergency service resources and filing a false police report. But since they didn't do any of that. That opened up the department to a lawsuit. And I wouldn't be surprised if those cops would have gotten demoted a couple ranks for their stunt.

That's one of the things cops don't like people knowing is required by law. Because when they screw up they don't want their boss knowing they are doing something stupid, or more probably illegal. Because legally if you know they are screwing up, and ask for a supervisor they have no choice than to contact, and have one show up immediately.

Friend of mine has family that's pretty high rank (not "general" but still pretty high on the base) in the military, we once talked about "abuse of rank" and he told me that whenever there's a new officer (dosen't matter if it's transfer or promotion) on base, one of the things he is personally teaching them that not just themselves but also their family, spouse and friends better not try to abuse the rank of the officer or it will be seen as the officer abusing it personally and they will be reported and busted down so fast they will think they just got assassinated.

If that 1st story was true, how do the officers involved still have jobs. They should've been reprimanded in the 1st instance when they turned the tables on OP just bc she burst into crocodile tears about harassment yet had no proof. The 2nd time they showed, which btw why were they already there, as soon as they saw that he had no weapon she should've been arrested for a false report, harassment & threatening OP with a weapon bc of the mase. Unless Karen had something going on with 1 of the officers or was related to 1 I don't see how this should happen. The whole story just seems so outlandish, but if true he should've called the FBI to come in & investigate their entire dept. Also I know ppl are quick to jump on the sue bandwagon, but in this case I definitely would, to ensure that all the officers involved in this fiasco would be have charges filed against them or at the very least be fired from their jobs. I know there's crooked law enforcement out there, but this just seems insane. The very instant that some other person (not even an official representative) starts making claims about property boundaries, you need to take action. Get a discrete body camera to record your interactions, and have security cameras recording the yard. This will prove the false accusations of bullying, and also the prolonged pattern of trespass. Someone trying to take even one molecule of your land is theft. If an entity like an HOA allows this even tacitly, let alone actively, Then it is lawyer time. Request from the courts all records of previous cases for the person and the HOA. Bring your evidence to the court through your lawyer. The HOA should be heavily fined. The officers of the HOA should be fined, and charged. The "HOA Helen" should also be fined and charged. Due to the deliberately criminal actions of the HOA, it should could, and should be dissolved. Any officers of the HOA when this actions were happening need to be criminally charged, and prohibited from server on the boards, or as managers or directors of any association, club, business or volunteer organization for a period of at least 20 years. The police department and it officers need to lose any "qualified immunity", and the court have a dissolution pending, so that ANY injustice will close down them. This will also set a precedent, so that other HOAs that abused their residents can be instantly disbanded if they break the law.

Can someone please explain to me (German) why Homeowner Associations are even a thing in the United States? As far as I understand the American mentality, you guys really, REALLY, value your rights and personal freedoms. In fact you value your personal freedoms so much that even things like having health insurance are not mandatory. And I’m not even talking about things like the Right to keep and bear arms. I’m not criticizing, I’m just saying that you guys value your personal freedoms a lot more than most countries in the world. But how do Homeowner Associations fit into this picture? How can you guys, who are strictly against any ever so small violation of your personal freedoms, be ok with some random organisation deciding what you can and can’t do on your own property? HOAs seem to me like the most un-American thing ever.
