One of the great lies HOAs always try to pull: 'Everyone in the area is automatically a part of the homeowners association'. Only problem is that state & federal laws don't allow HOAs to just decide that properties that are clearly outside of their boundaries or were purchased prior to the formation of the HOA are under their control. That is classic HOA overreach, and there are tons of stories out there where HOAs tried to pull that stunt, only to find themselves on the losing side of a very expensive lawsuit.

Exactly, ESPECAILLY when it comes to the cases of an existing property and a new housing development with a HOA, unless the owner of the existing property agrees to join, there is basically a big wall between them and the HOA has nothing to say about what happens "on the other side". There needs to be much more oversight when it comes to HOAs if they can get away with shady stuff like that, not to mention the possibilities for embezzlement and power abuse. First of all their bylaws should be required to be reviewed and signed by a lawyer and goverment office that have all made sure none of them violates existing laws (one example is a HOA story where property owner gets fined for his satelite dish, but state law had it that NOBODY has any say in where the dish can't be, if the company installing it says "this is the best spot" then that's where it can be placed and HOA has NO legal say in the matter). There's also a HOA story where "president Karen" admits to the judge that they (the board) voted on making OP a member (forcing him in / annexing his property) and the judge destroyed Karen and the HOA, because that's not how it works, imagine that, the higher ups of some organization sit down and say "that person is hereby under our juristiction, dosen't matter if they want to or not", her defence was that "their bylaws allowed them to do that" (one more example why said bylaws should be reviewed by actual legal professionals, not just "voted in" by a selected few)

Why do people wait to get dozens of letters from HOAs without even writing back to declare they are NOT part of the HOA? When the HOA shows up in person, why not call the lawyer then?

Here's an advice, contact your lawer, have them write a letter to the HOA stating that if they try that sh*t again they will be sued (AND you should follow up on it), also, save every letter and install cameras (prefebly with audio recording) so when they show up at your front door (or try to do anything to your property) you have evidence

@@animejacob Oh, I know why the HOAs behave this way. I just don't understand why property owners don't do more to assert their rights. That should be done early and often. At a minimum send a certified letter and/or email clearly advising that your property is not part of or subject to the HOA oversight. It helps establish that HOAs are acting in bad faith and/or harassing the property owner if they continue making demands.

No don't call a lawyer, first have them "trespassed" according to your state law. Then call a lawyer. The story is always the same OP plays nice HOA escalades they go round and round till OP invokes there GOD given rights. Soooo why not start were these things always end.
