I am an insurance adjuster and I'm telling you that 100% that is what's known as a word vs word because there is no independent witness and there is no evidence to prove either story is true. A police report in no way makes an adjuster's decision for them. A good adjuster will only use a police report as a way to obtain evidence and contact info, but the cop was not there so he only has the story of each party which means the cop knows no more than anyone else. Also the damage on his mustang is not consistent with what she said, it is consistent with her failing to turn and merge safely. So that should be not at fault word vs word, or even just not at fault. If his adjuster assigns him any % of liability at all, ask to speak with their boss and just keep going up the line until they change their verdict. You can ALWAYS fight it and ALWAYS go up the chain of command. That's not his fault at all.

After the guy refused to give me his information and gave me fake information.

So from my knowledge and working in Law Enforcement, the officer just takes the report and writes both sides of the story in the report and then the insurance company comes out and assess the damage to make sure the report is true. The insurance companies also fight it out to see who’s at fault and if so how much they are at fault. So Melo should be good, it’s obvious what happened. The insurance companies will be able to tell for sure what happened. That officer was trying to be lazy and let both parties pay for it out of pocket to get out of a report.

Dont know about in the USA but in the UK we have a rule that states "when emerging from a side road, and a vehicle is approaching with its indicator going, DO NOT ASSUME it is going to turn" There is also another factor which does not seem to be mentioned here, it is that as she was on the side road and he was on the major road, there would have been either a give way line or stop line that she would have had to cross. If she hit him, then she failed to give way. As a driving Instructor with over 35 years behind me , I always tell my students there are no 'Yeah buts' in the law. Yeah but he was indicating, don't mean shit. Yeah but he was speeding, don't mean shit. yeah but the sun was in my eyes, don't mean shit. You broke the rules, its your fault. She is wrong and he should stick to that.

Same thing almost happened to me i was driving on the left lane in a 3 lane road and some lady pulled out of a parking lot ( NO OTHER CARS IN THE ROAD) and she gets infront of me driving slow. I managed to brake in time and switch lanes. We ended up at the traffic light and i rolled down my window and she said “im supposed to let traffic through” 🤦‍♂️🤦‍♂️🤦‍♂️

I hate those people. When I was 16, I was driving my dad’s ford excursion which I had just spend an entire week Buffing to perfection because he was gonna sell it. Anyways, I changed lanes from the far left to the center lane then this guy in the right lane changes to the center after I was already in the lane and side swipes me. Then he lies to the cop saying that we were both entering at the same time and the cops believed him so we both got tickets. I was pissed so I got my story and the evidence ready for court to fight it but turns out he was an ex cop and got the tickets dismissed because he knew he couldn’t win.

Always amazes me how the average driver becomes an expert on accident reconstruction when most departments of any size have specially trained officers to do so. In my experience, in minor accidents, Officers don't assign "fault", just write what they observe and are told. Only serious crashes warrant an investigation as to cause; spent a lot of years dealing with and around this stuff.

No lie this kind of situation just happened to me about two months ago.....was at a train stop with my miata.....and this lady in front of me backed right into my front end and then swore up and down that I ran into her as I explained what happened to the cop took me about 5 mins and it took her over 20 mins to explain....moral of the story everyone needs dash cams....she didn't have insurance and never received a ticket for her actions ...and the cop even said in the police report that she backed into

Just moved out of Louisiana after living there for the better part of 20 years (90% of my life) and I literally can't tell you how many close-calls (and I mean ones that make you pull over and think) I've head because people in LA just drive however the fuck they want. This is a prime example, almost as if that chick was expecting him to just move out of her way. Got into my first accident just a couple days ago and totaled my challenger, was a case of me just cruising straight through a green light and the other person turning from incoming traffic right into me as if I wasn't there. Let's just say a challenger ways a bit more than a Mazda 3, its incredible how far I threw that fucker back into the turning lane. I walked away completely unscratched thankfully, not sure what happened to him after he got hauled off in the ambulance. His insurance did cut me a damn nice check though, way more than I thought. Shreveport drivers get their licenses from cereal boxes, be careful there!

Don’t know about there, but in Australia, if you turn on to a road that another driver is already on, the person that is turning on to the road must let the other driver go past safely first no matter what. So in this case the lady can’t even try to argue because the rule is she must wait for all traffic no matter what. It’s 100% her fault no argument no matter what! No matter what! (Phrase of the day haha)
