They took it without lawful authority so why should you be out of pocket for the recovery? To be honest though given Daniel's advice you may have now effectively sold it, so perhaps a win in the end?

I guess technically aslong as they had a valid warrant and if no one was there to prove the bike wasn't owned by the shop they kinda did have lawful authority at that point to take it but now they know its 100% down to them to return it at there cost and in my opinion they should pay compensation for the time he wasn't able to use it.

While you would win in court and get a judgment, it would be a judgment against a bankrupt company. Would it have priority as a post-insolvency event or would it just count in pari passu with other unsecured debts? If the latter, it might never get paid and almost certainly won't be paid in full. I would make sure you get the bike back rather than have a bankrupt company be in debt to you. Perhaps go and get the bike and then sue them for the costs incurred getting it - at least then the debt would be smaller.

The judgement would be against the company that took it to sell things off for the bankrupt company. Not the company that went bankrupt.

@@Weekzey Possibly. That depends on whether they have taken the property to sell on behalf of the bankrupt company or if they have bought the property from the bankrupt company to then try and sell at a profit. I'm not sure how these companies usually operate.

@@Liberty_Freedom_Brotherhood @dhvsheabdh It's not clear what happened here. He says the firm went bankrupt (by which he presumably means it went into insolvent liquidation). Recovery agents don't get involved in insolvencies. A receiver is appointed to dispose of the assets. Any claim is always against the company, not the receiver. It isn't at all clear who this recovery agent is an agent of. If the company is insolvent then individual creditors can't recover their debts themselves and have to wait for the receiver (so that all creditors are treated fairly), so sending bailiffs in to seize assets isn't an option (and if that were what had happened, there are specific processes to go through when bailiffs seize assets that don't belong to the debtor, you shouldn't need to sue them for conversion). If what actually happened is the assets of the firm were all bought out of the insolvency (the firm may also work as a recovery agent but they weren't acting as one in this case) then the act of conversion was committed by the receiver on behalf of the insolvent company, not by the buyer. Since the insolvent firm was a "mercantile agent" (they were given the bike for the purpose of selling it) the buyer may well have acquired good title to it and the only claim is against the insolvent company (which may explain why they are saying he can collect it at his own cost - they are doing a good deed by giving it back). "In pari passu" is standard terminology familiar to anyone that knows the first thing about insolvency. It is much clearer to use the standard terminology than to dumb it down, which can create ambiguity.

Get off your backside and go and get the bike back. Think yourself lucky they bothered to get in touch with you. I’d get on the train and be there the next day if it was worth that much money. You don’t need to hire a van at all or make excuses. You got lucky, move on and learn a lesson.
