I was at a Small Claims Court where the claimant said "the facts speak for themselves" when asked to clarify he said "everyone knows car dealers sell unroadworthy cars". He lost!

Just apply to the court to have the case thrown out on no reasonable prospects of success.

Go to your bank, draw up a bankers draft or similar and send it to him recorded. that ends your obligation to pay him, and is a defense you can write in the box on the small claims form once received, send proof, and don't even attend, he will lose.

He knows what he's doing. It's going to be cheaper for you to just pay him. Then your business won't have a judgment registered against you for the base claim amount.

Don't you have to refund to the original payment card due to money laundering etc.

You should. If a person buys on credit card and then gets a refund to a separate account they can also stop the credit card payment... you lose twice and then it's work for you to get that money back.

He should go to Weymouth with £350 in cash and tell the guy he has to accept it because it is legal tender. He'll be the first person in history to say that and it be true.

@@tosspot1305 legal tender must be accepted for a *debt* a shop is not a debt situation. so in this case, yes, he does have to accept legal tender

no because if the customer decides to ring his bank and raise charge back then he will have to pay it. the customer has returned the goods so is entitled to a refund. if the bloke here gives him 350 cash or bank transfer, and the customer decides to raise a charge back, its going to be really hard for this bloke here to prove he has already refunded him. how can he prove he has given him 350 in cash.... and lets say he does a bank transfer, which you are not protected on like a card transaction or card refund.... the customer could turn around and say oh the bank transfer was for something else.......... the shop owner should only refund the customer via the refund to the card so the transaction is clear!
